READ Good evening everyone, I received a call from Deputy Secretary of State Chris Beall this afternoon to discuss an issue that occurred with the Eligible But Unregistered (EBU) mailing done by the state per their agreement as a member of ERIC (Electronic Registration Information Center). This mailing goes to people that ERIC identifies as POTENTIALLY eligible to register to vote, but that are not currently registered. Some information about what ERIC sends to the state and what the mailing includes: • The reports include individuals who have a driver’s license/ID card but who are not registered to vote. • The data in these reports comes from the DMV, which is protected by the Driver’s Privacy Protection Act of 1993. • ERIC does not have political party affiliation data for anyone. • States filter out any individuals they know to NOT be eligible. • The mailing clearly states the eligibility requirements - age, citizenship, residency, etc. The state made an error in processing the data from ERIC when attempting to filter out those who are not eligible to register to vote. Unfortunately, this same mistake occurred in 2020 as well. Here is a rundown of the over numbers: • ERIC referred approximately 102,000 names of potentially eligible, but not registered people. • The state scrubbed the list and sent a mailing to 52,006 people they believed to be eligible but not registered. Unfortunately, the state has discovered that of the 52,006 mailings sent, approximately 31,000 (60%) of the mailings went to non-citizens. The state is working to correct the action in at least the following ways: • Sending a new mailing to the approximately 31,000 people to inform them they received the mailing in error and that they are not eligible to register to vote. • They will be reviewing the VR list each day to verify that none of those people have registered to vote. If any are currently registered to vote, they will be removed from the list and referred to law enforcement. A few things to remember about this: • This was not a mistake made by ERIC. ERIC continues to be an invaluable tool to help states maintain accurate voter registration lists. • A mailing does not equal a voter registration. Upon receiving this mailing, the person would still have to take action to register to vote. • If the person tried to register on-line, they would be unable to do so. Non-citizen driver’s licenses have a different data string than citizen driver’s licenses. So OLVR/SCORE would not accept the new non-citizen driver’s license recently implemented. • If a person on this list tried to register using a paper form and did not provide their DL, the daily review done by the SOS should catch that occurrence and they will remove that person from the list. I have asked Chris that they provide a list to each county that includes the overall number of instances per county, along with each name. The state only has the information by zip code, and not county. But Chris is working to get us at least the overall numbers. The SOS is reviewing the request to send us the names as well. I do expect this to be a topic of conversation on Monday’s Conduct of Elections call. I have requested that the state send additional details via email as well. There was an article about this on Colorado Public Radio today. Here is a link to the article for your review: https://www.cpr.org/2022/10/07/colorado-voter-registration-notices-non-citizens/ If you have any questions, please let me know. Best,

Speaking of hash code verification - you might find this interesting… ES&S have a 'bug' in their hash verification procedures designed to [ostensibly] ensure that “the software and/or firmware of a voting system matches exactly with what was certified by the EAC”. In the conclusion of Texas technical examiner Brian Mechler’s “Voting System Examination of Election Systems & Software EVS 6.1.1.0” report dated September 20, 2020, he states: “The ES&S hash verification process has been a growing issue of concern over the past few certification exams. In this exam, their customer relations with regard to this process have also become a concern. At this point, these issues have been communicated in detail to ES&S. I will not recommend certification of future ES&S releases unless they make substantial improvements to the ease-of-use, reliability, and traceability of their hash verification process.” In spite of his unwillingness to support certification of any future releases from ES&S that fail to address the problems, he somehow finds a way to accept this one while strongly recommending that “jurisdictions perform hash verification for themselves using a two-person verification method as described in Texas’ Election Security Best Practices Guide” as a mitigation for the issue. Incredible. One can't help but wonder… is this a 'bug', or is it an undocumented feature? Is it still present? @warrior_shield_foundation We honor today's importance, the 29th anniversary of Operation Gothic Serpent. On October 3rd, 1993, U.S. Forces met orders to capture Somali warlord Mohammed Farah Aidid as part of Operation Gothic Serpent at the Battle of Mogadishu. Hooten Young president and retired Delta Force MSgt. Norm Hooten helped lead this gruesome 18-hour mission for survival. We pay tribute to the bravery behind this mission with the Hooten Young Operation Gothic Serpent cigar collection.
