Passport is not Proof of Citizenship – Understanding India’s Legal Position On Passport Seva Divas (24 June), the Ministry of External Affairs (MEA) clarified that an Indian passport is primarily a travel document and not conclusive proof of citizenship. Citizenship and Passport in India “Citizenship is a legal status; a passport is a travel document.” The Ministry of External Affairs (MEA), on Passport Seva Divas (June 24), clarified that an Indian passport is primarily a travel document and not conclusive proof of citizenship, reaffirming the legal distinction between citizenship and identity documents. About Citizenship Meaning Citizenship is a legal relationship between an individual and the State, conferring rights, duties, and constitutional protection. It is governed by: Part II (Articles 5–11) of the Constitution. Citizenship Act, 1955. "Citizenship flows from law, not from possession of a document." Modes of Acquiring Indian Citizenship By Birth By Descent By Registration By Naturalisation By Incorporation of Territory Constitutional Provisions Part II of the Constitution (Articles 5–11) Article 5: Citizenship at the commencement of the Constitution. Article 6: Rights of migrants from Pakistan. Article 7: Migrants to Pakistan. Article 8: Overseas Indians. Article 9: Voluntary acquisition of foreign citizenship. Article 10: Continuance of citizenship rights. Article 11: Parliament empowered to regulate citizenship. Citizenship Act, 1955 Governs acquisition and termination of citizenship. Amended several times, including through the Citizenship (Amendment) Act (CAA), 2019. Why Passport Is Not Conclusive Proof of Citizenship Legal Position A passport is issued after authorities are satisfied that the applicant is an Indian citizen. However, it does not create citizenship. Courts can still examine citizenship independently. “Evidence supports citizenship; it does not automatically establish it.” Section 20 of the Passports Act, 1967 Empowers the Central Government to issue passports or travel documents to non-citizens in exceptional public-interest cases. Examples: Stateless persons Certain Tibetan refugees Sri Lankan Tamil refugees Thus, the law itself recognizes that a passport is primarily a travel document. Parliamentary Clarification (2020) The Ministry of Home Affairs (MHA) clarified that the following are not legally designated as conclusive proof of citizenship: Passport Aadhaar Voter ID PAN Card Birth Certificate Citizenship is determined strictly under the Citizenship Act, 1955. Judicial Interpretation Sarbananda Sonowal v. Union of India (2005) Supreme Court held that the burden of proving citizenship lies on the person claiming it. State of Andhra Pradesh v. Abdul Khader (1962) Passport is relevant evidence, but courts must examine constitutional and legal criteria before determining citizenship. Bombay High Court (2013) Documentary possession alone is insufficient without establishing legal eligibility. Recent Supreme Court Observation During hearings on Bihar's Special Intensive Revision (SIR), the Court observed that passports and birth certificates possess stronger evidentiary value, but are not conclusive proof of citizenship. International Practice Many countries follow the same principle. United Kingdom: Passport is issued after citizenship verification but is not the citizenship certificate. United States: Passport serves as strong evidence, while formal citizenship certificates exist for many categories of citizens. India's Structural Challenge No Universal Citizenship Certificate Citizens by registration and naturalisation receive citizenship certificates. Citizens by birth generally do not receive a dedicated citizenship document. Therefore, citizenship is usually established through a combination of: Birth certificates Electoral rolls School records Land records Passport Other supporting documents “India has a comprehensive citizenship law but no universal citizenship document.” National Register
