August Visa Bulletin has been published. This means the end for many DV-2024 selectees whose case numbers are higher than cutoffs listed. It is not fair to them. Excessive overselection causes so much misery.

FAQ: If I file a mandamus/unreasonable delay lawsuit, does the government have 60 days to give me a final visa decision? Answer: No. Remember the visa application process and the lawsuit process never merge into the same process. They are always separate. Judges do not issue visas. Consular officers do not issue court orders. After you file a lawsuit against the government, the government has 60 days to file a responsive pleading to the complaint. That pleading can either be an answer to the complaint, or much more frequently, a motion to dismiss (which we will prepare a response in opposition). Of course we hope to see progress with the visa application in the first 60 days, but it is never guaranteed.

To clarify for all, the Circuit Court of Appeals for the District of Columbia issued its order in Gomez (including Mohammed, Fonjong, and Kennedy), Goodluck, Rai, and Goh on June 25, 2024. Unfortunately, the court sided with the Biden administration.
