التزام التخريج الفقهي المذهبي للنوازل المعاصرة على معتمدات المتأخرين، لعل أقل ما يقال فيه أنه عقيم من ناحية الأثر العملي، وإن كان مفيدا للدارس المتفقه. فإن معتمد الدرس المذهبي المتأخر قائم على التدقيق في عبارات الفقهاء المتأخرين، واستنباط الأحكام وتخريج الفروع منها. وللاختلاف الشديد في طبيعة كثير من نوازل العصر عن أواخر العصر السابق؛ لاختلاف الظروف العام في الحياة، فإن التفريع بناء على ألفاظ فقيه أو أكثر لن تجدي. والأولى هو التخريج من أدلة الشرع مباشرة، على وفق أصول المذهب وضوابطه وقواعده، كما كان يفعله المتقدمون من فقهاء المذاهب في تخريج الفروع على أصول مذاهبهم. فإن النص الشرعي معصوم صالح لكل زمان ومكان، وأصول الفقهاء في أصلها قطعية.
