The US Constitution doesn’t provide a right to clean drinking water or accurate information from public officials, a divided federal appeals court ruled.
The decision affirms the dismissal of a lawsuit over alleged lead-contaminated drinking water in Jackson, Mississippi.
The full US Court of Appeals for the Fifth Circuit found that the lawsuit from the Jackson residents alleged violations of due process rights not granted by the Constitution.
In a majority opinion by Judge Kurt Engelhardt, the appeals court said there was no historical basis to find such rights fall under that clause.
“The Constitution does not provide redress for every governmental wrongdoing,” Engelhardt said.
A lawyer for the residents didn’t immediately return a request for comment.
Clarence Webster III, a Jones Walker partner who represented the city of Jackson, called the decision “one of the most significant constitutional rulings the Fifth Circuit will issue this year.”
“We are pleased the en banc court affirmed the City’s position and provided important guidance on the limits of constitutional liability,” Webster said in an emailed statement.
Engelhardt, a Donald Trump appointee, said the residents have other options, like pursuing tort claims, electing officials who will better manage the water system, and petitioning representatives for other solutions.
Residents of the city have claimed that officials deliberately allowed lead to contaminate the drinking water, harming those who drank it. Jackson has denied those allegations.
A divided Fifth Circuit panel in 2025 revived the residents’ claim against the city of Jackson, over their right to bodily autonomy. That ruling was vacated when the en banc Fifth Circuit took up the case.
Engelhardt said while the residents raised a right to bodily integrity, that right applies in instances like sexual assault by a police officer and forced medication of prisoners.
Mismanagement of a water system, he said, is “wholly different.”
And while the Supreme Court has found some due process rights to fall under the common-law right to informed consent, Engelhardt said those cases don’t include a right to accurate information from public officials.
He said that even if the residents had established a violation of due process rights, the city officials would still be granted qualified immunity from the claims because no clearly established right was violated.
Engelhardt’s opinion was joined by nine other Republican-appointed members of the court.

His second Epstein Files bill has “real teeth.”
It would empower the states to bypass Trump’s DOJ and launch their own prosecutions.
And over 100 lawmakers already signed a discharge petition to force a vote on it.
Here’s everything the new bill would do:
“One, it allows the Attorney General in … New Mexico to use Epstein files in a prosecution in state courts for state crimes.”
“Zorro Ranch is as massive and expansive and is involved in the whole Epstein saga as much or more so than Epstein Island.”
“They have gone in there, the New Mexico investigators.”
“But something unprecedented is happening.”
“The federal Attorney General is not cooperating with the state Attorney General.”
“He has been stonewalled by Todd Blanche.”
“So this bill gives him unfettered access to the files so that he could prosecute crimes that happened at Zorro Ranch.”
Dave Smith: “Wow, so this has got real teeth on it this time.”
Massie: “If you want a prosecution and you’ve given up on Trump’s administration, we’ve got a prosecutor who is ready to go after it.”
Second, the new bill states “unambiguously” the DOJ cannot continue to refuse to release files about internal deliberations on “whether to prosecute or investigate” Epstein’s co-conspirators.
Third, the bill would officially give legal standing to “three categories of litigants” to file their own lawsuits.
“It gives standing to survivors.”
“Because here’s another category of those 3 million files that are still being withheld.”
“302 forms that the FBI must complete after they’ve interviewed a witness or a victim.”
“Those files are missing.”
It would also give standing to state Attorneys General to file lawsuits “if Todd Blanche or the next Attorney General doesn’t cooperate.”
“And it would give members of Congress standing” to file lawsuits.

Mark’s siblings vacillate between annoyance and deep hurt, bewildered that something so distant from the ordinary life of their family—national politics—could enter their intimacy and overwhelm it.
The no-contact phenomenon is one manifestation of a deeper spiritual jaundice. We’re estranged from ourselves in a way that makes the risk and friction of other people difficult to bear.
Politics gives that interior unease somewhere to go. It can be particularly potent as a repository for discontent because it supplies both a diagnosis and a culprit.
Diffuse dissatisfaction is difficult to metabolize. Ideology offers a simplistic answer for why you feel bad and who did it to you. And once the culprit is someone you know, you can do something about it.

| 13 | A federal judge on Friday extended her prohibition against the U.S. Postal Service implementing President Donald Trump’s executive order seeking to limit mail voting during the midterms, putting another major obstacle in the way of the administration as the first states begin sending out mail ballots.
The preliminary injunction from U.S. District Court Judge Indira Talwani replaces a temporary order she granted blocking the Postal Service’s plan.
The Trump administration has already asked the Supreme Court to lift Talwani's temporary order, and will likely appeal her latest ruling as well.
The administration is running out of time to make big changes in voting procedures, though. North Carolina began sending out its first mail ballots Friday and more states will swiftly follow.
The legal battle could have major ramifications for this year’s elections, when control of Congress is at stake. Nearly one-third of voters in the U.S. cast mail ballots and election officials contend there isn’t enough time to revise their systems to comply with the new Postal Service directives.
Talwani, who was appointed by President Barack Obama, pointed to the tight timeline in her ruling.
“Plaintiff States are required under state law to mail millions of ballots to voters on a prescribed timeframe. As detailed below, they are unable to pivot this late in the election cycle, nearly guaranteeing significant disenfranchisement for eligible voters,” she wrote.

| 15 | President Trump's envoys Steve Witkoff and Jared Kushner will travel this weekend to Moscow and Kyiv for talks on ending the war, U.S. officials said.
This will be the first visit by Witkoff and Kushner to Kyiv since President Trump returned to office.
"They're bringing with them a plan to end the war," Trump told reporters in the Oval Office on Friday.
Witkoff and Kushner will travel on Friday, hold talks with Russian President Vladimir Putin at the Kremlin on Saturday and then meet with Ukrainian President Volodymyr Zelensky in Kyiv on Sunday.
The visit by Trump's envoys comes 10 days after CIA Director John Ratcliffe met with the heads of the Russian intelligence and security services in Moscow.
Ratcliffe was trying to learn whether the Russian intelligence chiefs could persuade Putin to pursue diplomacy with the goal of ending the war.
Witkoff and Kushner met with President Trump at the White House Thursday to discuss the trip.
Ukrainian and U.S. officials said they've been discussing the Kyiv trip for months.
In recent days, they said, the trip was on and off several times for different reasons before they settled on this weekend.
Negotiations between Russia and Ukraine mediated by the Trump administration were paused in mid-February after the Iran war started.
Witkoff and Kushner have held separate talks over the past few months with Russian and Ukrainian negotiators, but little progress has been made.
Zelensky's chief of staff, Kyrylo Budanov, told local media last week that U.S.-mediated talks with Russia could resume in September.
Yes, but: Ukrainian officials are highly skeptical of Putin's intentions and say they have intelligence that suggests Putin is planning a major escalation of the war.
Russia has also intensified missile and drone strikes on Ukrainian cities, including Kyiv.
Zelensky's deputy chief of staff, Pavlo Palisa, told reporters on Friday that Putin has ordered his military to prepare several operational scenarios for an offensive in northern Ukraine, with Kyiv and Chernihiv identified as key areas.
Putin has also rejected several proposals by the Trump administration to hold a trilateral summit with Trump and Zelensky to try to reach a diplomatic breakthrough.
Zelensky confirmed the meetings on X and said Ukraine is preparing for Witkoff and Kushner's visit.
He noted that Ukraine agreed not to conduct airstrikes against Russia on Saturday so that the U.S. envoys can arrive safely.
"Russia must do the same, ensuring there are no air strikes from its side for the time needed to hold these talks and handle the logistical matters related to this American visit," Zelensky said.
He said Ukraine wants the talks with Kushner and Witkoff to be substantive. "We will see what proposals Steve and Jared bring and what they are told in Moscow in response," he said. | 41 |

Let me begin this messy story by telling you that I grew up on the South Side of Chicago, in a lower middle class, racially mixed ward that also included the University of Chicago and a few upper middle class neighborhoods.
It was controlled by an elected Democratic party leader named Marshall Korshak, an attorney whose brother was Sidney Korshak.
As I would learn in high school, Sidney was the most powerful mob boss in Chicago. He oversaw drugs, prostitution, police payoffs and had ties to the corrupt International Brotherhood of Teamsters.
Decades later, when I was at the New York Times, Jeff Gerth, an expert on the financing of organized crime, and I published, after months of interviews, a four-part series on the newspaper’s front pages focused on Sidney and his control of racketeering, prostitution, and vice in Chicago.
The date the first installment of our series was to appear was delayed at the last minute because of a sudden Teamsters strike that kept the Sunday New York Times and its Korshak revelations from being distributed around the country for days.
The senior editors at The Times understood why the strike had taken place, but that fact was never published.
Our reporting involved two long background interviews with Roy Cohn, the prominent New York mob lawyer and fixer who had famously served as counsel for Senator Joseph McCarthy when he was on the House Un-American Activities Committee during the postwar Red Scare and later as a mentor to New York businessman Donald Trump.
Once assured we were speaking privately, Cohn provided a firsthand view of the link between politics and crime as well as the way certain prominent senators were kept supplied with pretty women.
So I knew the sort of man Jeffrey Epstein was when he first became known for providing airplanes for various politicians, including a former president, and later for running what seemed to me to be a series of a high-end whorehouses at no charge for prominent men, many high up in the world of American business and New York finance.
And so when I learned the story I’m about to tell, I wanted nothing to do with it.

After Newsom became Governor of California, a couple of her ridiculous "documentaries" made their ways into the public school system of California.
Schools pay licensing fees to Jennifer Newsom's nonprofit for the right to show her woke garbage movies to students.
Her nonprofit then pays her.
Millions have been paid from the nonprofit to the Newsoms or to Jennifer Newsom's little production company over the years for the rights to show these movies.
"Gender isn't real, it's just a spectrum. Masculinity is toxic." Blah blah blah.
Tax dollars paid to the Newsoms for the right to confuse kids and to teach them this woke garbage.
One of her documentaries on "toxic masculinity" is titled "The Mask You Live In." Newsom's wife named it that because according to her, if you say it quickly, it sounds like "the masculine."
That's the genius who created this "curriculum." She's the same person who slept with Harvey Weinstein and who later asked Weinstein for advice on how Gavin should handle his sex scandal in 2007.
Why would Jennifer Siebel Newsom ever be considered qualified to create something that is shown/taught in California public schools?
Imagine being a parent who has to pay to have the school force your kid to watch her videos. Imagine what would be promoted nationwide from a First Lady Siebel Newsom.
