Here is the third and final opinion of the day from the Supreme Court. Case - T. M v. University of Maryland Medical System Corporation Authored by - Justice Sotomayor Joined by - Justices Thomas, Alito, Kavanaugh and Jackson. Holding - The Rooker-Feldman doctrine bars federal district court jurisdiction over cases brought by state-court losers complaining of injuries caused by state-court judgments rendered before the district court proceedings commenced and seeking district court review and rejection of those judgments, regardless of whether the state-court judgment remains subject to further review in state appellate proceedings. Here is the second opinion of the day from the Supreme Court. Case - Hunter v. United States Authored by - Justice Kagan Joined by - Chief Justice Roberts, Justices Alito, Sotomayor, Gorsuch, Kavanaugh, Barrett and Jackson. Holding - An agreement not to appeal a sentence is unenforceable when it would result in a miscarriage of justice—meaning, when it would leave in place the kind of egregious error that would bring the judicial system into disrepute. Here is the third and final opinion of the day from the Supreme Court. Case - Abouammo v. United States. Authored by - Justice Kagan Joined by - Unanimous Court Holding - A defendant charged with violating §1519 must be tried in the district where the falsification occurred; he cannot be tried in a different district where the investigation was located because no “conduct constituting the offense” happened there. Authored by - Justice Jackson Joined by - Unanimous Court Holding - To determine whether an omission of a claim in the bankruptcy context was inadvertent or mistaken for purposes of judicial estoppel, courts should look to the totality of the circumstances surrounding the omission; the Fifth Circuit erred by artificially narrowing its inquiry to whether the debtor had knowledge of the underlying facts or a potential motive to conceal the claim. Authored by - Chief Justice Roberts Joined by - Justices Alito, Sotomayor, Kagan, Gorsuch, Kavanaugh, Barrett and Jackson. Holding - Because forfeiture orders issued under §503(b)(4) do not definitively resolve the parties’ legal obligations, and the FCC’s factual findings in its forfeiture proceedings are not conclusive, it does not violate the Seventh Amendment for the Commission to issue forfeiture orders without the involvement of a jury. Here is the first opinion of the day from the Supreme Court. Case - Hikma Pharmaceuticals v. Amarin Pharma. Authored by - Justice Jackson Joined by - Unanimous Court Holding - Amarin has failed to state a claim for active inducement in viola- tion of §271(b), so its complaint cannot withstand Hikma’s motion to dismiss. The central question is whether Amarin plausibly alleged that Hikma actively encouraged infringing use, not merely whether doctors could plausibly read the alleged statements as instructions to infringe. NEWS - Justice Barrett’s home was targeted in an apparent “swatting incident” late Wednesday evening. Because every Supreme Court Justice is assigned a 24-7 security detail provided by the Supreme Court Police Personnel, authorities coordinated with the specific detail and no additional resources were dispatched for the matter.
