የዋና ጥያቄ፣ መስቀለኛ ጥያቄና ድጋሚ ጥያቄ ምንነት በአጭሩ፦ 1. ዋና ጥያቄ (Examination-in-Chief) ዋና ጥያቄ የመጀመሪያ ጥያቄ ሆኖ መስካሪውን የጠራው ተከራካሪ ለምስክርነት ላቀረበው ሰው የሚያቀርብ ጥያቄ ሲሆን የዚህ ዋና ዓላማም ከጉዳዩ ጋር ተያይዞ የጠሪው ተከራካሪ ወገንን የሚደግፉ እውነታዎችን በሚመለከት የምስክሩን ቃል ለማቅረብ ነው፡፡ ጭብጡን የሚመለከትና በቀጥታ ወይም በሌላ መንገድ ምስክሩ በሚያውቀው ወይም ሊያውቀው በሚችለው ነገር ላይ ብቻ የተመሰረተ ጥያቄ ነው። በዚህ ግዜ ማለትም በዋና ጥያቄ ላይ ምስክሩን መምራት ወይም መሪ ጥያቄ ማቅረብ ፈጽሞ የተከለከለ ነው፡፡ ጠያቂው መልሱን ለምስክሩ መንገር ወይም ማሳየት የለበትም፡፡ 2. መስቀለኛ ጥያቄ (Cross-Examination) ይህ ጥያቄ ከዋና ጥያቄ ቀጥሎ በተቃራኒ ተሟጋች በኩል ለምስክሩ የሚቀርብ ሲሆን አላማውም የምስክሩን ትክክለኛነት እና ተዓማንነት ለመፈተን፤ በተሰጡት የምስክርነት ቃል ውስጥ የማይጣጣሙ ነገሮችን ለማጉላት ወይም ቀድሞ የተሰጡትን የምስክርነት ቃል ሊያዳክሙ የሚችሉትን እውነታዎች ለማስተዋወቅ ምስክሩ በመጀመሪያ ጊዜ የሰጠው የምስክርነት ቃል የተሳሳተበትን፤ እውነት ያልሆነውን ቃል፣ ወይም አጠራጣሪ መስሎ የተገመተበትን ነጥብ ፍርድ ቤቱ እንዲረዳው ለማድረግ የሚቀርብ ጥያቄ ነው። በመስቀልኛ ጥያቄ ላይ መሪ ጥያቄዎችን መጠየቅ የተፈቀደ ነው፡፡ 3. ድጋሚ ጥያቄ (Re-Examination) ይህ በመጨረሻ ደረጃ ላይ ምስክሩን በጠራው ተከራካሪ ወገን ለምስክሩ የሚሰነዘር ጥያቄ ሲሆን ጥያቄውም ምስክሩ በመስቀልኛ ጥያቄ ላይ የሰጠውን ቃል ለማብራራት ወይም ለማጣራት የሚቀርብ ጥያቄ ነው። ከመስቀለኛ ጥያቄ ጋር ያልተያያዙ አዳዲስ ርዕሶችን አንስቶ በድጋሚ ጥያቄ ላይ መጠየቅ አይፈቀዱም፡፡ በዚህ ግዜ ላይ፤ ምስክሩን መምራት ወይም መሪ ጥያቄ ማቅረብ አይቻልም። * መሪ ጥያቄ መሪ ጥያቄ ጠያቂው በጥያቄው ለተጠያቂው መልሱን የሚያሳይበት ሁኔታ ነው፡፡ ይህ ጠያቂው ቃላትን ወደ አፍ እንደማስገባት ማለት ነው፡፡ ለምሳሌ ቀይ መኪና አይተሃል አይደል? በሚል የሚቀርብ ጥያቄ መሪ ጥያቄ ነው፡፡ምክንያቱም ጠያቂው ምስክሩ አዎ ብሎ እንድመልስ የቀረበ መሪ ጥያቄ ነው፡፡ ነገር ግን ያየሄው መኪና ምን ዓይነት ቀለም ነው? በሚል የሚቀርብ ጥያቄ መሪ ጥያቄ አይደለም፡፡ የ/ፍ/ስ/ስ/ህግ/ቀ. 263 (1-4) ወ/መ/ስ/ስ/ህ/ቁ. 137(1-3)፣ 139

ከመጠን በላይ መወፈር ያስቀጣል‼️ 👉ውፍረታቸው ለወንዶች የወገብ ስፋት 85 ሴ.ሜ፤ ለሴቶች ደግሞ 90 ሴ.ሜ በታች መሆን አለበት ተብሏል። በጃፓን ከመጠን በላይ ውፍረትን በመከላከል የህብረተሰቡን ጤና ለማሻሻል ያለመው "ሜታቦ" የተሰኘው ህግ ተግባራዊ መሆኑን የሃገሪቱ የጤና ጥበቃ ሚኒስቴር አስታውቋል። ይህ በሥራ ላይ የዋለው ይህ ህግ በተለይም ከ40 እስከ 74 ዓመት የሆናቸውን የህብረተሰብ ክፍሎች ላይ ትኩረት ያደረገ ነው ተብሏል። ህጉ በየዓመቱ በሚደረጉ የጤና ምርመራዎች የወገብ ስፋት መለካትን ግዴታ ያደርጋል ተብሏል። በዚህም መሠረት ለወንዶች የወገብ ስፋት ከ85 ሴንቲሜትር፣ ለሴቶች ደግሞ ከ90 ሴንቲሜትር በላይ ከሆነ፣ ግለሰቡ በጤናው ላይ አደጋ ሊያስከትል በሚችል ደረጃ ላይ ይገኛል ተብሎ ይታሰባል ነው የተባለው። ይህ መለኪያ ከመጠን በላይ ክብደት ጋር ተያይዘው የሚመጡ እንደ ስኳር በሽታ፣ የደም ግፊት እና የልብ በሽታዎችን አስቀድሞ ለመከላከል ወሳኝ ነው ተብሏል። ህጉ ወገባቸው ከሚፈቀደው መጠን በላይ ለሆኑ ሰዎች የቅጣት እርምጃ ከመጣል ይልቅ፣ የአኗኗር ዘይቤያቸውን እንዲያሻሽሉ፣ የአመጋገብ እና የአካል ብቃት እንቅስቃሴ ምክሮችን እንዲያገኙ ያግዛል እየተባለ ነው። ይህ ህግ የተነደፈው የህብረተሰቡን የጤና ግንዛቤ በማሳደግ፣ የጤና አደጋዎችን በመቀነስ እና የመንግስትን የጤና አገልግሎት ወጪዎች በመቆጠብ ጤናማ ኑሮን ለማስፈን እንደሆነ ተገልጿል። በተጨማሪም፣ ህጉ አሰሪ ድርጅቶችና የአካባቢ መንግስታት ዜጎቻቸው በጤና ምርመራው ላይ እንዲሳተፉ እና የውፍረት መጠንን እንዲቀንሱ የማበረታታት ኃላፊነት እንዲወስዱ ያደርጋል ተብሏል። SHARE"  @Ewunet_Media

ሕጋዊ መከላከል • የራስን ወይም የሌላውን ሰው መብት ህገ ወጥ ከሆነ ጥቃት ወይም በቅርብ ከሚደርስ ህገወጥ ጥቃት ለማዳን ጥቃቱ እንዳይደርስ ለማድረግ ሌላ መንገድ ሳይኖር ከሁኔታው መጠን ባለማለፍ የተፈጸመ ድርጊት ህጋዊ መከላከል በወንጀል የማያስቀጣው የራስን ወይም የሌላውን ሰው መብት ህገ ወጥ ከሆነ ጥቃት ወይም በቅርብ ከሚደርስ ህገወጥ ጥቃት ለማዳን ጥቃቱ እንዳይደርስ ለማድረግ ሌላ መንገድ ሳይኖር ከሁኔታው መጠን ባለማለፍ የተፈጸመ መሆኑ ሲረጋገጥ ስለመሆኑ ከኢ.ፌ.ዲ. ሪብሊክ የወንጀል ሕግ አንቀጽ 78 ይዘትና መንፈስ የምንረዳው ጉዳይ ነው፡፡ ሕጋዊ መከላከል የወንጀል ተጠያቂነትን የማያስከትለው ተመጣጣኝ የሆነ ዘዴ ወይም መሳሪያ በመጠቀም በቅርብ መድረሱ የማይቀረውን ህገ ወጥ የሆነ ጥቃት ለመከላከል አስፈላጊ የሆነ ድርጊት መፈፀም ሲረጋገጥ ስለመሆኑ የኢ.ፌ.ዲ. ሪብሊክ የወንጀል ህግ አንቀፅ 78 እነ 79 ድንጋጌዎች ጣምራ ንባብ በግልጽ ያሳያል፡፡ ሰ/መ/ቁ. 86570 ቅጽ 15፣ ወ/ህ/ቁ. 78፣ 79 ህጋዊ መከላከልን ከመጠን ማሳለፍ የወንጀሉ ማቋቋሚያ በሆነ ጊዜ እንደ ቅጣት ማቅለያ ምክንያት አይወሰድም፡፡ ህጋዊ መከላከል የቅጣት ማቅለያ ምክንያት ስለመሆኑ የወ/ሕጉ አንቀጽ 79/1/ ይገልፃል፡፡ በወ/ሕጉ አንቀጽ 541/ሀ/ ሥር ከተመለከቱት የድንጌጋው ማቋቋምያ ምክንያቶች አንዱ ሕጋዊ መከላከልን ከመጠን በማሳለፍ የተፈፀመ የነፍስ ግድያ ወንጀል እንደሆነ ተመልክቷል፡፡ የወ/ሕጉ አንቀጽ 79/1/ የቅጣት ማቅለያ ምክንያት አድርጎ በገለፀው አኳኋን አንቀጽ 541/ሀ/ ሁለተኛው ሀረግ ደግሞ ወንጀሉን ለማቋቋም እንደሚችል ደንግጓል፡፡ እንዲህ አይነት ሁኔታ በተፈጠረ ጊዜ በወ/ሕጉ አንቀጽ 82/2/ እንደተደነገገው ድርጊቱን ለማቋቋም የተደነገገው ልዩ ክፍል ተፈፃሚነት ይኖረዋል፡፡ ሰ/መ/ቁ. 57446 ቅጽ 12፣ ወ/ህ/ቁ. 79፣ 82(2)፣ 84(2) https://t.me/ethiopianlawyerspage
