በግንባታው ዓለም ስኬታማ ጉዞ ለማድረግ እና ገንዘብዎን ከብክነት ለመታደግ ከስራ ተቋራጮች (Contractors) ጋር ሲያደርጉት የሚገባውን ውልና ጥንቃቄዎች በዝርዝር ተመልከቱ፦
1. ህጋዊ ፈቃድ እና ምዝገባ 📄
ሥራ ከመጀመራቸው በፊት የታደሰ የንግድ ፈቃድ፣ የግብር ከፋይ መለያ ቁጥር (TIN) እና በዘርፉ የተሰማሩበትን ህጋዊ ማረጋገጫ መጠየቅ የመጀመሪያው እና ትልቁ የጥንቃቄ እርምጃ ነው።
2. የብቃት ማረጋገጫ (Grade) ⭐️
ተቋራጮች በምን ያህል አቅም እና ካፒታል እንደሚሰሩ የሚገልጽ ደረጃ (ከደረጃ 1 እስከ 10) አላቸው። ለሚሰሩት ፕሮጀክት የሚመጥን ደረጃ ያለው መሆኑን ማረጋገጥ አስፈላጊ ነው።
3. የስራ ልምድ (Portfolio) 🏢
ከዚህ በፊት የሰሩዋቸውን ተመሳሳይ ፕሮጀክቶች፣ የተጠናቀቁ ህንፃዎች ወይም ሌሎች ግንባታዎች በአካል በመሄድ ወይም በምስል ማየት የብቃታቸው ትልቁ ማሳያ ነው።
4. ውል እና ስምምነት (Contract) ✍️
በቃል የሚደረግ ንግግር በግንባታ ላይ ቦታ የለውም። የዋጋ ዝርዝር፣ የቁሳቁስ ጥራት፣ የሚጠናቀቅበት ጊዜ እና የክፍያ ሁኔታ በግልጽ የሰፈረበት ውል በህግ ባለሙያ መዘጋጀት አለበት።
5. የዋጋ ግምት እና ክፍያ (Budget) 💰
ክፍያዎች በሂደት (በደረጃ) እንጂ በአንዴ መፈጸም የለባቸውም። ስራው ሲሰራ እና የጥራት ምርመራ ሲያልፍ ብቻ ክፍያ እንዲለቀቅ ማድረግ ገንዘብን ከብክነት ይታደጋል።
6. የጊዜ ሰሌዳ (Timeline) ⏳
ግንባታው የሚጀምርበትን እና የሚጠናቀቅበትን ቀን በግልጽ የሚያሳይ የጊዜ ሰሌዳ (Schedule) ከውሉ ጋር መያያዝ አለበት። ዘግይቶ የሚጠናቀቅ ስራ ከፍተኛ ተጨማሪ ወጪ ያስከትላል።
7. የቁሳቁስ ጥራት (Quality Control) 🧱
በውሉ ላይ የተስማሙባቸውን የኮንክሪት መጠን፣ የብረት ዓይነት እና ሌሎች የግንባታ እቃዎች ጥራት በባለሙያ ማስመረመር ለህንፃው ጽናት ዋስትና ነው።
8. የሰራተኞች ዋስትና እና ደህንነት (Safety) 🦺
በግንባታ ቦታ ላይ ለሚደርሱ አደጋዎች ተቋራጩ ኃላፊነት አለበት። የኢንሹራንስ ሽፋን ያላቸው እና የደህንነት እቃዎች (Safety materials) የሚጠቀሙ መሆናቸውን ማረጋገጥ ተገቢ ነው።
9. የባለሙያ ቁጥጥር (Supervision) 📐
እርስዎ ራስዎ ኢንጂነር ካልሆኑ፣ የስራውን ሂደት የሚከታተል ገለልተኛ አማካሪ (Consultant) ወይም መሐንዲስ መቅጠር ተቋራጩ ጥራቱን የጠበቀ ስራ እንዲሰራ ይገፋፋል።
10. የዋስትና ጊዜ (Defect Liability Period) 🔑
ስራው ተጠናቆ ከተረከቡ በኋላም እንኳ ለተወሰነ ጊዜ የሚፈጠሩ ስንጥቆች ወይም ጉድለቶች በባለቤቱ ወጪ ሳይሆን በተቋራጩ እንዲስተካከሉ በውሉ ላይ መካተት አለበት።

201 ሜትር ርዝመት ያለው የግድብ ግንባታው 6 ነጥብ 4 ሚሊዮን ሜትር ኪዩብ የአፈር ቁፋሮ በማካሄድ አጠቃላይ ግድቡ ከሚፈልገው 7 ነጥብ 72 ሚሊየን ሜትር ኪዩብ የኮንክሪት ሙሊት ውስጥ 81 ነጥብ 2 በመቶው ማለትም 6 ነጥብ 27 ሚሊዮን ሜትር ኪዩብ የኮንክሪት ሙሊት (RCC) ሥራ መከናወኑን የፕሮጀክቱ ሥራ አስኪያጅ ኢንጂነር መብራቱ ተሾመ ተናግረዋል።
የኃይል ማመንጫ ቤቱ የቁፋሮ ሥራ እንዲሁም የሲቪል ሥራው የመጀመሪያ ደረጃ የኮንክሪት ሙሌት ሙሉ በሙሉ መጠናቀቁንና የኤሌክትሮ መካኒካል ሥራውን በታቀደው ጊዜ ለማጠናቀቅ ዕቃዎች በበርካታ ፋብሪካዎች እንዲመረቱ መደረጉንም ጠቁመዋል።
የፋይናንስ አቅርቦት በተለይም የውጭ ምንዛሬ እጥረት እና ተያያዥ ችግሮች በግንባታው ሂደት ላይ አሉታዊ ተፅዕኖ ፈጥሮ መቆየቱን ያስታወሱት ኢንጂነር መብራቱ፣ አሁን ላይ ተቋሙ ለፕሮጀክቱ የሚያስፈልገውን ፋይናንስ በራሱ በመሸፈኑ ግንባታው እየተፋጠነ ይገኛል ብለዋል።
የግድብ ግንባታውን በተያዘው በጀት ዓመት መጨረሻ ለማጠናቀቅ በጥቅምት 2021 ዓ.ም የመጀመሪያውን ተርባይን ወደ ኦፕሬሽን ለማስገባት እየተሠራ ነውም ተብሏል።

📌 2. የመሐንዲሱ/የሱፐርቫይዘሩ ሚና (The Engineer / Supervisor)
PPA 2011: Engineer ወይም Supervisor የአሰሪው (Employer) ወኪል ሆኖ ይሰራል፤ በዋናነት የአሰሪውን ጥቅም ይወክላል።
FIDIC 2017 (Clause 3): Engineer ገለልተኛ (Neutral) ሆኖ በሁለቱ ወገኖች መካከል ውሳኔ እንዲሰጥ ይጠበቃል።
Sub-Clause 3.7 አዲስ አሰራር አስቀምጧል፦ በመጀመሪያ መስማማት (Agreement) ላይ ለመድረስ ይሞክራል፣ ካልተቻለ ብቻ ነው ውሳኔ (Determination) የሚሰጠው።
📌 3. የጊዜ ማራዘሚያ እና ክሌም (EOT & Claims)
PPA 2011 (GCC Clause 27 & 44):
ተቋራጩ የጊዜ ማራዘሚያ (Extension of Time) መጠየቅ የሚችለው በቂ ምክንያት (የአየር ሁኔታ፣ የአሰሪው መዘግየት፣ የተለየ ልዩነት/Variation) ሲኖር ነው።
ጥያቄው በፅሁፍ መቅረብ አለበት፣ ነገር ግን እንደ FIDIC በጥብቅ የተወሰነ "የቀን ገደብ (Time-bar)" ላይኖረው ይችላል።
FIDIC 2017 (Clause 20):
Strict Time-Bar Clause (28 Days): ተቋራጩ ወይም አሰሪው ጉዳቱ/መዘግየቱ በታወቀ በ 28 ቀናት ውስጥ ማሳወቅ (Notice) ካልላከ፣ መብቱ ፈጽሞ ይቃጣል (Claim drops)!
በ FIDIC 2017 ሁለቱም ወገኖች (Employer & Contractor) እኩል የክሌም ስርዓት ይከተላሉ።
📌 4. የዋጋ ማስተካከያ (Price Adjustment)
PPA 2011 (GCC Clause 47): የፕሮጀክቱ ጊዜ ከ 18 ወራት በላይ ከሆነ እና በልዩ ውሉ (SCC) ከተፈቀደ ብቻ የዋጋ ማስተካከያ (Price Adjustment Formula) ይተገበራል።
FIDIC 2017 (Sub-Clause 13.7): በውሉ ማلاحጫ (Contract Data) ከተገለፀ በማንኛውም ጊዜ በምንዛሬ ወይም በቁሳቁስ ዋጋ ጭማሪ ምክንያት የዋጋ ማስተካከያ ይደረጋል።
📌 5. አለመግባባቶችን መፍታት (Dispute Resolution)
PPA 2011 (GCC Clause 24 & 25):
በመጀመሪያ በ Adjudicator (አስታራቂ) ይታያል።
ካልተስማሙ ወደ Arbitration (ግልግል ዳኝነት) ይሄዳል።
FIDIC 2017 (Clause 21):
DAAB (Dispute Avoidance/Adjudication Board): አለመግባባት ከመፈጠሩ በፊት ቋሚ DAAB ይቋቋማል። ዋና አላማው አለመግባባቶችን አስቀድሞ "ማስቀረት" (Avoidance) ነው።
ከ DAAB ውሳኔ በኋላ ካልተስማሙ ወደ ICC Arbitration ይሄዳል።
