የጥያቄ መልስ:

በህጋዊ መርሆዎች እና በኮንስትራክሽን ውል ልምዶች (በተለይም በህንጻ አዋጅ ቁጥር 1356/2017 ስር ያለውን የኢትዮጵያ ህግ በመጥቀስ) 🚧የህንጻው ተቋራጭ ህንጻውን ህጋዊ በሆነ መንገድ ማስረከብ አይችልም! የተደራሽነት መስፈርቶችን አለማሟላት ዝርዝር ትንታኔ፦ 1. የህግ መስፈርቶች የውል ስምምነትን ይሽራሉ - የአዋጅ ቁጥር 1356/2017 አንቀጽ 16(2) ለአካል ጉዳተኞች ተደራሽነትን ያስገድዳል። ይህ ህጋዊ ግዴታ እንጂ በውል ላይ ብቻ የተመሰረተ አይደለም። - የውሉ ዲዛይን/ዝርዝር መግለጫዎች የተደራሽነት ባህሪያትን ባያካትቱም፣ የህግ የበላይነት የውሉን ድንጋጌ ይሽራል። ህግን የሚጥስ ህንጻ፣ ውሉን ቢከተልም፣ በነባሪነት ህግ አያሟላም። - የህግ መርህ፦ ውሎች ተዋዋይ ወገኖች ህጋዊ ግዴታቸውን እንዲጥሱ ሊያስገድዱ አይችሉም። - ከአዋጁ ጋር የሚጋጭ ማንኛውም የውል አንቀጽ ውድቅ ነው። 2. ተደራሽ አለመሆን ህጋዊ “ጉድለት” ነው - “ጉድለት” የሚለው ቃል በውል ሰነዶች ላይ ከሚገኙ ልዩነቶች ብቻ የተወሰነ አይደለም፤ ግዴታ የሆኑ የህግ ደረጃዎችን አለማሟላትንም ያካትታል። - የአዋጁ አንቀጽ 16(4) ጥሰቶች ላይ ቅጣቶችን ስለሚጥል፣ ተደራሽነት ሊታለፍ የማይችል ህጋዊ መስፈርት መሆኑን ያረጋግጣል። - የእጅ ማስረከብ ውጤት: ህግን የማያሟላ ህንጻ ማስረከብ ተቋራጩንም ሆነ የህንጻውን ባለቤት ለህጋዊ ተጠያቂነት (በአካል ጉዳተኞች መብት ህጎች ስር ለሚመጣ ቅጣት፣ ትዕዛዝ ወይም ክስ) ያጋልጣል። 3. የ"Handover" ቢደረግ  ውጤቱ እስከ የመኖሪያ ፍቃድ ሊያሳግድ ይችላል: ህንጻው የአንቀጽ 16(2)ን የሚጥስ ከሆነ፣ የሚመለከተው ባለስልጣን የመኖሪያ ፍቃድ ለመስጠት ይከለክላሉ። የባለቤት ተጠያቂነት: ባለቤቱ ህንጻውን በህጋዊ መንገድ መጠቀም ወይም ማከራየት አይችልም። - በአዋጅ ቁጥር 715/2011 (የአካል ጉዳተኞች ሥራ ስምሪት) ስር የአድልዎ ክስ ሊገጥማቸው ይችላል። - የተቋራጭ ተጠያቂነት: ተቋራጩ ተገዢነት እስኪሳካ ድረስ የማሻሻያ ወጪዎች፣ መዘግየቶች እና ቅጣቶች ተጠያቂ ሆኖ ይቀጥላል። 4. “ማስታወሻ” በቂ ያልሆነበት ምክንያት ስለ ተደራሽ አለመሆን “ማስታወሻ” ጋር ማስረከብ በመሠረቱ ህግን የማያሟላ ንብረትን እንደ መቀበል ይቆጠራል ይህም የህዝብ ፖሊሲ እና ህጋዊ ግዴታዎችን ይጥሳል። - ህጋዊ ስጋትን ለመቀየር አይበቃም (ተቋራጩ ተጠያቂ ሆኖ ይቀጥላል)። ባለቤቱን ህገወጥ የሆነን ግንባታ በመጠቀም ከሚመጣ ተጠያቂነት አያድነውም። 5. ትክክለኛው የሥራ አካሄድ ከማስረከብ በፊት ማስተካከል: ተቋራጩ የተደራሽነት ጉድለቶችን በራሱ ወጪ ማስተካከል አለበት። - የውል ማስተካከያ: የመጀመሪያው ዲዛይን/ዝርዝር መግለጫዎች ጉድለት ካለባቸው፣ ባለቤቱ የዲዛይን ወጪዎችን ሊሸፍን ይችላል፣ ነገር ግን ተቋራጩ ግንባታውን የማስፈጸም ኃላፊነት አለበት። - የህግ ተገዢነት ሰርተፊኬት: ማስረከብ የአንቀጽ 16(2)ን ጨምሮ ከሁሉም ህጎች ጋር ተጣጥሞ መሰራቱን የሚያረጋግጥ ሰርተፊኬት ይጠይቃል።
