Maduro’s case next makes its way to court, on July 22, federal prosecutors could encounter one rather significant obstacle:
Our courts don’t have the authority to handle his case. And the law that says so was signed by the United States of America.
If the United States honors its agreement, it could well be forced to release its prized captive.
The reason dates back to the first decades of the 20th century, when a topic that seems dry and legalistic today — international arbitration — was an exciting and idealistic cause, championed as a modern, rational tool of justice with the power to change the world.
The United States began including arbitration clauses in many treaties.
One of those was a 1922 extradition treaty between the United States and Venezuela. It states, in part, that “all differences between the contracting parties relating to the interpretation or execution of this treaty shall be decided by arbitration.” Approved by the Senate and ratified by the president, that document has the force of law.
Well, there sure are “differences between the contracting parties” today.
The government of Venezuela is playing along with the Trump administration when it comes to oil exports, but it has publicly insisted that Mr. Maduro’s capture was illegal under international law — and that would include the extradition treaty.
A dispute of this nature should clearly trigger the 1922 treaty’s arbitration clause. According to its stipulations, Judge Alvin Hellerstein, who is overseeing Mr. Maduro’s trial, must suspend the proceedings and send the matter to a panel of independent evaluators to examine the treaty and decide whether it has been honored.
Should the arbitrators conclude that Mr. Maduro’s capture violated the treaty, the United States would be required to release him.

Anna joined our LL.M. program in Fall 2024 and has since approached her studies with steady progress and hard work. Anna sometimes slipped through the cracks in our attention—professors tend to concentrate on superstars who constantly speak out in class or on problem students who need extra help. Anna is neither of those, but instead is simply a quiet but excellent student: doing well in classes, steadily progressing, and steadily learning.
Anna mentioned when she started Pericles’ LL.M. program that she had a goal to visit and study in the United States. This summer she managed it! Under Pericles’ partner-school agreement with Widener University’s Delaware Law School, Anna lived in Delaware for a month, studying Anti-Money Laundering law alongside American and foreign law students. The Pericles/Delaware exchange program was dormant for a few years due to the SMO. The whole process of accomplishing this study abroad was an exercise in determination for Anna. The staff we had worked with at Delaware Law School was gone. The new staff wasn’t sure how to deal with a Russian applicant. Communications were delayed. Anna was asked to complete one document, then asked to complete something else instead. She enrolled in one course, then was switched to another. The entire process was quite confused. So what convinced us to make her student of the month was that Anna determinedly set her mind to studying in the U.S. this summer, and managed it. Anna’s resolve and ability to steadily pursue her goal sets her apart from others.
Pericles’ exchange program with Delaware Law School is an experience that truly embodies the global perspective we aim to foster. We have not only a summer exchange program but a dual M.J or LL.M./M.J. program in which a student can get a U.S. degree along with their Pericles degree. This Pericles/Delaware Law School program is one of very few left for Russian and American law school cooperation. Anna’s perseverance in working through the hurdles has smoothed the process and opened the floodgates for other Pericles students—two more studying at Delaware Law now and others planning to go in the coming year. For her initiative and stubbornness in achieving her goal in the face of confusion and setbacks, we are proud to recognize Anna as Pericles’ student of the month.

I joined the LLM program in 2024 on the recommendation of my former chief, who suggested I look into the Pericles community. Honestly, my first thought was that it could be my chance to study in the USA - and, amazingly, it happened! I still can't believe I got to take a course on AML regulation at Widener University in Delaware, in person (!!). The course was incredibly informative and lasted four weeks, and the whole trip was such an enriching experience - we had university excursions to Washington, visited the district court where we watched litigation processes, and also went to an Italian festival. I know I'll carry these memories with me for a lifetime. A huge thank you to the Pericles team for giving us such a rare and valuable opportunity. | 309 |

I am very happy to be part of the Pericles LL.M. program. Pericles is the kind of place where everyone and everything encourages you to learn – a friendly environment, supportive professors, motivated classmates, an easy-to-use Moodle platform, and great study materials and books.
Studying here is both demanding and fun, and I genuinely enjoy it.
So far, I have completed two courses: Legal Writing I and Introduction to American Law. Legal Writing I not only taught me how to draft legal documents in English — memoranda, client letters, and the like – but also helped me think more clearly about the structure of my writing in Russian and other languages.
As for Introduction to American Law, I found it particularly valuable. The course gave me a clear understanding of how the U.S. legal system is organized – from the role of case law and precedent to the relationship between federal and state courts. We also examined several landmark cases, which really helped me see how legal principles are applied in practice. What stood out to me most was learning how constitutional protections, such as due process and equal protection, function in real-world litigation. Each week built on the previous one, and I finished the course with a much stronger grasp of American legal reasoning.
I am really looking forward to the other courses at Pericles, especially those taught by Marian Dent and Brian Bellerose.

" Few students can you actually accuse of making unmistakable, tangible progress in English over 12 short weeks. Dmitry is one.
He started out in Approaching Legal English, … well, perhaps a bit more than just approaching, but with insatiable curiosity and intense verve. As we progressed through the classes, you could almost see him thirsting for more and more. He posed questions that brought on insightful discussions and, frankly, often left me able to answer only, “I’ll have to get back to you on that later.”
In ALE, you get so much homework that you don’t have to turn it in by a specific date. “Just do it whenever you can,” I like to say, “but try to get it all done.” Dmitry himself runs on a backbreaking schedule—litigation, travel, family—and still he has managed to keep up a flow of assignments filling up my inbox.
Speaking—everyone’s bogeyman in language acquisition—has turned into Dmitry’s particular success. Unflinchingly, he has attacked his bouncing Russian intonation and replaced it with a downward English one, while thereby also facilitating clear, short, and concise sentences. | 11 | Someone recently told me, “I need a legal English course that inspires me. Something that’s valuable, useful, interesting, and even fun.”
Let’s look at these things carefully, like lawyers, or like someone who wants to express ideas precisely in English—just as we do in the course I teach, Approaching Legal English.
First, “valuable.” We usually think of “value” as “ценность,” but that’s off. “Value” is really a ratio: quality received for money paid. The value of a course isn’t what you paid for it, but what you can do with what you got out of it—how much your teacher opened your eyes to new things you can do with English in a better way. You’d be surprised at how many lawyers misuse “valuable.”
Next, “useful.” Probably one of the most mistranslated words. “Useful” isn’t “полезный”: the advice my accountant gave me wasn’t “useful.” It helped me a lot, so it was “helpful.” And that’s what you need when you study legal English.
Now my favorite, “interesting,” the most uninteresting word in the English language—something you say and write only when you can’t come up with anything better. In Approaching Legal English, we’ll concentrate on sharpening your ideas, whether you’re speaking to a client or writing a CV for a new job.
And lastly “fun.” I always think of it like this: I can’t define it, but I sure know it when I see it. Why not come to our first class and experience how much you can enjoy making English work for you?
