SC case on 125(4) crpc:
July 2026
Issue:
Wife files an application u/s 125 crpc seeking maintenance from Husb.
Trial court grants Wife some interim maintenance.
Husband now files an application u/s 125(4) seeking vacation of the interim order basis that he has gathered some evidence to show wife indulging in adultery.
Trial court: Application filed by Husband u/s 125(4) will be decided ONLY AFTER final adjudication of Wife's application.
Challenged in SC.
SC's ruling: Trial court committed an ERROR here.
Trial court should have decided the application filed by Husband without waiting for final adjudication of Wife's application seeking maintenance.
SC also made some observations regarding using services of PRIVATE Detectives.
Holding that there is no law governing such private investigations, there is a need to develop mechanism over the same.

Accused is a teacher. A SC/ST student committed s-ui-cide bcs of humiliating acts by this teacher. Anticip bail refused -> upheld by Ker HC.
Although I m not sure if teacher could be convicted under 306 IPC (whatever BNS it maybe)....

Sharing this here because para 5 (@ page 5) of the judgement has mentioned 11 SC cases on sec 498A.
So, good case to have all major cases on 498A.
