The structural and administrative reasons behind this RTI response highlight the tactics involved:
1. Data Outsourcing to a Third-Party
VendorOSEPA does not handle the exam data directly. The entire Computer-Based Test (CBT), the raw score calculation, and the highly controversial normalization process were completely outsourced to a private testing agency (typically TCS/Edcil). OSEPA argues that because they only received the final processed "Select Lists" from the vendor, the raw mathematical data, individual normalization values, and exact cut-off matrices are technically not stored as physical documents or records in their immediate government database.
2. Legal Exploitation of Section 2(f) of the RTI Act
Under Section 2(f) of the RTI Act, a public authority is only required to provide data that already exists in a recorded format within their office. They are not legally obligated to create, compile, extract, or calculate new data to satisfy an applicant. Because OSEPA never generated a consolidated, official "State-Wide Cut-off Spreadsheet," the Public Information Officer (PIO) can technically issue a blanket reply stating that no such specific document exists in their physical record room.
3. Masking the "Draft Merit List" Deletions
Following the Division Bench's ruling that struck down Clause 8.3, OSEPA had to abandon their original district-wise allocation data structure and manually correct the database to switch to state-level merit prioritization.
