بســـم اللــه الرحــمــن الـرحـــيــم ◾️The ruling on shortening and combining the prayer whilst travelling for more than 4 days (2)◾️ Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - 📩🔹Question: What is the evidence of the scholars who specify the combining and shortening of a traveler to four days? And on the other side, what is the evidence of those who say there's no limit? 📩🔸Answer: Their evidence is the hadith of Jaabir, that the Prophet ﷺ, arrived in Makkah during the Farewell Hajj on the fourth day of Dhul-Hijjah. He stayed there for the fourth, fifth, sixth, and seventh days, while shortening his prayers. He then prayed Fajr (morning prayer) on the eighth day and left for Mina. They say that the Prophet  ﷺ had a combined intention to stay for those four days. Therefore, anyone who is traveling and intends to stay for four days or less can shorten their prayers. And if anyone  intends to stay longer than that, they should perform the full prayers and are not considered in the ruling of a traveler. However, this evidence is not explicitly clear in implying what they are going towards. Ibn al-Qayyim, may Allah have mercy on him, said: "The Prophet ﷺ, did not say to the ummah, 'Do not shorten your prayers if you stay longer than that,' but rather, his stay was for that duration." He also said: "And in this is clear error which is not hidden. For indeed the Messenger ﷺ, conquered Makkah, and it is what it is, and he stayed there to establish the foundations of Islam, and dismantle the foundations of Shirk, and lay the groundwork for what was around him from the Arabs. And it is known with certainty that this required a stay of several days, which could not be accomplished in one or two days. Similarly, his stay in Tabuk, for indeed he waited for the enemy, and it is known with certainty that there was between him and them several stages which would require days to accomplish. And he knew that they would not arrive in four days. And also, Ibn Umar stayed in Azerbaijan for six months, shortening his prayers due to the snow. And it is known with certainty that such snow would not melt and uncover in four days whereby the roads would be open. Similarly, Anas stayed in Shaam for two years, shortening his prayers. And the Sahaabah stayed in Ramhurmuz for seven months, shortening their prayers. And It is certain that such a siege and jihaad would not end in four days. And the companions of Ahmad said that if someone stays for jihaad against the enemy, or is detained by a ruler, or is sick, they can shorten their prayers, whether they believe the need will be fulfilled in a short or long time. And this is the correct view, but they added a condition that has no evidence in the Qur'aan, Sunnah, nor consensus, or is the practice of the Sahaabah. They said: This condition is based on the possibility that their need will be fulfilled within the period that does not invalidate the status of a traveler, which is less than four days. So it is said to them: Where did you get this condition from? And the Prophet ﷺ, when he stayed longer than four days in Makkah and Tabuk, shortening his prayers, he didn't say anything to them and he did not clarify to them that he did not intend to stay longer than four days. He knew that they were following his example in his prayers and emulating him in shortening them during his stay, but he did not say a single word: 'Do not shorten your prayers if you stay more than four nights.' And clarifying this is a very important point. He got married, then on the day he married her it became known to him that his wife wasn’t a virgin. Then, after a year he was provided a son with her, and after two years he was provided a daughter with her, and he’s still with her now. However, he dislikes her and cannot stand her. No-one from his family or her family knows of this matter. He concealed it for her, no-one knows of it except Allah Aza wa Jal, then me his childhood friend. Should he divorce her despite him saying her character is very good, that she’s observant of the prayer, the Nawāfil, and all the rights of Allah? It’s just he cannot stand her ever since the first night of when he consummated the marriage and found her not to be a virgin. We direct this question to the Shaykh, and may Allah reward you with good? 📩🔸Answer: If he sees good in her, then he should not divorce her. Why would he do that whilst she’s now the mother of his children?! Her hymen could have broken other than by way of intercourse. بســـم اللــه الرحــمــن الـرحـــيــم ◾️Interruption to the menses and a change to what usually occurs: When is purity established?◾️ Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - 📩🔹Question: A female questioner asks: My monthly cycle used to be regular, my usual habit is that it remains for around seven days, then towards the end, brown discharge appears before the blood completely stops. This time it was different: During the regular days of the menses, red blood appeared like usual, then the blood stopped abruptly on the third or fourth day and I saw signs of purity - a dry cotton pad or moisture without any colour. There was no appearance of brown discharge which I usually experience before the end of my cycle. The following morning, the usual discharge returned, first it was brown, then it was pink. Then, after several hours red blood appeared, and it had the usual smell of menstruation blood. After this, that same night, I saw brown discharge followed by an interval of dryness, and the next day, more brown discharge and pink discharge appeared with little flakes of red, almost not visible inside the pink liquid. I want to know, do I take consideration to the first pause of the menses, along with confirmation of a clean cotton pad as a sign of having reached true purity? Or was the true purity the second pause where there was nothing there until the second day of when there was the appearance of slight brown liquid followed by pink? May Allah reward you with good. 📩🔸Answer: The interruption (of menses) and dryness that occurs in the middle of the regular cycle, she waits a day and a night. They establish it approximately two days after the date of birth, and they say we aren’t celebrating it on the same day. Instead, we delay it so there’s no imitation of the disbelievers. Is this valid? 📩🔸Answer: Celebration of birthdays is from imitating the disbelievers. During the latter part of a woman’s waiting period, she first experienced Jufaaf (dryness), then brownish discharge (Kudrah) and yellow discharge (Sufrah). At times (during her menses) she sees the Qassatul Baydhaa, but her usual habit is that she doesn’t always see the Qassatul Baydhaa. Is what she saw of brownish and yellow discharge of her norm considered as part of the cycle or a part of purity? 📩🔸Answer: If this is from her usual habit, then this Kudrah (brownish discharge) and Sufrah (Yellow discharge) is considered to be from her cycle, and Allah knows best. And if the Jufaaf (dryness) comes to her, she should wait to see if it continues. If so, she makes ghusul and prays. On the 17th day, she saw the Qisatul Baydhaa but she just relied upon the first Ghusul that occurred on the 15th day and she continued fasting. Is the fast after the appearance of Qisatul Baydhaa invalid? 📩🔸Answer: Her initial ghusul does not suffice her because she made it before she became pure. So, prayer and fasting is not valid from her. بســـم اللــه الرحــمــن الـرحـــيــم 🔶🔹’Ad-Durar Al-Bahiyyah’🔹🔶 ▪️Author: Imām Ash-Shawkāni -May Allah have mercy on him- ▪️Explanation: By Shaykh Hassan bin Muhammed Ba Shu'ayb -May Allah preserve him- 📚Chapter of Menstruation. 📝Is Kudrah and Sufrah from menstruation?: Al-Kudrah is: Dirty water tainted with red (brownish). As-Sufrah: Yellow water like the water which exudes from wounds (pus). Regarding its ruling there are the following positions: The first: That it's not menstruation, at all. This is the position of the Madhab of the Hanaabilah. The second: That it's considered menstruation, at all times. This is the position of some of the Shaafi'iyyah and the Hanaabilah. The third: It's considered menstruation if it's during the days of menstruation. This is the position of the Majority. The fourth. That As-Sufrah is menstruation and Al-Kudrah isn't menstruation except if it's preceded by blood. And this is the position of Abu Yusuf. The fifth: That it's not considered menstruation except if it was connected to menstruation blood, but if it was seen after becoming pure and before the menstruation starts, then it's not considered menstruation. And this is the position of Abu Thawr and Ibnl Mundhir. This fifth position is the most correct, due to the Hadith of um Attiyah, may Allah be pleased with her, she said: We did not consider Al-Kudrah and As-Sufrah anything. Reported by Bukhari (326), and reported by Abu Daud (307) with the wording: We did not consider Al-Kudrah and As-Sufrah anything after purity. With the addition of (after purity). And the Hadith of Aisha, may Allah be pleased with her, which Imam Malik reported in Al-Muwatta (97): From Alqamah bin Abu Alqamah, from his mother; the freed slave of Aisha; the Mother of the believers, that she said: Women would go to Aisha the mother of the believers, with a small container with some cotton with As-Sufrah from menstruation blood, asking about the prayer. She would say to them: Don't be hasty wait until you see the Qassatul Baydaa. She intended with this purity after the menstruation. However, my husband’s mother opposes our marriage and she refuses to see me or speak to me, rather she even returns my gifts. My husband has started to change, to the extent he started to say he regrets the marriage, and at times he says his jinn is telling him to hit me, despite him not mentioning anything to me about having “a jinn” prior to marriage. This matter is hurting me a lot and I don’t know what to do. What do you advise? May Allah reward you with good. 📩🔸Answer: The advice is to be patient and enhance your dealings with him and dealings with his mother. My husband doesn’t agree with me, and he doesn’t see any issue with leaving him alone with them.
