Breakfast Talk on “Arbitration of Energy Disputes” ——— On the morning of 10 September 2026, the National Commercial Arbitration Centre (NCAC) hosted the "Arbitration of Energy Disputes Seminar," one of the NCAC Annual Events, on the 8th Floor of GIA Tower, Koh Pich. The event was presided over by Mr. HIB Nareth West, President of NCAC, who delivered the welcome and opening remarks, and featured Mr. BUN Youdy, Managing Partner of Bun & Associates, and Mrs. Elodie DULAC, Partner of Peter & Kim, as honorable guest speakers. The seminar included a presentation on the overview of energy disputes and a panel discussion, moderated by Mr. VANN Yuvaktep, Vice Chair of the NCAC Education and Training Committee, followed by a question and answer session and an appreciation ceremony. The closing remarks were delivered by Mr. Jay COHEN, Chairman of the NCAC Education and Training Committee. The discussion covered the stakeholders and contracts commonly found in energy projects, the types of disputes they give rise to, the procedural challenges of arbitrating them, and the practical lessons for arbitrators handling complex energy cases. Mr. Igor Driesmans, Ambassador of the European Union to the Kingdom of Cambodia, his delegation, and a Representative of the European Chamber of Commerce in Cambodia (EuroCham). The Delegation of the European Union to the Kingdom of Cambodia is a diplomatic mission of the European Union, representing the interests and policies of the European Union in Cambodia as well as responsible for strengthening cooperation with the Royal Government of Cambodia in the areas of politics, economy, trade, investment, development, human rights, the rule of law, and sustainable development. On this occasion, NCAC, as a non-profit and independent commercial ADR institution, presented its mission to promote fair, independent, transparent, and efficient out-of-court commercial dispute resolution mechanisms in Cambodia, in order to ensure a favorable business environment and a fair settlement of commercial disputes. During the discussion, both parties exchanged experiences with one another and explored possibilities of cooperation in promoting and raising awareness of commercial arbitration in Cambodia, particularly among European Union investors operating in the country. NCAC believes that cooperation with the European Union (EU) will contribute significantly to raising awareness of commercial arbitration and to the sustainability of NCAC's operations and activities, as well as to the fulfilment of its mission of providing a favourable environment for businesses and foreign investors through the strengthening of fair, independent, efficient, and impartial out-of-court commercial dispute resolution mechanisms in Cambodia. 7	During the discussion, both parties exchanged experiences with one another and explored possibilities of cooperation in promoting and raising awareness of commercial arbitration in Cambodia, particularly among European Union investors operating in the country. AIAC is an independent, non-governmental and non-profit arbitral institution based in Kuala Lumpur, Malaysia, providing commercial alternative dispute resolution (ADR) services including arbitration, mediation and adjudication, at both the domestic and international levels. During the meeting, both sides exchanged views on recent developments in ADR in Cambodia and Malaysia. Discussions focused on strengthening bilateral cooperation, including the cross-promotion of the NCAC and AIAC arbitration and mediation rules within their respective jurisdictions, with the aim of enhancing awareness and encouraging greater use of institutional ADR services. Both sides also explored opportunities for future collaboration in capacity building, including specialised training programmes, and began discussions on the possible preparation of a Memorandum of Understanding (MOU) between the two institutions. Both institutions reaffirmed the importance of knowledge sharing and professional development in strengthening ADR frameworks and supporting the continued growth of dispute resolution practice in the region.
