Ben Roberts Smith breaks silence and addresses the media. Compare it to the Joel Davis case: >Arrested & charged for a social media post which contained the phrase ‘rhetorical rape’ >Denied bail from magistrates multiple times >Kept in isolation in maximum security prison >National security classification (basically has no rights) >Gets bail after 4 months but only after spending $40k to get to the Supreme Court Ben Roberts Smith: >Arrested and charged with 5 counts of murder in circumstances constituting war crimes >Gets bail from a magistrate in less than a week The vibe is that judges consider social media posts critical of politicians significantly more serious than murder. The only way this makes sense is to acknowledge that politics massively influences judicial decisions. The BRS arrest angered a lot of people. Giving him bail was damage control and a mitigation tool; it’s meant to calm everyone down.
