የጥብቅና ጥበብና ልዕልና፡- የላቀ የሕግ ባለሙያ ለመሆን የሚያስችሉ ወርቃማ መርሆች በአትዮጵያ የሕግ ሥርዓቱ ውስጥ ከ25 ዓመታት በላይ አሳልፌያለሁ። ለ19 ዓመት ተኩል በዳኝነት (ከዞን ከፍተኛ ፍ/ቤት እስከ ፌዴራል ጠቅላይ ፍርድ ቤት ሰበር ሰሚ ችሎት)፣ እንዲሁም ላለፉት 6 ዓመታት በጥብቅና ሙያ አገልግያለሁ። ከችሎቱ የሰብሳቢነት መንበር (Bench) እና ከጠበቆች መቆሚያ (Bar) ሆኜ ሁለቱንም ዓለማት ስመለከት የተገነዘብኩት አንድ ትልቅ ሀቅ አለ፦ 👉 "የላቀ የሕግ ባለሙያ መሆን ከዕውቀት ባሻገር ጥበብና ሥነ-ምግባርን አዋህዶ መያዝን ይጠይቃል!" የሚል ነው፡፡ ይህች አጭር ጽሑፍ፣ አዲስ ወደ ሙያው ለሚቀላቀሉም ሆነ በሥራ ላይ ለሚገኙ የሕግ ባለሙያዎች፣ በሕግ ትምህርት ቤት የገበየነውን ጽንሰ-ሐሳብ ከተግባራዊው የዕለት ተዕለት የሙያ ሕይወታችን ጋር አናበን እንድንመለከት የምትረዳ ማስታወሻ ናት። 1. የሕግ ሥርዓቶቹን መዋቅራዊ አውድ ጠንቅቆ መረዳት በጥብቅና ሙያ ወደር የለሽ ስኬት ለማስመዝገብ መጀመርያ መዋቅራዊ ዐውዱን መረዳት ያሻል፡-  የኮመን ሎው ሥርዓት (Common Law):- በዳኞች የቅድመ-ውሳኔ ልማዶች (Stare Decisis) እና በተፋላሚነት    (Adversarial) መርህ ላይ ይመሠረታል።   የሲቪል ሕግ ሥርዓት (Civil Law):- እንደ ሀገራችን ኢትዮጵያ፣ ቀድመው በተሰነዱ ሕጎች (Codified   statutes) እና ዳኛው የነቃ ተሳትፎ በሚያደርግበት አጣሪነትን መሠረት ባደረገ (Inquisitorial) ሥርዓት ላይ   ይመረኮዛል። 2. መሠረታዊ የሙያ ሥነ-ምግባር መርሆች፦ "የሕግ ዕውቀት ያለ ሥነ-ምግባር፣ ልክ በእብድ እጅ እንዳለ ስለታም ሰይፍ (ወይም ልጓም እንደሌለው ፈረስ) ነው።" ይባላል፡፡ ዕውቀት 'አቅም' ሲሰጠን፣ ሥነ-ምግባር ደግሞ ያንን አቅም ለበጎ ዓላማ ብቻ እንድናውለው የሚቆጣጠርን 'ልጓም' ነው። የሕግ ዕውቀት ኖሮት ሥነ-ምግባር የጎደለው ባለሙያ፣ ሕግ ከማያውቅ ተራ ሰው ይልቅ ለፍትሕ ሥርዓቱ እጅግ አደገኛ ነው! የሚል እምነት ብዙዎች ዘንድ መኖሩም ይነገራል፡፡ በመሆኑም፦  በከፍተኛ ትጋት መሟገት፡- ደንበኛን በሕጉ ማዕቀፍ ውስጥ በቁርጠኝነት ማገልገል።  ሙያዊትህትና፡- ለዳኞችና ለሞያው አጋሮች የሚሰጥ ክብር የልዕልና እንጂ የድክመት መገለጫ አይደለም።  የጥቅምግጭት (Conflict of Interest)- ተቃራኒ ጥቅም ያላቸውን ወገኖች በአንድ ጊዜ ወክሎ መከራከር ፍጹምክልክል ነው። 3. የሕግ ሰነድ ዝግጅት የላቀ ክህሎት (Legal Writing) የሕግ ሰነድ ግጥም አይደለም፤ አሻሚነትን በማስወገድ መልእክቱን በቀጥታ ማስተላለፍ አለበት። ሰነድ ሲያዘጋጁ በዓለም አቀፍ ደረጃ ተቀባይነት ያላቸውን ማዕቀፎች ይጠቀሙ፦  IRAC: ይህ የሚወከለው Issue (ጭብጥ) Rule (ሕግ) ፣ Application (ምክንያት)፣ Conclusion (ድምዳሜ) የሚለውን ስልት ሲሆን፣   CREAC: ይህ ደግሞ Conclusion፣ Rule፣ Explanation ፣ Application፣ Conclusion የሚለውን የሚገልፅ ነው፡፡ 4. የችሎት ፊት አሳማኝ የቃል ክርክር (Oral Advocacy) ዳኛ ሆኜ ብዙ ጠበቆችን ታዝቤያለሁ። በችሎት ፊት የሚደረግ ስኬታማ የቃል ክርክር የሚከተሉትን ይጠይቃል፡-   ጉዳዩን ጠንቅቆ ማወቅ፡- ሰነድ በማንበብ ፍርድ ቤቱን አያሰልቹ። አይን አይኑን እያዩ ያስረዱ።   ቀጥተኛ ምላሽ፡- ዳኛ ሲጠይቅዎት አያምልጡ! በቀጥታ ይመልሱ።   ስልታዊ እምነት(Strategic Concession)፡- ደካማ ጎንን መቀበል ታማኝነትን በእጅጉ ከፍ ያደርጋል። 5. ጤናማ የደንበኛ ግንኙነት ደንበኛን እንደ መዝገብ ቁጥር ሳይሆን እንደ ሰው ይመልከቱ። ሚስጥሩን ይጠብቁ። ስለሂደቱ ግልጽ የሆነ መረጃ ይስጡ። ከሁሉም በላይ ውል ከመፈረሙ በፊት ስለ ክፍያ ግልጽነት (Fee Transparency) ይኑርዎት፤ ይህ ሙያዊ ክብርን ያስጠብቃል። 6. ቀጣይነት ያለው ሙያዊ ዕድገት (CPD) ሕግ ይለወጣል፣ ይሻሻላል፣ ይተረጎማል። ለውጡን ያልተከተለ ጠበቃ ደንበኛውን ይጎዳል።  የሰበር ውሳኔዎችን እና አዳዲስ ሕጎችን በቋሚነት ያንብቡ።   በልምምድ ችሎቶች (Moot Courts) ይሳተፉ፤ ከአንጋፋ ባለሙያዎች ይማሩ (Mentorship)።   ከእያንዳንዱ የችሎት ውሎ በኋላ ራስዎን ይገምግሙ (Reflection)። ሙያው ጥሪ ነው፣ ማደግ ደግሞ ግዴታ! 7. የዘመናችን ወሳኝ ትምህርት (The Contemporary Imperative) ዛሬ ላይ የሕግ ሙያ ዓለም አቀፋዊ ሆኗል። የላቀ ጠበቃ ማለት በኮዱ ላይ የተጻፈውን የሚያነብ ብቻ ሳይሆን፦  ቴክኖሎጂን (Legal Tech) የሚጠቀም (E-filing, AIlegal research)   አማራጭ የግጭት መፍቻዎችን (ADR) የሚያበረታታ፣    ነፃ የሕግ አገልግሎት (Pro Bono) በመስጠት ማኅበራዊ ኃላፊነቱን የሚወጣ ነው። ማጠቃለያ፡- የላቀ የሕግ ባለሙያ ማለት ቴክኒካዊ ዕውቀትን፣ ከሥነ-ምግባራዊ ታማኝነት ጋር አዋህዶ ለሕግ የበላይነት የሚቆም ነው። ከእነዚህ ሙያዊ ግዴታዎች ባሻገር ደግሞ ባለሙያው የግብር ግዴታውን በሕጉ አግባብ መወጣት አለበት (በዚህ ዙሪያ ባሉን የአሠራር ክፍተቶች ላይ ወደፊት ሰፋ ያለ ጽሑፍ ይዤ እመጣለሁ)። ታዋቂው ጸሐፊ ራልፍ ዋልዶ ኤመርሰን እንዳለው፦ "The good lawyer is not the man who has an eye to every side and angle of contingency... but who throws himself on your part so heartily, that he can get you out of a scrape." በሙያችን እንበርታ! ከልምዶቻችን እንማማር!
