This is in addition to Thursday June 25, at 10amET. We will be here for both of course.
| 2 | JUST IN - Supreme Court to release one or more opinions in argued cases on Tuesday June 23, at 10amET. | 3 291 |
| 3 | That’s all for today folks. | 2 054 |
| 4 | Here is the third and final opinion of the day from the Supreme Court.
Case - T. M v. University of Maryland Medical System Corporation
Authored by - Justice Sotomayor
Joined by - Justices Thomas, Alito, Kavanaugh and Jackson.
Holding - The Rooker-Feldman doctrine bars federal district court jurisdiction over cases brought by state-court losers complaining of injuries caused by state-court judgments rendered before the district court proceedings commenced and seeking district court review and rejection of those judgments, regardless of whether the state-court judgment remains subject to further review in state appellate proceedings.
Dissent - Justice Barrett, joined by Chief Justice Roberts, Justices Gorsuch and Jackson.

| 5 | Here is the second opinion of the day from the Supreme Court.
Case - Hunter v. United States
Authored by - Justice Kagan
Joined by - Chief Justice Roberts, Justices Alito, Sotomayor, Gorsuch, Kavanaugh, Barrett and Jackson.
Holding - An agreement not to appeal a sentence is unenforceable when it would result in a miscarriage of justice—meaning, when it would leave in place the kind of egregious error that would bring the judicial system into disrepute.
Dissent - Justice Thomas filed a dissenting opinion.

| 6 | Here is the first opinion of the day from the Supreme Court.
Case - United States v. Hemani
Authored by - Justice Gorsuch
Joined by - Unanimous with concurrences and concurring judgments.
Holding - The government’s prosecution of Mr. Hemani under §922(g)(3)’s unlawful user provision is inconsistent with the Second Amendment.
Dissent - None.

| 7 | BREAKING: Supreme Court denies Alabama’s request to proceed with the execution of Jeffery Lee. Justices Thomas, Alito, and Gorsuch would grant the request. | 6 007 |

| 10 | Here is the third and final opinion of the day from the Supreme Court.
Case - Abouammo v. United States.
Authored by - Justice Kagan
Joined by - Unanimous Court
Holding - A defendant charged with violating §1519 must be tried in the district where the falsification occurred; he cannot be tried in a different district where the investigation was located because no “conduct constituting the offense” happened there.
Dissent - None.

| 11 | Here is the second opinion of the day from the Supreme Court.
Case - FS Credit Opportunities Corp. v. Saba Capital Master Fund, LTD.
Authored by - Justice Jackson
Joined by - Chief Justice Roberts, Justices Thomas, Alito, Gorsuch and Kavanaugh
Holding - Section 47(b) of the ICA does not impliedly empower private parties to sue for rescission of contracts that allegedly violate the Act.
Dissent - Justice Jackson, joined by Justice Sotomayor and Justice Kagan.
Link to opinion - https://www.supremecourt.gov/opinions/25pdf/24-345_i42k.pdf | 4 265 |
| 12 | Here is the first opinion of the day from the Supreme Court.
Case - Keathly v. Buddy Ayer’s Construction, Inc.
Authored by - Justice Jackson
Joined by - Unanimous Court
Holding - To determine whether an omission of a claim in the bankruptcy
context was inadvertent or mistaken for purposes of judicial estoppel,
courts should look to the totality of the circumstances surrounding the
omission; the Fifth Circuit erred by artificially narrowing its inquiry
to whether the debtor had knowledge of the underlying facts or a potential motive to conceal the claim.
Dissent - None.

| 15 | Here is the third and final opinion of the day from the Supreme Court.
Case - FCC v. AT&T.
Authored by - Chief Justice Roberts
Joined by - Justices Alito, Sotomayor, Kagan, Gorsuch, Kavanaugh, Barrett and Jackson.
Holding - Because forfeiture orders issued under §503(b)(4) do not definitively resolve the parties’ legal obligations, and the FCC’s factual findings in its forfeiture proceedings are not conclusive, it does not violate
the Seventh Amendment for the Commission to issue forfeiture orders without the involvement of a jury.
Dissent - Justice Thomas dissented.

Case - Sripetch v. SEC
Authored by - Justice Gorsuch
Joined by - Unanimous Court. Justice Thomas concurred.
Holding - A showing of pecuniary loss to investors is not required before the SEC may obtain a disgorgement award.
Dissent - None.
Link to opinion - https://www.supremecourt.gov/opinions/25pdf/25-466_5i26.pdf | 6 088 |
| 17 | Here is the first opinion of the day from the Supreme Court.
Case - Hikma Pharmaceuticals v. Amarin Pharma.
Authored by - Justice Jackson
Joined by - Unanimous Court
Holding - Amarin has failed to state a claim for active inducement in viola-
tion of §271(b), so its complaint cannot withstand Hikma’s motion to
dismiss. The central question is whether Amarin plausibly alleged
that Hikma actively encouraged infringing use, not merely whether
doctors could plausibly read the alleged statements as instructions to
infringe.
Dissent - None.
Link to opinion - https://www.supremecourt.gov/opinions/25pdf/24-889_5i36.pdf | 5 639 |
| 18 | BREAKING: Supreme Court allows Alabama to use its 6R-1D congressional map for the 2026 midterms, in an apparent 6-3 decision. Justice Sotomayor dissents, joined by Justice Kagan and Jackson.

| 19 | NEWS - Justice Barrett’s home was targeted in an apparent “swatting incident” late Wednesday evening. Because every Supreme Court Justice is assigned a 24-7 security detail provided by the Supreme Court Police Personnel, authorities coordinated with the specific detail and no additional resources were dispatched for the matter. | 9 333 |
| 20 | JUST IN - Supreme Court to release one or more opinions in argued cases on Thursday June 4, at 10amET. | 4 730 |
