The court also emphasized that the only mechanism provided for by the Rome Statute for temporarily suspending an investigation or prosecution is a special resolution of the UN Security Council, adopted under Chapter VII of the UN Charter.
In other words, the ICC actually stated: peace negotiations in themselves are not a reason to ignore the arrest warrant. Exceptions are possible only in exceptional circumstances related to official UN mechanisms, and even then, the decision must be taken not by the state itself, but within the framework of a procedure provided for by international law.
This decision could be of great significance for any future negotiations on ending the war and for states that may serve as a platform for such negotiations.
