FAQ: Why does the Supreme Court always release its controversial decisions in June? Believe it or not, it is actually unintentional. The justices, along with their law clerks, work tirelessly to ensure that cases are decided smoothly without any disruptions. Typically, the more controversial a case is, the more it requires deeper consideration from the justices drafting the majority opinions to ensure sufficient support is secured to establish the official opinion of the Court. This process alone takes weeks, and often months, to complete. Furthermore, justices also handle petitions from their respective circuits, which includes the consideration of hundreds of such petitions each week. Simply put, unanimous decisions tend to take less time than controversial, split decisions. That concludes our coverage of the opinions of the 2025, 2026 Supreme Court term. Thank you to everyone who joined us throughout this incredible journey. Not to worry, though, the Supreme Court may be entering it, summer recess, but we all know that the cases will be piling up and emergency orders will likely be issued throughout the summer. Justice Kavanaugh concurred in part and dissented in part. Holding - Children born in the United States to parents unlawfully or tem- porarily present are “subject to the jurisdiction” of the United States and are citizens at birth under the Fourteenth Amendment’s Citizen- ship Clause. B.P.J Authored by - Justice Kavanaugh Joined by - Chief Justice Roberts, Justices Thomas, Alito, Gorsuch, and Barrett Holding - Title IX allows schools to provide separate women’s and men’s sports teams defined by biological sex, and West Virginia has permis- sibly maintained female sports for biological females consistent with Title IX. Dissent - Justice Sotomayor filed an opinion concurring in the judgment in part and dissenting in part, in which Justice Kagan and Justice Jackson joined. Good Tuesday Morning Supreme Court Enthusiasts. It’s the very last day of opinions for the Supreme Court 2025-2026 term, oh what a ride this one has been. We will start out at 10amET, and continue from then. We’ll be here every step of the way, don’t worry! Here is a list of the opinions to be handed down this morning: - National Republican Senatorial Committee v. FEC (campaign finance) - Little v. Hecox (trans athletes) - West Virginia v. B.P.J (trans athletes) - Trump v. Barbara (birthright citizenship) The only caveat is the order they will come down, as there is still some uncertainty regarding the author of each, however that part really doesn’t matter too much. Holding - An alien standing in Mexico does not “arriv[e] in the United States” by attempting, and failing, to set foot in this country. An alien “arrives in the United States” only when he crosses the border.
