6	Abstract: Ashura presents one of the deepest paradoxes in history: Imam Husayn was militarily defeated, yet the values he embodied survived the power that killed him. His body was overcome in Karbala, but his moral world outlived the empire that tried to erase him. This presentation looks beyond the final day of Ashura to examine Imam Husayn’s life, words, family, and companions. It combines a brief academic summary of Ashura and collective memory, a comparative and concise review of Imam Husayn’s companions, and a mythological reflection on why some stories and events of defeat become the backbone of nations. From a realist perspective, it asks how moral memories shape collective identity, strengthen resilient communities, and create a lasting language of dignity, truth, loyalty, courage, compassion, freedom, repentance, and refusal of humiliation.	334

10	نصّ و اجتهاد در انديشه سياسی شيعه، دکتر حسن انصاری جلسه دوم: در اين جلسه درباره تمايز دوم نظريه امامت شيعی از نظريه خلافت اهل سنت سخن گفتيم. توضيح داديم چطور در حالی که نظريه خلافت خود نظريه ای اجتهاد محور قلمداد می شد اما به سطح جايگاه دينی ارتقا داده شد و حتی احکام اجتهادی خلفاء فقه اهل سنت را ساخت و جنبه دينی پيدا کرد. در حالی که شيعه با وجود اينکه امامت را امری منصوص می دانست اما با دينی جلوه دادن اجتهادات در امر سياسی اگر مستند به حجيت شرعی و منصوص نباشد مخالف بود و همين راه را برای عرفی کردن ساحت سياست باز می کرد. از نتايج اين تمايز اين بود که فقه اهل سنت عموما متکی بر اجتهادات خلفاء و صحابه بود و متکی بر دستور العمل های مقام "قدرت" خلفاء اما بعدا بدان رنگ حديث نبوی دادند در حالی که فقه شيعه چون نسبتی با قدرت مسلط نداشت نه تحت تأثير قدرت خليفگان بلکه به عنوان فقه برآمده از نصوص امام معصوم در هيئت سنت اپوزيسيون شکل گرفت. در اين چارچوب در فقه شيعه عمل فقهی بايد مستند به نص شرعی باشد و اين نص مستند است به حجيت امام معصوم. عمل سياسی اجتهادی هم ممکن است منتهی اين عمل سياسی اگر به نحوی مأذون از امامت معصوم نباشد طبق ديدگاه شيعه نبايد به عنوان امر دينی تلقی شود بلکه در چارچوب "منطقة الفراغ" است. Summary: In this session, we discussed the second distinguishing feature of the Shi'i theory of the Imamate in comparison with the Sunni theory of the Caliphate. We explained how, although the theory of the Caliphate was originally regarded as one centered on ijtihād (independent legal reasoning), it was eventually elevated to the status of a religious institution. Even the ijtihād-based rulings of the caliphs came to form the foundation of Sunni jurisprudence, thereby acquiring a religious character. By contrast, although Shi'ism considers the Imamate to be a matter established through explicit divine designation (naṣṣ), it rejects the religious legitimation of political ijtihād unless it is grounded in a divinely authorized and scripturally established proof. This, in turn, opened the way for a more secular—or non-sacralized—understanding of the political sphere. One important consequence of this distinction is that Sunni jurisprudence generally came to rely on the ijtihād of the caliphs and the Companions, as well as on directives issued by the holders of political authority. These rulings were later given the appearance of Prophetic hadith. Shi'i jurisprudence, however, because it had no institutional relationship with the ruling political power, was shaped not under the influence of the caliphs' authority but as an oppositional legal tradition grounded in the transmitted teachings (naṣṣ) of the infallible Imam. Within this framework, every juridical ruling in Shi'i law must be based on a revealed textual proof, whose authority ultimately derives from the infallible Imam. Political action based on ijtihād is certainly possible; however, if such political action is not, in some manner, authorized by the infallible Imamate, then according to the Shi'i perspective it should not be regarded as a religious act.
