Happy Tuesday Everyone!
Today the justices will convene to hear one case for oral argument this morning.
1). Beaird v. United States — No. 25-5343
- Kendrick Beaird challenges a federal sentencing enhancement that increased his recommended prison sentence because his firearm had a 17-round magazine. The enhancement relied on commentary to the Federal Sentencing Guidelines, rather than an explicit definition in the guideline itself.
- The Supreme Court will decide whether courts should continue deferring to that commentary under its 1993 decision in Stinson v. United States.
Arguments for this case begin at 10 a.m. ET. Here is a link to listen live - https://www.supremecourt.gov/oral_arguments/live.aspx

It’s long conference day, which brings the question most people ask, what is the difference between the regular conference and a long conference?
Here’s your answer - the long conference is an extended version of a regular Friday conference, however, instead of a dozen or more petitions, the justices have hundreds of petitions to review. All of the cases that have piled up over the summer recess are set to be reviewed today.
An order list will be released on Monday October 5 at 9:30amET. if you have any questions regarding the long conference, ask away in the chat board. | 4 999 |

Weekend Recap
• Missouri files appeal to the US Supreme Court, seeking to overturn a Missouri Supreme Court decision regarding the state’s redistricting map. Justice Kavanaugh has ordered a response to the application by today. The state argues that if the current decision is allowed to stand, there will likely be voter confusion regarding the general election congressional maps, given that the map ordered to be used in the midterm elections will not replicate the one used during the primacy elections.
• The Trump administration has once again appealed a decision regarding USPS mail-in ballot policy ahead of the midterm elections, which was blocked by a district court judge on Friday. The DOJ filed an appeal with the Supreme Court on Sunday morning. Justice Jackson ordered a response to the application by Wednesday.

| 20 | BREAKING - Supreme Court rules 8-1 restoring an FCC policy granting political parties and joint fundraising committees access to lowest unit charge (LUC) discounted broadcast ad rates for coordinated candidate ads. Justice Jackson dissented.
