The SPLC is still pressing the government for records of its work with federal law enforcement, including its “field sources”—informants who also served as confidential human sources for federal agencies.
For the SPLC, this information could be useful at trial. The group appears to be building a defense that casts its field-source program as cooperative and well known to federal law enforcement and the indictment as evidence that Trump has weaponized the DOJ against his political opponents.
According to court filings, FBI database searches for “SPLC” and “Southern Poverty Law Center,” limited to 2007–2023, produced 19,746 hits. Searches for each of the 28 field sources by name returned between 0 and 4,220 hits.
The SPLC wants the court to order these records turned over.
Prosecutors maintain that the confidential human source (CHS) category of information is not Brady material. They say that if any of those field sources may appear as witnesses at trial, disclosure may fall under Giglio. The government has asked the FBI to determine whether any SPLC informants who are likely government trial witnesses also worked as FBI confidential human sources.
