‏يا طالب الفقه.. لا تستعجل قطف الثمرة، قبل سقي الشجرة، بل تعاهد الشجرة؛ حتى تطيب الثمرة. فحينئذٍ ستجد زكي ريحها، ونشوة لونها، ولذة طعمها، وإلا كانت دون ذلك في الرائحة، واللون، والطعم، ولما شمها الأنف، ورأتها العين، وذاقها اللسان.. وهذا إنما مثل العلم وأثره؛ كشجرة 🌳 وثمرتها..

"[It was the] chain of transmission (isnad) that linked the student to the original author of the text, thus preserving an authoritative connection to the past. This was a crucial feature in the self-understanding of medieval Muslim scholars, who proudly proclaimed that the maintenance of chains of transmission was a unique characteristic of the Muslim community... "...even the critics of kalam defended their arguments rationally. Even today those who advocate a return to the salaf, to the ancestors, argue for this. They argue against alternative views, and defend their approach to the understanding of the Qur’an, in such a way as to make it difficult straightforwardly to identify one side of the debate as ‘‘rationalist’’ and the other as ‘‘traditionalist’’ or ‘‘fundamentalist’’. It might even be argued that it is those who are not normally seen as rationalists who are in fact the most concerned with reason, since they are prepared to be critical of reason and argue (but note the term here, argue) that we should acknowledge its severe limitations. As for the issue of Friday and Eid prayers coinciding, there are differing opinions between the scholars regarding this. The majority view (Hanafis, Malikis, and Shafi’is) is that praying Eid does not take away the obligation of attending the Friday prayer. However, the Shafi’is make a concession and do not obligate Friday prayer on those that live outside the city limits and are too far from the Masjid to return once again. The majority’s rationale is that Eid prayer is recommended, and Friday prayer is an obligation, and that they have separate timings that do not overlap. The Hanbalis say that praying Eid takes away the obligation of Friday prayer as an individual obligation, and instead Duhur is prayed. It is still, however, required for the Imam of the Muslims and his appointees to lead Friday prayers, as a communal obligation, for those that could not make it to Eid prayer. Their rationale is as follows: - Eid and Friday prayers are both obligations according to the Hanbalis, with the former being a communal obligation (Fard Kifayah), and the latter being an individual obligation (Fard ‘Ayn), whereas Eid according to the majority is recommended, and not obligatory at all. (Keep in mind that the scholars of Usul say that there is no difference between Fard ‘Ayn and Fard Kifayah in their starting points, meaning that both are binding upon every single individual initially, yet the Fard Kifayah falls from the individual once enough people have preformed it. Thus, this rationale stands, since both Eid and Friday are obligations on every individual initially). - They overlap in terms of timing, since Friday prayer also begins of after the sun rises a spear’s length above the horizon - only according to the Hanbalis, and Imam as-Shafi’i’s older view, but not the majority -. - The two prayers overlap in nearly all of their other conditions and pillars/obligations, such as requiring 40 people, etc. - With all of those things in mind, the Hanbalis use the principle - mentioned by Ibn Rajab and others - that states: when two acts of worship concur, of the same category/genus, at the same time, neither of whom are a follower/completer of the other, nor is one of being made up (qada’) = they dissolve into one another, and only one act of worship is performed. However, in every case, praying both Eid and Friday is more virtuous and safer.

بعض العلماء احتج على حجية القياس بالمعقول حيث قالوا بأن الأحكام لا حصر والنصوص محصورة متناهية ومواطن الإجماع محدودة أيضاً، فلا بد من طريق لا يتناهى يربط به باقي الأحكام..وما ذلك إلا القياس. وهذا الاستدلال يشبه استدلال الجويني رحمه الله، وقد نال الغزالي رحمه الله في أساس القياس وابن برهان في الأوسط إلى ضعف ذلك. قال ابن برهان: (( وهذا أيضا باطل، فإن الخصم يقول: لا أسلّم أنه ليس في النصوص وفاء بالأحكام، بل هي نافية بها، والظواهر والعمومات والخفيّ والجلي وإليه الإشارة بقوله تعالى ( تبياناً لكل شيء ) )) يعني كأن الإمام ابن برهان يقول أن المخالف يرجع الأحكام إلى عمومات النصوص أو إلى المفهوم إن كان يقول بالمفهوم.. والغزالي أطال بذلك جدا في كتابه أساس القياس بما لم أر مثيلاً له لغيره من الأصوليين.

A debate between the great hadith critics 'Alī ibn al-Madīnī and Yaḥyā ibn Ma'in occurred on whether touching the penis nullifies one's ablution, with Imam Aḥmad ibn Ḥanbal presiding over them as a mediator. Ibn al-Madīnī ruled in favour of the hadith of Ṭalq (which says ablution is not required), while Ibn Ma'īn believed that the hadith of Busrah (which obliges ablution) was the decisive text of the issue. Every side weakened the hadith of their counterpart: Ibn al-Madīnī weakened the hadith of Busrah because it contains an unknown intermediary (a soldier sent by Marwan to corroborate the hadith from Busrah), while Ibn Ma'īn weakened the hadith of Talq because it contains the narrator Qays ibn Talq, who is unknown. Because of these complications, it became evident that the existing ḥadīths were insufficient to resolve this legal issue. Subsequently, both sides strove to find reports from the Companions to back their viewpoint. Ibn Ma'īn produced a report from Ibn 'Umar in which he stated that the one who touches his penis must renew his ablutions. In response, Ibn al-Madīnī cited a report on the authority of Ibn Mas'ūd, who held the view that touching the penis is of no consequence for one’s state of ritual purity. However, Ibn Ḥanbal intervened by noting that the chain of this report attributed to Ibn Mas'ūd contains an impugned narrator. To address this concern, Ibn al-Madīnī related an alternative report from the Companion 'Ammār b. Yāsir in which 'Ammār is reported to have said that he saw no difference between touching his penis and touching his nose. Ibn Ḥanbal is satisfied with this latter report, even exclaiming further that the reports of Ibn 'Umar and 'Ammār are equal in terms of strength. He concludes by stating that one may follow either of the two reports narrated from these Companions.

هل ذكر المفتي الدليل على فتواه عيب ومنكر؟ قال ابن القيم رحمه الله: "عاب بعضُ الناس ذكرَ الاستدلال في الفتوى، وهذا العيب أولى بالعيب! بل جمال الفتوى وروحها هو الدليل، فكيف يكون ذكرُ كلام الله ورسوله وإجماع المسلمين وأقوال الصحابة والقياس الصحيح عيبًا؟ وهل ذكرُ قول الله ورسوله إلا طراز الفتاوى؟ وقولُ المفتي ليس بموجِب للأخذ به، فإذا ذكر الدليلَ فقد حرُم على المستفتي أن يخالفه، وبرِئ هو من عهدة الفتوى بلا علم. وقد كان رسول الله صلى الله عليه وسلم يُسأَل عن المسألة، فيضرب لها الأمثال، ويشبِّهها بنظائرها. هذا، وقوله وحده حجة، فما الظنُّ بمن ليس قوله بحجَّة، ولا يجب الأخذ به! وأحسن أحواله وأعلاها أن يسوغ قبول قوله، وهيهات أن يسوغ بلا حجة! وقد كان أصحاب رسول الله صلى الله عليه وسلم إذا سئل أحدُهم عن مسألة أفتى بالحجة نفسها، فيقول: قال الله كذا، وقال رسول الله صلى الله عليه وسلم كذا، أو فعل كذا؛ فيُشفَى السائل، ويبلِّغ القائل. وهذا كثير جدًّا في فتاويهم لمن تأمَّلها. ثم جاء التابعون والأئمة بعدهم، فكان أحدهم يذكر الحكم ثم يستدل عليه، وعلمه يأبى أن يتكلَّم بلا حجة، والسائل يأبى قبول قوله بلا دليل. ثم طال الأمد، وبعد العهد بالعلم، وتقاصرت الهمم، إلى أن صار بعضهم يجيب بـ «نعم» أو «لا» فقط، ولا يذكر للجواب دليلًا ولا مأخذًا، ويعترف بقصوره وفضلِ من يفتي بالدليل. ثم نزلنا درجةً أخرى إلى أن وصلت الفتوى إلى عيب من يفتي بالدليل وذمِّه. ولعله أن يحدث للناس طبقة أخرى لا يُدرى ما حالهم في الفتاوى! والله المستعان". أعلام الموقعين عن رب العالمين (179/5). #تقييداتي

In this short video, Shaykh Hamad al-Hamad demonstrates how much a ṣāʿ* corresponds to in modern measures for staple foods, a point which is needed for the purpose of paying Zakat al-Fitr. - Wheat: approx. 2.04 kilograms - Rice: approx. 2.1 kilograms - Dates: approx. 1.6 kilograms *1 ṣāʿ = four mudds. A mudd was a conventional unit of measure and refers to the amount that fills the two hands of an average person when drawn together.

بعث إليَّ بعض الإخوة بحثًا في مسألة إخراج القيمة، ثم نصحني –جزاه الله خيرًا– ألا أنسب الكلام إلى غير قائله، لأنه لم تثبت هذه النقول بجواز إخراج القيمة عن الأئمة مثل أبي حنيفة وغيره، وهذه مجازفة متسرعة منه، لأن ما كتبه أغلبه نابع من سوء فهم كلام الأئمة هؤلاء ومخالفة نصوصهم الصريحة. والمشكلة أن صاحب البحث يتصور أن المذهب الفقهي ليس إلا نقولًا مفردة عن الأئمة، وأن تحقيق المسألة يكون بمجرد إثبات: هل قال الإمام الفلاني هذا القول أم لم يقله! وهذا –مع الأسف– تصور قاصر لطبيعة المذاهب الفقهية. فالمذهب ليس مجرد قائمة أقوال تُنقل عن الإمام المؤسس، بل هو مدرسة علمية متكاملة لها: أصول وقواعد، وفروع مبنية على تلك الأصول، وتخريج للفروع على الأصول، بل أحيانًا تخريج للأصول على الفروع. ولهذا فإن المذهب يتكوَّن عبر اجتهاد طبقات العلماء من الأصحاب والخرَّاجين والمنقحين والمُرجِّحين، حتى يستقر القول المعتمد في المذهب. ومن هنا يقع الخلط عند بعض الناس؛ فإذا قيل: "قال أبو حنيفة بجواز إخراج القيمة"، ظن أن المقصود بالضرورة النص الحرفي المنقول عن الإمام نفسه. والحقيقة أن المراد في اصطلاح الفقهاء غالبًا هو: أن هذا هو المعتمد في المذهب الحنفي، أي ما استقر عليه اجتهاد علماء المذهب عبر قرون. وهذا أمر معروف في جميع المذاهب. فكثيرًا ما يقال مثلًا: "المذهب عند الشافعية كذا"، مع أن الإمام الشافعي قد لا يكون نص على المسألة بعينها، وإنما خرَّجها أصحاب الوجوه أو رجحها المنقحون من علماء المذهب. فالمذاهب الفقهية ليست أقوال أفراد، بل مدارس علمية ممتدة عبر قرون طويلة، يتعاقب فيها العلماء على التحقيق والترجيح والتنقيح. ثم إن مسألة أخرى ينبغي أن تُفهم قبل الخوض في مثل هذه القضايا، وهي أن الخلاف الفقهي ليس نوعًا واحدًا؛ بل منه: خلاف سائغ معتبر، وخلاف غير سائغ. فإذا فُهم هذا الأصل انحل كثير من الإشكال. ومسألة إخراج القيمة في الزكاة من المسائل التي وقع فيها خلاف سائغ بين أهل العلم، وقد قال بها أئمة معتبرون، وانتسبت إلى مذاهب فقهية معروفة، وعمل بها علماء عبر القرون. فإذا علم الإنسان أن هذا القول قول معتبر في مذهب من المذاهب، فليعلم أن المسألة حينئذٍ ليست نقضًا ولا إبطالًا، وإنما خلاف فقهي معتبر. فوجود قول آخر لا يعني نقض المذهب، بل يعني أن في المسألة اجتهادًا مختلفًا بين المدارس الفقهية. ومن أمثلة تخبط صاحب هذا البحث أنه نص في بداية كلامه على أن من ينقل القول بجواز إخراج القيمة إنما ينقله في الزكاة المفروضة دون زكاة الفطر. وهذا يدل –مع الأسف– على أنه لم يفتح كتابًا واحدًا لا في الأصول ولا في الفقه؛ إذ لو رجع إلى كتب المذهب لعلم أن جواز إخراج القيمة قاعدة مطّردة عند الحنفية في الزكوات كلها، وتشمل زكاة الأموال وزكاة الفطر وغيرهما. ومن أمثلة ذلك أيضًا أن الحنفية بنوا جواز إخراج القيمة في الزكوات على أصل معتبر عندهم، وهو النظر إلى مقصد الإغناء في الزكاة؛ فالمقصود عندهم تحقيق كفاية الفقير وإغنائه، فإذا حصل ذلك بالقيمة جاز عندهم إخراجها. ولهذا نظروا في هذه المسألة إلى المقاصد والمعاني. فما ما ذكره صاحب البحث من مثالٍ على أن الحنفية لا يجيزون إخراج القيمة في الأضاحي، فليس فيه نقض لقاعدتهم كما توهم؛ لأن المقصود في الأضحية عندهم إراقة الدم والتقرب بذلك، فلهذا لم يجز عندهم إخراج القيمة فيها. فهم في الحالتين ينظرون إلى مقاصد العبادة ومعناها: فإن كان المقصود الإغناء جاز إخراج القيمة، وإن كان المقصود فعلًا معينًا –كإراقة الدم– لم تقم القيمة مقامه. ولهذا فإن نقض الأقوال المعتمدة في المذاهب لا يكون بتتبع النقول المجتزأة، ولا بإثبات أن الإمام الفلاني قال أو لم يقل فحسب، بل بفهم منهج المذاهب وأصولها وطبيعة الخلاف الفقهي. ولهذا فإني أنصح –لوجه الله تعالى– بعض المتعجلين من طلاب العلم: ألا يتصدروا قبل التمكن، وألا يتكلموا في مسائل المذاهب قبل فهم طبيعتها، وأن يأخذوا العلم عن أهله، وعن المشايخ المتحققين به. فإن الكلام في العلم قبل فهمه لا يزيد المسائل إلا اضطرابًا.

What people admire in us is often only the outward appearance of our character, actions, or success. Yet none of us is free from faults. In His mercy, Allah conceals many of our shortcomings and sins from the sight of others. If those hidden flaws were exposed, the admiration we receive might quickly disappear. Allah is al-Sittīr, the One who conceals the faults of His servants. The Prophet ﷺ taught that on the Day of Judgement, Allah will remind a believer of his sins, then say: “I concealed them for you in the world, and today I forgive you for them.” (Bukhārī). This shows the immense mercy of Allah, who not only hides our faults in this life but may forgive them in the Hereafter. The image reflects Kintsugi, the art of repairing broken pottery with gold. Just as gold restores a broken vessel with dignity, Allah’s mercy and covering grant us honour despite our imperfections.

كتب بعض الفضلاء: ‏نصيحة إلى أئمة المساجد حول ثلاث مخالفات في دعاء القنوت.. قأقول وبالله التوفيق: إن الدعاء شأنه عظيم وقدره كبير ولهذا قال صلى الله عليه وسلم: (الدعاء هو العبادة). والعبادة لا تكون مقبولة الا بشرطين اثنين عظيمين: الشرط الأول: الإخلاص، فلا يدعو العبد إلا وهو يبتغي وجه الله تعالى بعيدا عن الرياء والسمعة. و الشرط الثاني: المتابعة للنبي صلى الله عليه وسلم فإذا اختل واحد من هذين الشرطين فإن العمل يكون باطلاً مردوداً. ولهذا ينبغي لإمام المسجد أن يتحرى السنة في دعاء القنوت وأن يبتعد عن المخالفات التالية: المخالفة الأولى: رفع الصوت الشديد بالدعاء والذي ينبغي أن يكون الإمام حال الدعاء متضرعا لله تعالى بعيدا عن الصراخ أو رفع الصوت الشديد عملا بقوله سبحانه وتعالى:﴿ ادْعُوا رَبَّكُمْ تَضَُّرعًَا وَخُفْيَةً إِنَّهُ لَا يُحبُُِّ المعُْْْتَدِينَ﴾. وجاء في صحيح البخاري، أنَّ الصحابة رضي الله تعالى عنهم رفعوا أصواتهم بالدعاء فقال صلى الله عليه وسلم: "يا أيها الناس اربعوا على أنفسكم فإنكم لا تدعون أصمَّ ولا غائباً إنه معكم إنه سميع قريب." قال شيخ الإسلام ابن تيمية رحمه الله تعالى: [رفع الأصوات في الذكر المشروع لا يجوز إلا حيث جاءت به السنة كالأذان والتلبية ونحو ذلك، فالسنة للذاكرين والداعين ألا يرفعوا أصواتهم رفعاً شديداً]. المخالفة الثانية: التكلف في السجع والبعد عن الأدعية المأثورة ، قال ابن عباس رضي الله عنهما لمولاه عكرمة: «انظر السجع من الدعاء فاجتنبه فإني عهدت رسول الله وأصحابه لا يفعلون إلا ذلك»أي: ذلك الاجتناب.[رواه البخاري]. قال القرطبي رحمه الله : [ومنها أن يدعو بما ليس في الكتاب والسنة فيتخير ألفاظاً مفقرة، وكلماتٍ مسجعة قد وجدها في كراريس لا أصل لها ولا معول عليها فيجعلها شعاره، ويترك ما دعا به رسول الله صلى الله عليه وسلم ، وكل هذا يمنع استجابة الدعاء ] ـ المخالفة الثالثة : الدعاء بتغني وتلحين وتطريب وترتيل والتزام بأحكام التجويد والمدود فهذا مما ينافي الضراعة والخشية والاستكانة. قال الكمال ابن الهمام الحنفي رحمه الله: [ ولا أرى أن تحرير النغم في الدعاء يصدر ممن يفهم معنى الدعاء والسؤال ، وما ذاك إلا نوع لعب؛ فإنه لو قُدِّر في الشاهد سائل حاجة من مَلِك أدّى سؤاله وطلبه بتحرير النغَم فيه - من الخفض والرفع والتطريب والترجيع كالتغني - نُسِب ألبتة إلى قصد السخرية واللعب؛ إذ مقام طلب الحاجة: التضرع لا التغنّي] وجاء في فتاوى اللجنة الدائمة ما نصه: [على الداعي أن لا يشبّه الدعاء بالقرآن فيلتزم قواعد التجويد والتغني بالقرآن فإن ذلك لا يعرف من هدي النبي صلى الله عليه وسلم ولا من هدي أصحابه رضي الله تعالى عنهم]. وقال الشيخ بكر أبو زيد رحمه الله: [ إن التلحين والتطريب والتغني والتقعر والتمطيط في أداء الدُعاء مُنكر عظيم يُنافي الضراعة والابتهال والعُبودية وداعية للرياء والإعجاب وتكثير جمع المُعجبين به وقد أنكر أهل العِلم من يفعل ذلك في القديم والحديث ]. ولهذا يقال إن دعاء القنوت مثله مثل دعاء الخطيب على منبره لافرق بينهما في ترك التغني والترتيل أو مراعاة التجويد. أسأل الله تعالى أن يوفقنا جميعا للعلم النافع والعمل الصالح وأن يرينا الحق حقا ويرزقنا اتباعه والباطل باطلا ويرزقنا اجتنابه. وصلى الله وسلم على نبينا محمد وعلى آله وصحبه أجمعين ‎

«ولا ريب أن المحققين من كل طائفة على أن خبر الواحد والاثنين والثلاثة قد يقترن به من القرائن ما يحصل. العلم الضروري بخبر المخبر، بل القرائن وحدها قد تفيد العلم الضروري؛ كما يعرفُ الرَّجُلُ رضا الرَّجُلِ وغضبه، وحبه وبغضه، وفرحه وحزنه، وغير ذلك مما في نفسه؛ بأمور تظهر على وجهه قد لا يمكنه التعبير عنها. [...] ولا يقول عاقل من العقلاء: إن مجرد خبر الواحد، أو خبر كل واحد يفيد العلم، بل ولا خبر كل خمسة أو عشرة؛ بل قد يخبر ألف وأكثر من ألف، ويكونون كاذبين إذا كانوا متواطئين».

A Critical Review of Political Candidates as al -Muʾallafatu Qulūbuhum - English Version Project Iḥyāʾ presents this academic research paper as a systematic study of the recent fatwa by AMJA and FCNA permitting the allocation of Zakāt funds to political candidates. This work is not presented as a fatwa, but as an academic study of the application of Zakāt to the category of al-muʾallafa qulūbuhum, examined within the broader methodological trend of contemporary modernist fiqh, particularly maqāṣid-centered approaches and their impact on juristic reasoning. It offers a scholarly analysis of the ruling’s legal foundations, assumptions, and implications. Formal fatāwā have been issued by AFA and Dār al-Qāsim. This study forms part of Project Iḥyāʾ’s broader research effort to examine contemporary methodological trends in modernist fiqh.
