The All India Muslim Personal Law Board (AIMPLB) has strongly condemned the inflammatory, misleading, and factually baseless remarks made by the controversial Bangladeshi fugitive writer Taslima Nasrin, who recently returned to India after a gap of nineteen years. Speaking to the media in Kolkata, she made highly provocative statements regarding the Uniform Civil Code and Islamic seminaries (madrasas). The Board has described her comments as an irresponsible attempt by a foreign national to interfere in India’s internal affairs.
In a press statement, AIMPLB Spokesperson Dr. S. Q. R. Ilyas said that alleging that Islamic seminaries promote extremism or produce “jihadis” is nothing but a blatant falsehood, a malicious slander, and a deliberate attempt to malign an entire religious and educational tradition. Such baseless accusations not only hurt the religious sentiments of millions of Indian Muslims but also appear to be a calculated effort to vitiate the country’s communal harmony.
Dr. Ilyas said it is deeply regrettable that a foreign national, who herself is living in India as a refugee, is making inflammatory comments on the country’s religious, constitutional, and social issues. He emphasized that India cannot permit anyone, under the guise of freedom of expression, to spread hatred, defame religious institutions, or interfere in the country’s internal affairs. He urged the Government of India to ensure that such individuals remain within the bounds of the law and to prevent the recurrence of such provocative statements.
Referring to Taslima Nasrin’s comments on Bangladesh, Dr. Ilyas said that her remarks were equally irresponsible and inconsistent with India’s balanced foreign policy. Such statements have the potential to adversely affect bilateral relations between the two neighbouring countries, and the Government of India should take serious note of this aspect as well.
Dr. Ilyas further observed that the campaign to malign Islamic seminaries is not new. Similar allegations have been made repeatedly over the past several decades, yet neither those making these accusations have ever produced any credible evidence, nor has any investigative or security agency in the country substantiated such claims. Despite this, vilifying madrasas has become part of an organised political and ideological campaign.
He pointed out that the reality is that thousands of madrasas across India provide education to millions of children without placing any financial burden on the national exchequer. Thousands of their graduates go on to obtain higher qualifications from leading universities and serve the nation with distinction in the judiciary, academia, journalism, civil services, social work, and many other fields. Defaming such institutions, which render invaluable national service, is not only unjust but also detrimental to the country’s educational and social harmony.
The All India Muslim Personal Law Board calls upon the Government of India to take serious cognisance of these inflammatory remarks, prevent foreign refugees from interfering in India’s internal and religious affairs, and ensure that the country’s constitutional and social fabric is not allowed to become a casualty of the hate-driven politics of any foreign individual.

آل انڈیا مسلم پرسنل لا بورڈ نے پارلیمنٹ کے دونوں ایوانوں سے ترمیمی بل منظور کرکے وندے ماترم کی توہین کو قابلِ سزا جرم قرار دینے کے اقدام پر شدید تشویش کا اظہار کرتے ہوئے اسے ملک کے آئینی، سیکولر اور جمہوری مزاج کے منافی اور شہریوں کی مذہبی آزادی پر ایک سنگین حملہ قرار دیا ہے۔ بورڈ کے مطابق قانون سازی کے ذریعے کسی مخصوص مذہبی تصور یا عقیدے کو ملک کے تمام شہریوں پر مسلط کرنا دستورِ ہند کی بنیادی روح سے متصادم ہے۔
آل انڈیا مسلم پرسنل لا بورڈ کے ترجمان ڈاکٹر سید قاسم رسول الیاس نے جاری کردہ اپنے بیان میں کہا کہ وندے ماترم کو قانونی جبر کے ذریعے تمام طبقات اور مذہبی برادریوں پر لازم کرنے کی کوشش نہ صرف نازیبا بلکہ دستور کے بنیادی اصولوں کے بھی خلاف ہے۔ انہوں نے کہا کہ دستور سازی کے مرحلے میں دستور ساز اسمبلی نے گہرے غور و خوض کے بعد وندے ماترم کے ابتدائی دو بندوں کو ہی قومی سطح پر قبول کیا تھا، جبکہ اس کے دیگر حصوں کے مذہبی مفاہیم کو ملک کے سیکولر کردار کے ساتھ ہم آہنگ نہیں سمجھا گیا تھا۔
ڈاکٹر الیاس نے کہا کہ وندے ماترم کے بعض مندرجات ایسے مذہبی تصورات پر مبنی ہیں جن میں وطن کو ایک دیوی کی صورت میں پیش کرکے اس کی وندنا کی دعوت دی گئی ہے۔ مسلمان کے لیے یہ تصور اس کے بنیادی عقیدۂ توحید سے صریحاً متصادم ہے۔ انہوں نے واضح کیا کہ مسلمان صرف اللہ وحدۂ لاشریک کی عبادت کرتا ہے اور اس کی ذات، صفات، حقوق واختیارات میں کسی بھی درجے کا شرک اس کے ایمان کے منافی ہے۔ چنانچہ کسی مسلمان کو اس کے عقیدے کے خلاف کسی مذہبی مفہوم کے حامل گیت، نعرے یا عمل میں شرکت پر مجبور کرنا ناقابلِ قبول ہے۔
انہوں نے کہا کہ دستورِ ہند کی دفعہ 25 ہر شہری کو اپنے مذہب پر عمل اور اس کی پیروی کی آزادی عطا کرتی ہے، جبکہ دفعہ 19 اظہارِ رائے کی آزادی کی ضمانت فراہم کرتی ہے۔ ان آئینی ضمانتوں کا واضح تقاضا ہے کہ کسی شہری کو اس کے مذہبی عقیدے اور ضمیر کے خلاف کسی گیت، نعرے، نظریے یا علامت کو اختیار کرنے پر مجبور نہیں کیا جاسکتا۔
ترجمان نے سپریم کورٹ کے معروف فیصلہ Bijoe Emmanuel بنام ریاستِ کیرالہ کا حوالہ دیتے ہوئے کہا کہ عدالتِ عظمیٰ نے حتیٰ کہ قومی ترانے جن گن من کے معاملے میں بھی یہ اصول تسلیم کیا کہ اگر کسی شخص کا مذہبی عقیدہ اسے کسی مخصوص عمل میں شرکت سے روکتا ہو تو اسے محض عدمِ شرکت کی بنیاد پر سزا نہیں دی جاسکتی۔ عدالت نے یہ بھی واضح کیا تھا کہ اظہارِ رائے کی آزادی میں بعض حالات میں خاموش رہنے کا حق بھی شامل ہے اور احترام کے ساتھ عدمِ شرکت کو بے احترامی قرار نہیں دیا جاسکتا۔
ڈاکٹر الیاس نے کہا کہ وطن سے محبت اور وطن کی پوجا دو الگ تصورات ہیں۔ مسلمان اپنے وطن سے محبت کو اپنے دینی و شہری فریضے کا حصہ سمجھتے ہیں، لیکن وہ وطن کو معبود یا دیوی کا درجہ نہیں دے سکتے۔ انہوں نے کہا کہ حب الوطنی کا معیار کسی مخصوص نعرے یا گیت کی ادائیگی نہیں بلکہ ملک، اس کے آئین، عوام اور ان کے حقوق کے ساتھ وفاداری ہے۔
انہوں نے کہا کہ حکومت کو چاہیے کہ ایسے حساس اور تقسیم پیدا کرنے والے اقدامات کے بجائے ملک کو درپیش حقیقی مسائل—بے روزگاری، مہنگائی، غربت، تعلیم، صحت، معاشی عدمِ مساوات اور سماجی ناانصافی—کے حل پر توجہ مرکوز کرے۔ عوام کی توجہ بنیادی مسائل سے ہٹا کر جذباتی اور مذہبی تنازعات کو ہوا دینا نہ ملک کے مفاد میں ہے اور نہ ہی جمہوریت کے۔
ڈاکٹر الیاس نے کہا کہ ایک مضبوط اور متحد ہندوستان وہی ہوگا جہاں ہر شہری کو مساوی عزت، انصاف اور آزادی حاصل ہو، جہاں کسی کی حب الوطنی کو اس کے مذہبی عقیدے کے ترازو میں نہ تولا جائے اور جہاں آئین کی بالادستی، مذہبی آزادی اور شہری حقوق کا تحفظ ہر حال میں یقینی بنایا جائے۔

The All India Muslim Personal Law Board has expressed grave concern over the passage of an Amendment Bill by both Houses of Parliament making alleged disrespect to Vande Mataram a punishable offence. The Board has termed the move contrary to the constitutional, secular and democratic ethos of the country and a serious assault on the religious freedom of citizens. According to the Board, seeking through legislation to impose a particular religious concept or belief upon all citizens is inconsistent with the basic spirit of the Constitution of India.
In a statement, Dr. S. Q. R. Ilyas, Spokesperson of the All India Muslim Personal Law Board, said that any attempt to make Vande Mataram compulsory for all sections and religious communities through legal coercion is not only objectionable but also contrary to the fundamental principles of the Constitution. He pointed out that, during the framing of the Constitution, the Constituent Assembly, after detailed deliberation, accepted only the first two stanzas of Vande Mataram at the national level, while the religious connotations of its other portions were not considered compatible with the secular character of the country.
Dr. Ilyas said that certain passages of Vande Mataram are based on religious concepts in which the motherland is depicted in the form of a goddess and people are exhorted to worship her. Such a concept is unequivocally contrary to the fundamental Islamic doctrine of Tawheed, or the absolute Oneness of God. He made it clear that a Muslim worships only Allah, the One and the Only God, and that associating any partner with Him in His Being, Attributes, rights or authority is incompatible with Islamic faith. Therefore, compelling a Muslim to participate in a song, slogan or practice carrying a religious meaning contrary to his or her faith is wholly unacceptable.
He said that Article 25 of the Constitution of India guarantees every citizen the freedom to profess, practise and follow his or her religion, while Article 19 guarantees freedom of expression. These constitutional safeguards clearly imply that no citizen can be compelled to adopt or participate in any song, slogan, ideology or symbol against his or her religious beliefs and conscience.
Referring to the Supreme Court’s landmark judgment in Bijoe Emmanuel v. State of Kerala, the Spokesperson said that the Court had upheld this principle even in the context of the national anthem, Jana Gana Mana. The Court held that a person could not be punished merely for not participating in an act when doing so was contrary to his or her religious beliefs. The Court also made it clear that, in certain circumstances, freedom of expression includes the right to remain silent, and that respectful non-participation cannot be regarded as disrespect.
Dr. Ilyas emphasised that love for the motherland and worship of the motherland are two entirely different concepts. Muslims deeply love their country and consider love for the homeland part of their civic and moral responsibility, but they cannot regard the country as a deity or goddess. He said that patriotism should not be measured by the recitation of any particular slogan or song; rather, it should be judged by one’s commitment to the country, its Constitution, its people and their rights.
He urged the government to focus instead on resolving the real problems confronting the country—unemployment, inflation, poverty, education, healthcare, economic inequality and social injustice—rather than pursuing sensitive and divisive measures. Diverting public attention from fundamental issues by inflaming emotional and religious controversies serves neither the national interest nor the cause of democracy.
