The passive Qila ("it is said") can have multiple meanings in a text:
i. showing that an opinion is weak (when compared to what is mentioned before it);
ii. not identifying the speaker (e.g. if they are unknown or the author does not want to name them);
iii. responding to anticipated objections from an interlocutor.

كتبت هذا المنشور منذ أكثر من ثلاثة أعوام وأذكرني به أحد المعلقين اليوم فأحببت إعادته والتذكير به لعل فيه نفعا لطلاب العلم:
مراتب الأصوليين:
ليس كل من كتب في الأصول كتابا أو شرحا مختصرا أو مطولا على درجة واحدة، بل هم مراتب متعددة، فمنهم النقلة، ومنهم المحققون، ومنهم المتحققون بهذا العلم، وقد رأيت أن أقسمهم إلى أربعة مراتب:
1- مرتبة النقل والرواية.
2- مرتبة الفهم والدراية.
3- مرتبة التطبيق والرعاية.
4- مرتبة الاجتهاد .
فالأولى تعتمد على مجرد النقل وحكاية الأقوال وتعتني بقائليها من صحة نسبة الأقوال إليهم، ونقل الأدلة وما توجه إليها أو يمكن أن يتوجه إليها من اعتراض.
ولا حظ لصاحب هذه المرتبة إلا حفظ الأقوال أو إدراكا لها وفهمهما جيدا على مراد أصحابها.
والمهم في هذه المرتبة : تحري الدقة في النقل ، وعدم التصرف المخل فيما ينقله.
فلا ينسب قولا لغير قائله ، ولا يحكى دليلا لم يستدل به على المسألة على أنه دليل للمسألة.
بل إذا صلح دليل لمسألة لم يستدل به القائلون فأراد نقله يقول مثلا : ويمكن أن يستدل للقائلين بهكذا بهذا الدليل.
كما نراه عن المحققين.
وأعلى هذه المرتبة : أن يحرر الأقوال فيما التبس فيه العلماء في النقل ويرجع إلى مصنفات أصحاب الأقوال أو المصنفات المعتمدة في مذاهبهم.
ويعرف مكامن الإضطراب في حكاية الأقوال ، وما يصلح من خلال شواهد وأمارات.
كرأي العنبري في الاجتهاد ، والأصفهاني في النسخ ، والتراجم في الواجب المخبر والنظام في القياس ، وأصح الأقوال عن الإمام أحمد في كثير من المسائل كالتفرقة بين الفرض والواجب.
وبخاصة الأقوال المنسوبة إلى الائمة الكبار من أصحاب المذاهب والتي فهمت ونسبت تخريجا على أقوالهم كالتصويب والتخطئة.
كذا نقل المصطلحات وتحريرها وضبط معانيها.
ومقصود أصحابها بها كالإستحسان والمصالح ، وتحقيق المناط وتخريجه.
ومعرفة الفرق الظاهرة بين القةاعد المتشابهة وإن كان يقرب من المرتبة الثانية أو هو منها.
ويكون هذا في المسائل الظاهرة دون المسائل الخفية التي تحتاج إلى كبير إعمال فكر ونظر فهذه مرتبة أعلى.
ومن المهم في هذه المرتبة تحري محل النزاع فيما فيه نزاع.
حتى لا يشمل الخلاف محال الإتفاق ، وكذا لا يكون محال الإختلاف محل وفاق.
وهذه من الأهمية بمكان كبير.
ومثلها في بقية العلوم الفرعية.
فمن ذلك ما رواه الخطيب البغدادي.
المرتبة الثانية : مرتبة الفهم والدراسة
• وأعني بها أن يكون مدركا أسرار كل مسألة ، فإن وراء المسائل الأصولية مسائل اعتقادية ، أو لغوية.
فالمصنفون في الأصول صنفوا على وفق مذاهبهم الإعتقادية ،
فكثير من المسائل الكلام فيها فرع الكلام في امور اعتقادية.
• وأن يعرف أسباب الخلاف في المسائل الأصولية ويرد المسألة إلى أصل هذا الخلاف ومنشإه
وهذا أمر يحتاج إلى تضلع بكبير من العلوم غير الأصول.
كالفقه – والعقيدة – ومصطلح الحديث – واللغة.
• وأن يعرف ثمرة الخلاف في المسائل الأصولية ويمكنه رد الأقوال الفقهية إلى قواعدها الأصولية وما قيل فيها خلافا ووفاقا.
فهم الإستدلال على الأقوال وما يمكن أن يكون دليلا صحيحا وما يمكن أن يكون مزيفا ، ووجه زيفه.
• ويلحق بذلك أن يعرف قواعد في الأدلة الإجمالية وما يمكن أن يرد عليها من اعتراضات وكيفية رده والجواب عليه ( وهذا أصول فقه خاص ).
المرتبة الثالثة : مرتبة التطبيق والرعاية :
وهذه لا تتأتى إلا بعد تحقيق المرتبتين الأوليين.
وهذه درجة اجتهاد في الأصول والفروع.
ومعنى الرعاية العمل بموجب القواعد الأصولية ومقتضاها فهذه هي الثمرة الحقيقية لهذا العلم.
وإذا أردت أن تعرف كيف تحققت هذه المرتبة في أعلى درجاتها فعليك بالتدبر الأمثل لما كتبه إمامنا الإمام الشافعي رحمه الله.
وما كتبه كذلك إمامنا ابن دقيق العيد ، وابن أبي حميرة في شرح مختصره على النجاري.
والإمام ابن تيمية عليه رحمة الله وذلك واضح في فتاويه.
والإمام العلامة ابن رجب في فتحه. وكذا الحافظ الكبير ابن حجر العسقلاني في الفتح ، والشيخ الشنقيطي في أضواء البيان.
ووضعهم القاعدة في موضعها وتطبيقها في صورة تذيقك لذة العمل بالعلم وتطبيقه.
البراعة وخذ مثلا : البراعة الكبيرة التي تحقق بها البعض في التوفيق والترجيح بين الأدلة التي ظاهرها التعارض.
أقول : ولا يسمى عالما بالأصول من اقتصر على المرتبة الأولى
إنما هو دارس ، وناقل ، وحاك.
وصاحب الثانية عالم بالأصول وسمه أصوليا إن شئت.
وصاحب الثالثة مجتهد في الأصول والفروع إن قام بحق الرعاية كما ينبغي.
5- المرتبة الرابعة : مرتبة الاجتهاد .
وهي مرحلة إمامة، وأهلها فقط هم الذين يحق لهم الاستدراك والنقد إن ثم ما يدعو إليه ، وهم الذي يحق لهم الكلام في التطوير والتجديد في العلم.
والذين تحققوا بهذه المكانة أنفسهم طبقات ومراتب ، منهم من هم في بداياته ومنهم من بلغوا فيها مبلغا كبيرا، وبعضهم بلغ فيه الذروة في باب منه دون باب حتى يتحقق قوله تعالى (وفوق كل ذي علم عليم).

When you are a young student, you often find yourself running towards all the extra-long shuruh and flashy hawashi of a matn to reap as many secondary benefits and details as possible.
But looking at the matn in its own terms? Not done enough, unfortunately.
After maturing, you realize the worth of the matn itself, and appreciate the importance of the process of fakk al-'ibarah and how many meanings can be extracted by carefully analyzing the words of the matn itself.
Every word choice of the matn reveals a layer of meaning that the author wanted to capture. A line of the text not only contains benefits through its mantuq, but also its mafhum. These benefits require time to be parsed out.
The process of extracting the meanings embedded within the text requires not only a careful eye, but patience as well.

AI and the dulling of the intellect
As AI becomes more and more embedded in everything we use, it is important that one be very conscious of what they use AI for and what they decide is not worth risking becoming dull in. Take the example of spell check, as it became more widely used such that it is now expected one uses it before submitting a document or writing an email; the overall ability of people to spell words correctly dulled.
Now, AI checks are embedded in Word and email, which encourages people to sloppily write the overall idea they want to convey and then click the "polish" button so that they do not have to spend time thinking of how best to word something. The danger of this is that just as spell check dulls the ability of one to spell, this feature most likely will dull people's ability to articulate themselves.
Without the ability to articulate oneself well, it is very difficult for a person to formulate an argument, persuade, explain oneself, or engage in meaningful dialogue. More important than these things, articulation is the act of thinking itself. The ability to think is fundamental to being human; without it, one becomes more animal-like.
While AI has some amazing applications, one has to be more diligent than ever over the effects any specific usage will have on oneself and evaluate if the trade-off is worth it.
"Sunan al-Daraqutni is a collection which contains defective reports, not actable ones. This is the case for most of the reports found inside it.
This means that al-Daraqutni relates hadiths in order to reveal their hidden defects and what they contain in terms of faults.
This conclusion had been reached by past scholars like Ibn 'Abd al-Hadi and Ibn Taymiyyah."

"Both Ibn Taymiyya and Ibn al-Qayyim totally reject ... the theory that language originates from convention.
At the same time, on Ibn Taymiyya’s theory, there are no essences hidden behind God’s words to determine their use in any particular context. When I hear the sentence ‘‘I saw her duck’’, for example, there is no universal ‘‘duckness’’ in my mind that constrains me to think of the bird ‘‘duck’’ rather than the verb ‘‘duck’’.
In other words, meaning does not come in the form of a universal that fixes the extension of a term in every future case of its expression’s future application. Meaning is nothing deeper than the use of ordinary words in particular contexts.
This does not mean that the future use of words revealed in the Qur’an is wholly unshaped. It indicates only that God provides nothing better than the Qur’an itself and the hadith of the Prophet to explain it. "The soundest method of commentary on the Qur’an," Ibn Taymiyya writes, "is to comment on it with the [words of the] Qur’an [itself]; for what is unclear in one place is explained in another and what is abridged in one place is set forth plainly in another.’’ All items of divine discourse, in fact, can be understood by an appeal to divine words as these have been given...
Ibn Taymiyya thus makes an appeal to language as performance and to what people do with words in specific contexts of communication. ‘‘Discourse in use’’ bases itself on the divine speaker’s habit of discourse (‘adat al-mutakallim). No hidden essences lurk behind it to serve as the meaning of words.
The meanings of words are immanent to the structure of their use (isti‘mal). We know in a certain and decisive (qat‘ı) fashion what a speaker wills and intends to say simply by virtue of his habit of address."

«الورع وطلاب العلم»
من الأشياء التي تحزنني جدا عندما أجد طلاب علم لا يوجد في حياته أدنى مساحة «للورع»
فهو لا يراعي موضوع الورع في تصرفاته بقليل ولا كثير.
فإذا جاء لباب المكاسب (مثلا) دخل في كل معاملة، مهما كانت شبهة التحريم مرتفعة فيها، لأن الأصل في المعاملات الحل !؟
وفي باب الأطعمة (مثلا) لا يحجزه عن أكل اللحوم إلا طبخها مهما كان مصدرها أو ملابساتها.
وفي باب العبادات (مثلا) لا يتورع -احتياطا للعبادة- عن العمل ببعض الأقوال .
وتجد مصطلحاته هي مصطلحات بعض العوام:
الدين يسر
الأمر يسير
الله غفور رحيم
ونحو هذه المفاهيم التي هي في نفسها حق لكن يقع الخطأ في فهمها وتنزيلها.
العلم ليس مجرد معلومات جافة
بل وسيلة لتحقيق التقوى، وصيانة النفس وتربيتها.
ووسيلة لبناء مفاهيم شرعية يعمل بها طالب العلم.
ووسيلة لحمل النفس على أجمل المحامل.
ولهذا قال مطرف بن عبد الله بن الشخير: «خير دينكم الورع»
وقال سفيان الثوري: «إنما يُطلب العلم ليُتقى الله به، فمن ثمّ فُضِّل، فلولا ذلك لكان كسائر الأشياء»
وقال ابن رجب: «العلم ثمرته: خشية الله»
وليس قصدي من هذه الكلمات أن يكون طالب العلم على مستوى الثوري وأحمد في الورع، بل ولا على مستوى من هم دون الثوري وأحمد من العلماء الكبار
وإنما أقصد: أنه لا يستقيم أن تجد طالب العلم لا يكاد يستعمل الورع في شيء من تصرفاته، فهذا خلل ظاهر في فهم المقصود من العلم.
تنبيه مهم:
أنا هنا أتحدث عن «الورع» لا عن «الحلال والحرام».

We, Syrian Sunni Arabs, are not Umayyad in lineage, and we should not aspire toward the nascent neo-Umayyad identity as a culture. If we're going to attach ourselves to a glorious reign from our Islamic past, why not simply move a few decades earlier and aim at the Rashidun?
This is not to say that the Umayyads should not be appreciated as a fundamental element of our heritage. Their feats and contributions to Islam can be highlighted, especially in light of Shi'ite historical satire about them, but that should not entail the supplantation of our identity with this neo-Umayyad cause.
It becomes evident from this passage that al-Karkhī and his Ḥanafī colleagues were not advocating for overruling proof texts with the views of jurists of their school. This is not an issue of where a scholar opposes a text, but instead where two texts contradict with one another. Al-Karkhī was discussing the delicate issue of how jurists should solve apparent conflicts and contradictions between ḥadīths. The whole discussion centres on sketching out the key principles that can be referred to and applied to address such apparent inconsistencies. Although in some cases reconciliation might be possible, in other areas it is not owing to the mutual exclusivity of the texts. Acting on both reports at the same time in the latter scenario is impossible, and thus the jurist is forced to try to identify one report that is more worthy of being followed. If the dates of the two different Prophetic statements can be identified, then the earlier text is judged as being abrogated. If not, then one text might be preferred over the other by referring to any indicators or markers that render one report to be superior to the other. Such procedures in resolving apparent contradictions are nothing new, and are even discussed at length by ḥadīth scholars themselves. Instead of leaving a ḥadīth due to madhhab chauvinism, jurists only left out acting on a given report based on secure and well-developed principles that warranted that departure. This occurred if they believed that another superior report abrogated it or superseded it.
Because the establishment of these procedures actually points to how much al-Karkhī and his Ḥanafī colleagues were careful in not contravening any of the divine texts, Sābiq’s charge appears to miss the mark. This is because if the jurists left any text, it was because of a hidden problem detected in it, such as it being abrogated or preponderated.
The Dangers of Paraphrasing: Misquoting al-Karkhi
When attempting to demonstrate the existence of ta'assub (partisanship) among the scholars of the madhhabs, a rather infamous statement of the Hanafi scholar Abu al-Hasan al-Karkhi is often brought up as a frontier example. According to this rendition (mentioned by Rashid Rida, al-Khudari, and al-Sayyid Sabiq), al-Karkhi allegedly said that any verse or hadith that went against the teachings of the Hanafi school would have to be deemed abrogated or preponderated.
But did al-Karkhi actually say this? If we go to the original work of al-Karkhi and its commentary (by al-Nasafi), it turns out that the scholar's argument has been misunderstood. It appears to be the case that an individual paraphrased al-Karkhī’s statement according to their own understanding of it and Sabiq simply adopted the one-line statement. A substantial portion of the original passage from al-Karkhī’s work and its commentary is reproduced below:
(The fundamental principle (aṣl) is that every report which opposes the views of our colleagues is held to be abrogated, or opposed by that which is similar to it [in strength], whereby another evidence was consulted or one of the many modes of preferring one narration over the other were used. Or reconciliation was resorted to, and all of this is done in accordance to what the evidence points to. If there is an indication of abrogation then that is what is resorted to; similarly, if there is denotation of something else, then that is what we rule with. He said: from among that is what al-Shāfiʿī says concerning the permissibility of performing the voluntary dawn prayers after the obligatory dawn prayer before sunrise. This view is owing to what ʿĪsā reports: ‘The Prophet saw me pray the two units after the obligatory prayer. He said: “What are they?” I said: “they were the two [voluntary] units of the dawn (fajr) prayer which I was performing.” So he remained silent.’ I say: this is abrogated owing to what has come from the Prophet that he said: ‘There is no prayer to be done after the dawn prayer until the sun rises, and no prayer after the mid-day (ʿaṣr) prayer until the sun sets.’ As for the case of a report being in outright disagreement with another, then this is found in the ḥadīth of Anas, may God be pleased with him, that the Prophet used to perform the special supplication done in prayer while standing (qunūt) in the dawn prayer until he left this world. This is contradicted by another report from Anas, may God be pleased with him, that the Prophet performed the special supplication in the dawn prayer for [only] a month and then left it. Since his two narrations contradict with one another, they cancel each other out and both drop as being considered as evidence (tasāqāṭa). Thus, what remains for us as an evidence is the ḥadīth of Ibn Masʿūd, may God be pleased with him, and others that the Prophet made the supplication for two months against the tribes from the Arabs and then left it. As for explaining away the apparent meaning of one text against another (taʾwīl), then it can be found in what is reported from the Prophet that he would say upon raising his head from the bowing posture, ‘God responds to the one who praises Him, our Lord, for You alone is praise (samiʿa Allah li-man ḥamidahu, rabbanā laka l-ḥamd) .’ This indicates that both the Imām and those besides him should say both litanies together. But it has also been narrated from the Prophet that he said: ‘If the Imām says [while leading during the prayer] “God responds to the one who praises Him,” then you should say “Our Lord, for You alone is praise.”’ He divided them into two parts, and this division breaks up any association between the two (sharika). So the two texts are harmonized by us saying: combining the two litanies is done by the one praying alone (munfarid), while reciting only one of them (ifrād) is done in the cases of the Imām and the follower (muqtadī)...

موازنةٌ تيميّة بديعة بين الأئمة الأربعة في أصول الفقه:لشيخ الإسلام رحمه الله من الموازنات الدقيقة بين منازع الأئمة وطرائقهم في الأصول والفروع ما هو مشهورٌ به، حتى عُدَّ هذا الفنّ من مفاريده؛ لكمال استقرائه، وجودة انتزاعه واستنباطه، وعدله في موازنته وإنصافه. بل له من الموازنات العجيبة بين بعض أئمة الكلام من المتقدِّمين والمتأخِّرين ما يُعجب منه، حتّى إنه لا يُغادِر من محاسنهم شيئا إلا ذكره ولو صغُر، وهو مقامٌ لا تقوى فيه كثيرٌ من النفوس على ترك المبالغة في الحطِّ والثّلب، بلهَ ذكرَ المحاسن، والتأوُّلَ للزلَّات ومحبةَ الإعذار. وقد حفَل كتاب الشيخ النَّفيس الصّادر حديثًا «قاعدة في تفضيل مذهب الإمام أحمد وذكر محاسنه والذبّ عنه» بموازنات عالية، ونقدات رفيعة، وإشرافٍ بليغٍ على مسالك الأئمة الأربعة في الأصول والفروع، والتَّنبيه على مجامع المحاسن في طرائقهم، وما لبعضهم على بعض من التفرُّد في أبواب، والزِّيادة في أبواب. وهو موطنٌ أهتبل نشرَه ملخَّصًا في وقت لاحق إن شاء الله. هذا.. وإنّني أقدّم عليه هنا جُذاذةً منتزعة من الملحق الذي ذيّل به الشيخ المحقِّق عبدالله السليمان-حفظه الله وجزاه عن أهل العلم خيرا- هذه القاعدة النَّفيسة، وهو فصلٌ في الموازنة بين الأئمة الأربعة في الأصلَيْن: أصول الدِّين، وأصول الفقه، حققه الشيخ سلمه الله عن: «الكواكب الدّراري» لابن عروة الحنبلي رحمه الله. وأنتزع منه هنا ما يتعلق بالموازنة بين الأئمة الأربعة في أصول الفقه خاصّة. قال شيخ الإسلام رحمه الله: «الأئمّة الأربعة هم في أصول الفقه والدّين على درجاتٍ: ⏺فالشافعيُّ في أصول الفقه أجود لها: - إجمالًا وتفصيلًا من مالك. - وتمييزًا بين الدّليل وغير الدّليل. - وتقديم الرّاجح على المرجوح. ⏺وإن كان لمالكٍ في ذلك من الكلمات الجامعة المُجمَلة ما هي حسنةٌ عظيمة القدر. ولكنّ الشافعيَّ يُفصِّل أصولَه. ⏺والإمام أحمد هو: - مُفصِّلٌ للكلام في أصول الدِّين والفقه تفصيلا جيِّدًا. - موافِقٌ [للشافعي] في عامّة أصول الفقه، وكان يقول [عنه]: «حديثٌ صحيح، ورأي صحيح». - وكان يقول عن مالك: «حديث صحيح، ورأي ضعيف»، مع ما في أصول فقهه من نوعِ اضطرابٍ. ⏺وأما أهل الرَّأي؛ فهم وإن كان لهم جملٌ من الكلام في ذلك؛ فليس لهم قواعدُ محرّرةٌ لا في أصول دينٍ ولا في أصول فقهٍ. لكنِ اعتاضوا عن ذلك بما وضعوه من الفروع المُولَّدة؛ فإنّهم ولَّدوا من تفريع الحوادث ما لم يُفرّعه غيرُهم؛ ولهذا قال الشّافعي: «من أراد الفقه؛ فهو عيالٌ على أبي حنيفة» في تفريع المسائل لا في معرفة الدّلائل. ⏺وهذا الذي بين مالكٍ والشّافعيِّ: من ترجُّح هذا من وجهٍ، ومن ترجُّح هذا من وجهٍ، في الأصلَيْنِ؛ [هو] كما بينهما في الفقه. - فالشافعيُّ أتبعُ للنُّصوص المُفصَّلة، لا يخالف حديثًا صحيحًا عمدًا قطُّ، بخلاف مالكٍ في هذا الباب. - لكن مالكٌ ضبَطَ من قواعد الشريعة ومقاصدها ما لم يضبطْه الشافعيُّ من السِّياسات والمعاملات ورعاية المقاصد والنّيّات. وهذا أشبه بـ«أصول الدِّين»، كما أنَّ الأحاديث المفصَّلة أشبه بـ«أصول الفقه». ⏺وهؤلاء أقربُ من الكوفيِّينَ في هذين الأصلين؛ فإن الكوفيِّين أكثرُ مخالفةً للنُّصوص، لا يوجد في مذهبٍ من المذاهب أكثرُ مخالفةً لها منهم. ⏺والإمام أحمد: - موافقٌ للشافعيِّ من حيث الجملة في: متابعة الحديث. - ولمالكٍ في: رعاية المقاصد والنّيّات وقواعد الشريعة. - لكن قد يحصل من مالك في بعض المواضع تفصيلٌ لا يوجد مثلُه في كلام أحمد؛ وإن كانت أصولُ أحمد توافقه. - وأصول الفقه تُنبِئ أنّه تعلّمها من الشافعيّ، كما تعلّم الشافعيُّ منه الأصول المفصّلة، وهي الأحاديث الصِّحاح الدالّة على مسائل الفقه». انتهى ملخَّصًا. ⏺

As-salāmu 'alaykum wa raḥmatullāhi wa barakātuh,
Following our publication addressing Mut'ah al-Ṭalāq in response to Dr. Hatem al-Haj's fatwa issued through AMJA, we became aware that AMJA has developed an official Family Code and standardized Marriage Contract promoted for use by Muslim couples and families in America. Our review reveals that both documents contain what effectively constitutes a form of alimony, among other substantial concerns.
The marriage contract warrants particular attention given its legally binding implications for couples who adopt it. After careful examination, we cannot recommend its use in its present form.
We have accordingly prepared a comprehensive evaluation of both documents for the benefit of the scholarly community. أن علماءَ شنقيط يستحسنون ابتداءَ دروسهم يومَ الأربعاء تفاؤلًا أن يتِمَّ الكتابُ ولا يعوق دونَه عائق، وقد رُوِيَ في ذلك حديث لا يصح، لكنه في فضائل الأعمال فيُتساهَل فيه.
والحديث لا أصل له كما نص عليه كثير من المحققين.
وقد حكى لي مثل ذلك شيخُنا الفقيه عمر بن معلم حسين السعدي عن علماء الصومال.
قلتُ: وقد التمستُ له أصلًا سديدًا من السنة الصحيحة، وهو حديث جابر أن النبي ﷺ دعا يوم الأربعاء بين الظهر والعصر فاستُجِيبَ له، فكان جابرٌ يتحرَّى هذا الوقت للدعاء.
وقد عمل بهذا الحديث طائفة من أهل العلم، من أصحابنا الحنابلة وغيرهم ورأوا أن في يوم الأربعاء ساعةَ استجابةٍ، قاله الشيخ تقي الدين ابن تيمية.

هل يؤمن المأموم إذا دعا الإمام بدعاء من ملاذ الدنيا?!
يحتمل أنه يؤمن لأن الأصل وجوب متابعة الإمام و يحتمل أنه لا يؤمن لأن هذا مما تبطل به الصلاة، و المؤمن داع، و هي أشبه بمسألة سجدة ص، و الاحتمال الثاني قوي جدا و هو اختيار شيخنا عبد الله الميمان حفظه الله.

In his work Nuzhat al-Nazar, al-Hafidh ibn Hajar mentions the four standard conditions for the Mutawatir (mass-transmitted) report.
But then he adds a controversial 'fifth' condition:
" ... to that is added that the report should impart knowledge to its listener."
Holding this to imply a positive condition is problematic since it might be circular. Since to obtain knowledge one needs the mutawatir report, but to have something mutawatir proper one needs to obtain knowledge.
If this does not hold, how are we to make sense of this condition?
Sheikh Muhammad Bajabir said:
"Al-Hafidh’s statement here caused a huge problem for the commentators [of the Nuzhah]. Here, the meaning is that the 4 conditions be met and the mawani’ (impediments) must be lacking. In other words, this statement is an indication of the need for there to be a lack of impediments (intifa' al-mawani’).
How is this so? It is possible for the first 4 conditions to be met but yet one does not obtain knowledge with 100% certainty. This might occur because of an ‘arid which prevents the obtaining of daruri knowledge. I might accept the report but I still have some doubts due to an ‘arid.
If this ‘arid comes and prevents the access to knowledge with the 4 conditions, then this is not mutawatir, rather it will remain mashur only.
What is an example of a mani’? They are many, with some relating to the listener. It may be with the comprehension of the listener, or he believes from a wahm beforehand which contradicts this mutawatir report, so he does not believe it. A person tells you so-and-so died, but you thought you saw him yesterday because someone resembling him entirely approached you (but it was somebody else). This is based on a false belief which he thinks is true.
Thus, intifa' al-mawani' is needed for obtaining al-‘ilm al-yaqini, otherwise the khabar is considered mashur only."
While the point of this post is well-intentioned and tries to rationalize a legal ruling on the grounds of 'urf (custom), it actually is misleading and fails to account for the reasoning of medieval jurists for why they declared that the husband is not required to pay for their wive's medical treatment.
If the brother looked more carefully at the books he cited from, he would have seen that they cite a common point of legal reasoning for why the man does not pay for medical expenses. This point of reasoning does not stem from culture, but a deeper understanding of what rights/responsibilities that the marriage bonds entails as a legal contract between the two parties.
Essentially, they draw an analogy between the husband and wife's marital relationship and that of a lessee (tenant) and lessor (landlord).* Now, at first sight, this analogy may seem strange, but it is grounded on the fundamental understanding that just as the lessee does not own the property he lives in and has a restricted right to it, likewise the husband does not own his wife's body and only has restricted rights towards it. Since the Shariah does not arbitrarily bring differences between comparable cases, it means that the two dealings should bring forth a similar set of liabilities and responsibilities.
What follows from this analogy is the following conclusion. If the house that the tenant lives in collapses or falls due to its own weak foundations, he would not be obliged to pay for its reconstruction, since this burden falls on the lessor. Taking this point and analogously applying it to the marriage contract, the jurists argued that the illness of the wife does not trigger an obligation upon the husband to pay for his wife, since she bears the responsibility for the basic maintenance of her body, just as the landlord is responsible for ensuring that the structure they rent out is in proper shape.
Now, one may not agree with this analogy or accept its conclusion, but this is irrelevant. The fact that we derive from this reasoning is that the fuqaha' were less concerned about the efficacy of medical treatment per se**.
There are other considerations and arguments as well, such as the analogical reasoning that medical treatment is outside the remit of the husband's nafaqah, just as the costs for the reconstruction of a collapsed house is outside the remit of the tenant's responsibility.
There are other ta'lilat (legal ratiocinationary points) that the fuqaha' bring for this issue for why medical treatment is not upon the husband, but this is just one of them.
Even more so, medical treatment even today has varied success rates and there are mass fluctuations in their effectiveness, frequency, and cost rates. From the prism of many jurists this is problematic as it would not neatly fit with the rules set in the chapter of nafaqat.
This is why many of the contemporary scholars who hold the view of obligation impose conditions. Ibn 'Uthaymin, for instance, said that the treatment amount for the wife should not be costly and must be a manageable amount.

** Though it should be added that Shaykh Musa Furber has noted that some Shafi'i jurists mention the lack of efficacy as a factor in this ruling, so according to some of them, an improved efficacy in the medical treatment could warrant reconsideration of the ruling; but even then, pushing it to the level of obligation is not an easy matter.
