Il Giudice del Lavoro di Milano (sentenza n. 2972/2026) si è espresso sul ricorso di un dipendente di Poste Italiane, stabilendo un principio chiaro: le assenze per Microattività Ambulatoriale Complessa (MAC) vanno equiparate al Day Hospital e devono essere regolarmente retribuite.
I punti chiave della vicenda:
- La controversia: L'azienda considerava le giornate dedicate alle cure MAC come assenze ingiustificate o richiedeva al lavoratore di coprirle con le ferie.
- La decisione: Il Tribunale ha respinto l'interpretazione aziendale, ordinando a Poste Italiane la restituzione delle somme trattenute e il saldo delle spese legali.
- L'impatto: Questa pronuncia supera il singolo caso specifico, ricordando come le tutele sanitarie non debbano mai trasformarsi in un danno economico o professionale per il lavoratore. | 3 357 |
