*тЬНя╕ПJudicial Vacations and IndiaтАЩs Pendency Crisis* тЩЯя╕П Why in Focus? An opinion article highlights how summer vacations in the Supreme Court and High Courts coincide with IndiaтАЩs massive judicial backlog, renewing the debate on judicial efficiency, court vacations, and access to timely justice. *тЬНя╕П Key Highlights* тЩЯя╕П Massive pendency: As of end-2025, over 5.39 crore cases were pending in Indian courtsтАФ4.76 crore in District Courts, 63.6 lakh in High Courts, and over 92,000 in the Supreme Court. тЩЯя╕П Court vacations: During the annual summer break, only vacation benches hear urgent matters. Critics argue this reduces judicial capacity despite India having one of the highest judge-to-population workloads globally. тЩЯя╕П Colonial legacy: The practice of long court vacations originated during the British colonial period, when judges avoided the Indian summer. Although the Supreme Court renamed the vacation as тАЬPartial Court Working DaysтАЭ in 2024, the number of sitting days remains largely unchanged. тЩЯя╕П Suggested reforms: Instead of abolishing vacations, experts recommend staggered leave, ensuring courts function at full strength throughout the year while allowing judges adequate rest. тЩЯя╕П Alternative Dispute Resolution (ADR): Wider use of Lok Adalats, mediation (under the Mediation Act, 2023), arbitration, and retired judges can reduce court burden and improve access to justice. *тЬНя╕П Challenges / Issues / Implications* тЩЯя╕П Judicial vacancies remain a major cause of delays, with several High Courts operating below sanctioned strength. тЩЯя╕П Rising pendency undermines the constitutional right to speedy justice, disproportionately affecting undertrials and economically weaker litigants. тЩЯя╕П Underutilisation of ADR mechanisms and procedural inefficiencies continue to add pressure on the formal judicial system.

Magistrate's Jurisdiction for Bail: The Allahabad High Court clarified that a Judicial Magistrate has the power to grant bail
Magistrate's Jurisdiction for Bail: The Allahabad High Court clarified that a Judicial Magistrate has the power to grant bail under Section 437 of the Code of Criminal Procedure, 1973, even in cases that are exclusively triable by a Court of Session, provided the offense is not punishable by death or imprisonment for life. The "Negative Tendency": The Court strongly criticized the practice of Judicial Magistrates automatically refusing or avoiding bail applications simply because a case is Sessions-triable. It noted that Magistrates often treat these applications as an "untouchable" subject due to a mistaken belief that they lack jurisdiction.
