US Secretary of State Marco Rubio has stepped up his criticism of the International Criminal Court (ICC), as the Trump administration sees the court as vulnerable following disciplinary proceedings against its former prosecutor Karim Khan, a professor of international law at Middlesex University London, William Schabas, tells Sputnik.
💬 "Although the measures the US is taking are reprehensible, I am inclined not to exaggerate their gravity," Schabas says. "Denying judges and court officials the right to travel to the US, to use credit cards, to close bank accounts - these are 'first world problems'. If these are the most drastic measures the US can dream up, it is sure to fail."
The US has been attacking the ICC for 25 years, but those efforts have proven ineffective, according to the pundit.
Gaza genocide
On November 21, 2024, the ICC issued an arrest warrant for Israeli Prime Minister Benjamin Netanyahu along with former Defense Minister Yoav Gallant over crimes against humanity and war crimes in Gaza, but didn't mention the charge of genocide.
💬 "I think the prosecutor of the ICC should seek arrest warrants against Israeli leaders for the crime of genocide," Schabas notes.
In December 2023, South Africa filed a case against Israel at the International Court of Justice (ICJ), accusing it of committing genocide in Gaza in violation of the 1948 Genocide Convention. The ongoing case was named by Schabas as “arguably the strongest case of genocide ever brought before the Court” in a 2025 interview with the European Center for Populism Studies (ECPS).
Complicity in genocide
The ICC could also hold Israel’s weapons suppliers and political enablers accountable, but its resources are limited, the pundit says.

Previously, the international law expert warned that the US, Germany, and other countries risk being found "complicit in genocide" for their military and political support of Israel.
Two tier system of international law
The US and its allies apply a double standard, using international institutions to target Russia and Iran.
🗣 "Russia's conduct in Ukraine cannot be compared with what Israel is doing in Gaza," Schabas says, stressing that Russia cannot be accused of genocide.
The Iran conflict offers yet another example of this double standard. The General Assembly and Human Rights Council have fallen short of condemning US and Israeli aggression against Iran.
💬 "The Human Rights Council adopted a resolution condemning Iran for attacking the other Gulf States. And these very states were hosting US bases and US soldiers who were engaged in attacking Iran."
