By providing you with their own self-generated "Liability Order" documents instead of directing you to the Court for a certified extract under Rule 68 of the Magistrates' Courts Rules 1981, the Council has:
Provided Inaccurate Data: They have represented their own internal financial ledger entries as a formal court judgment, which is factually and legally inaccurate.
Failed the Transparency Principle (Article 5(1)(a)): Data must be processed "lawfully, fairly and in a transparent manner." Deliberately withholding the correct legal procedure to obtain court records is a breach of the transparency and fairness principles.
Breached the Right of Access (Article 15): When you requested the "judicial order," their failure to provide the correct legal route (redirecting you to the Court) effectively denies your right of access to the accurate personal data held by the Court, providing you with "conflicting or incomplete" information instead.

7. STATUTORY FAILURE OF THE MONITORING OFFICER (LGHA 1989)
5.1 Under Section 5 of the Local Government and Housing Act 1989, the Monitoring Officer has a strict statutory duty to report any proposal, decision, or omission that constitutes a contravention of law or maladministration. The Monitoring Officer has entirely failed this statutory duty.
5.2 He permitted a direct contravention of law by allowing statutorily disqualified employees to bypass the Full Council and adopt the 2026/27 CTRS.
5.3 He failed to enforce the mandatory statutory consultation required by Schedule 1A of the LGFA 1992, allowing a procedurally unlawful tax scheme to be weaponized against the public.
5.4 He remains complicit in severe maladministration by failing to rectify the Council's unlawful operation of a statutory financial relief fund (Section 13A(1)(c) of the LGFA 1992) without a logged audit trail. | 340 |

- IT’S A STATUTORY OBLIGATION TO HAVE IT…
The council is currently in breach of Section 10(1) of the Freedom of Information Act 2000.,
The partial responses provided are highly contradictory regarding the holding of DWP data under Section 130 and 131 ( Information Sharing Information sharing in relation to welfare services etc) of the Welfare Reform Act 2012, and exposes a complete lack of financial auditing regarding Section 13A (2)(c) applications; particularly paragraph 6; council has the power to reduce the amount to ZERO;
FOI relates directly to the unlawful adoption of the 2026/27 Council Tax Reduction Scheme by an unelected “officers” Paul Jones and Mel Creighton (as in the High Court Ruling LL AU V Trafford Council 2025, Discretionary Scheme Discriminatory) is in breach of:
1. Section 67 of the Local Government Finance Act 1992, shall be discharged only by the authority" (the Full Council).
2. 13(a) cannot be delegated Section 67(2)(aa) of the Local Government Finance Act 1992. Paul Jones and Mel Creighton signed it as an Officer Decision.
3. Schedule 1A of LGFA 1992. (3)(1)(a) legally demands a public consultation:
(a)consult any major precepting authority which has power to issue a precept to it,
The Council failed to consult interested parties( ie: SUPREME COURT RULING: R (Moseley) v Haringey LBC)
4. Breach of the Local Government Finance Act 1992. Paul Jones signed it off himself as an Officer Decision.
Schedule 1A of LGFA 1992 legally demands a public consultation:
