የጠፋው ሰው በሕይወት መመለስ እና ውጤቱ የመጥፋት ውሳኔ የተሰጠበት ሰው በሕይወት መመለስ የመጥፋት ውሳኔ ቀሪ ከሚሆንባቸው ምክንያቶች ውስጥ አንዱ እንደሆነ በፍትሐብሔር ሕግ ቁጥር 170 ሥር ተደንግጎ የምናገኘው ጉዳይ ነው። ጠፋ የተባለው ሰው መመለስ ደግሞ የራሱ ውጤቶችን እንደሚያስከትል በፍትሐብሔር ሕግ ቁጥር 171 ሥር የተመለከተ ሲሆን እነዚህም፡- • ጠፋ የተባለው ሰው የተወሰዱ ንብረቶችን በሚገኙበት አኳኋን ይወስዳል። ንብረቶቹ ተሽጠው ከሆነ ደግሞ የተሸጡበትን ዋጋ ይወስዳል፣ ስለሆነም ንብረቶቹን የያዙ ግለሰቦች በዚህ አግባብ ለተመለሰው ሰው የማስረከብ ግዴታ አለባቸው። (የፍትሐብሔር ሕግ ቁጥር 171)። ንብረቱን የያዙ ግለሰቦች በተንኮል ወይም በመጥፎ አስተዳደር ላጠፉት ነገር ካሳ የመክፈል ኃላፊነት አለባቸው (የፍትሐብሔር ሕግ ቁጥር 171(3))። • ጋብቻን በተመለከተ ግን በመጥፋት ውሳኔው የፈረሰው ጋብቻ መመለሱ ሕይወት እንዲዘራ ወይም እንደገና እንዲጸና የማድረግ ውጤት የለውም (የፍትሐብሔር ሕግ ሰ/መ/ቁ. 74791 ቅጽ 14፣ ሰ/መ/ቁ. 213917 ቅጽ 27)። ማጠቃለያ የመጥፋት ውሳኔ በሕይወት መኖሩ ባልታወቀ ሰው ምክንያት በቤተሰብ እና በንብረት መብት ላይ የሚፈጠርን ክፍተት ለመሙላት የተቀረጸ ጠቃሚ የሕግ መሣሪያ ነው። ሕጉ በአንድ በኩል የጠፋውን ሰው በሕይወት የመመለስ ተስፋና ንብረት ለመጠበቅ የጊዜ ገደቦችንና የዋስትና ግዴታዎችን የሚያስቀምጥ ሲሆን በሌላ በኩል ደግሞ የቀሩት ቤተሰቦችና ወራሾች ሕይወታቸውን እንዲቀጥሉና ንብረቱን እንዲያስተዳድሩ መብት ይሰጣል። በመሆኑም ሕጉ እንደሚደነግገው ያለ ፍርድ ቤት መደበኛ የመጥፋት ውሳኔ ማስታወቂያና ማረጋገጫ በሰዎች ንብረትና መብት ላይ መወሰን በሕግ ፊት ተቀባይነት የሌለው በመሆኑ ማኅበረሰቡ ይህንን ሥርዓት ተገንዝቦ በሕጋዊ መንገድ መብቱን ማስከበር ይኖርበታል። #ንቃተ ሕግና ሥልጠና ዳይሬክቶሬት የተዘጋጀ
