ތަޙުޤީޤީ ރިޕޯޓް: ދިވެހިރާއްޖޭގައި ބްރޯޑްކާސްޓިންގެ ވާދަވެރިކަން ހުއްޓުވަން ބަޔަކު އުޅެނީ ކީއްވެ؟ ހިލޭޓީވީއާ ގުޅިގެން މިހާރު ގައުމުގައި އުފެދިފައިވާ ހިޔާލުތަފާތުވުންތަކަކީ ހަމައެކަނި ވެބްސައިޓަކާ ގުޅޭ މައްސަލައެއް ނޫނެވެ. މިއީ މިއަށްވުރެ މާ ފުން، އަދި މާ މުހިންމު ސުވާލެކެވެ. ރާއްޖޭގެ ޓީވީ މާކެޓް ކޮންޓްރޯލް ކުރަނީ ކޮން ބައެއް ހެއްޔެވެ؟ އަދި އާންމު ރައްޔިތުން ބަލާނެ އެއްޗެހި ނިންމުމުގެ ބާރު އޮތީ ކާކަށް ހެއްޔެވެ؟ ހިލޭޓީވީން ބުނާ ގޮތުގައި އެއީ ބްރޯޑްކާސްޓްކުރާ ބައެއް ނޫނެވެ. އަދި ރީ-ބްރޯޑްކާސްޓްކުރާ ނުވަތަ ކޭބަލް ޓީވީގެ ޚިދުމަތްދޭ ބައެއްވެސް ނޫނެވެ. އެ ޕްލެޓްފޯމުން ސިފަކުރާ ގޮތުގައި އެއީ އެކި ވަސީލަތްތަކުން ލިބެން ހުންނަ ކޮންޓެންޓް އެއްތަނަކުން ފެންނާނެ މަގުފަހިކޮށްދޭ (content aggregation) ޚިދުމަތެކެވެ. އެތަނަކީ އަމިއްލައަށް ޓީވީ ޗެނަލްތައް ހޯސްޓްކުރާ ނުވަތަ އަލުންދޭ (retransmit) ތަނެއް ނޫނެވެ. ނަމަވެސް، މި ދިފާޢުގައި ދެމިއޮތް ނަމަވެސް، ހިލޭޓީވީއާ ދެކޮޅަށް ޤާނޫނީ ފިޔަވަޅުތައް އަޅައި، އެ ވެބްސައިޓަށް ނުވަދެވޭ ގޮތް ހެދުމަށް ބަޔަކު ދަނީ މަސައްކަތް ކުރަމުންނެވެ. މިކަމުގައި އޮތް ތަޟާދު (irony) ފާހަގަނުކޮށް ދޫކޮށްލެވޭކަށް ނެތެވެ. ރާއްޖޭގެ ކޭބަލް ޓީވީގެ ބާޒާރުގައި މިހާރުވެސް އޮތީ އެންމެ ކުންފުންޏެއްގެ ނުފޫޒު އިންތިހާއަށް ގަދަވެފައެވެ. މާކެޓް އެއްބައެއްގެ އަތްމަތީގައި އޮތުމާއި، އާ އީޖާދީ ވަސީލަތްތަކަށް ވާދަކުރުމުގެ ހަމަހަމަ ފުރުޞަތު އޮތްތޯ އަބަދުވެސް ސުވާލު އުފެދެއެވެ. ރާއްޖޭގެ ރީ-ބްރޯޑްކާސްޓް ކުރުމުގެ ޤަވާޢިދުތަކުންވެސް މި ވާހަކަތަކަށް ބާރުލިއްބައިދެއެވެ. ސަރުކާރުގެ ގެޒެޓްގައި ޝާއިޢުކޮށްފައިވާ ރީ-ބްރޯޑްކާސްޓް ކުރުމުގެ ޤަވާޢިދަކީ (https://gazette.gov.mv/gazette/6891) މި ދާއިރާ ހިންގާ ޤާނޫނީ އޮނިގަނޑެވެ. މި ޤަވާޢިދަށް އެންމެ ފަހުން ގެނެވުނު އިޞްލާޙުތަކުގައި، އަމިއްލަ ބޭނުމަށްޓަކައި ގޭބިސީތަކުންނާއި ފަރުދުން ޗެނަލްތައް ބެލުމަކީ ރީ-ބްރޯޑްކާސްޓް ކުރުމުގެ ލައިސަންސް ނެތް ނަމަވެސް ކުރެވިދާނެ ކަމެއްގެ ގޮތުގައި ސަރީޙަކޮށް ބަޔާންކޮށްފައިވެއެވެ. ވީއިރު، ރައްޔިތުންނަށް އަމިއްލަ ބޭނުމަށް ޤާނޫނީ ގޮތުން ޗެނަލްތަކަށް ވަދެވޭނަމަ، ހިލޭޓީވީގެ މައްޗަށް ކުރެވެނީ ކޮން ތުހުމަތެއް ހެއްޔެވެ؟ ހިލޭޓީވީން ތަކުރާރުކޮށް ބުނަމުންދަނީ އެފަރާތުން ސްޓްރީމްތައް ހޯސްޓް ނުކުރާ ކަމަށާއި، ބޭރުގެ ޗެނަލްތައް އަލުން ނުދޭ (retransmit) ނުހަދާ ކަމަށެވެ. އަދި އެއީ ކޭބަލް ނެޓްވޯކެއް ނޫން ކަމަށްވެސް ބުނެއެވެ. "އަޅުގަނޑުމެން މަސައްކަތް ކުރަނީ ރާއްޖޭގައި ލައިސަންސް ލިބިފައިވާ ބްރޯޑްކާސްޓަރުންނާ ގުޅިގެން. އަދި ޚިދުމަތް ފެށީއްސުރެ ކޮންމެ އަހަރަކު އާ ޗެނަލްތައް އުފައްދައި، މީޑިއާނެޓަށް ވަރުގަދަ ގޮންޖެހުމަކަށް ވެފައިވާނެ،" ހިލޭޓީވީން ބުނެއެވެ. ވީއިރު، ހިލޭޓީވީއާ މެދު ގޮތް ނިންމަމުންދަނީ އެތަނުން ކުރާ ކަމަކަށް ބަލާފައި ހެއްޔެވެ؟ ނުވަތަ ގާއިމުވެފައި އޮތް ވިޔަފާރީގެ ނިޒާމަކަށް ނުރައްކާވާތީ ހެއްޔެވެ؟ މި ސުވާލުތައް އިތުރަށް ސީރިއަސް ވަނީ، ޓީވީ އިންޑަސްޓްރީގެ މިލްކުވެރިކަމާއި އޭގެ ފަހަތުގައި އޮތް ސިޔާސީ ނުފޫޒުތަކަށް ބަލާއިރުއެވެ. ރާއްޖޭގެ ރައްޔިތުންގެ މަޖިލީހުގެ މެންބަރުން ކުރައްވާ ކަންކަމަކީ އެންމެންނަށް އެނގޭ ބޮޑު ސިއްރެކެވެ. ބްރޯޑްކާސްޓް ކުރުމާއި ރީ-ބްރޯޑްކާސްޓް ކުރުމުގެ ދާއިރާގައި ސިޔާސީ ނުފޫޒުގަދަ ފަރާތްތަކުގެ ވިޔަފާރީގެ މަޞްލަޙަތު އޮތް ކަމީ ފެންނަން އޮތް ހަގީގަތެކެވެ. މީގެ ސަބަބުން، މަޞްލަޙަތު ފުށުއެރުމާއި، ބާޒާރުގައި އަލަށް ފަށާ ފަރާތްތަކާއި ކުރިން ތިބި ފަރާތްތަކާ މެދު ޤަވާޢިދުތައް ހަމަހަމަކޮށް ހިންގޭތޯ ސުވާލު އުފެދެއެވެ. ދިވެހިރާއްޖެއަކީ އަމިއްލަ ޤާނޫނުތަކެއް ހިނގާ މިނިވަން މުސްތަޤިއްލު ޤައުމެކެވެ. ބޭރުގެ ބޮޑެތި ކުންފުނިތަކަކުން ބޭނުންވުމަކުން، އެހެން ޤައުމުތަކުގެ ޤާނޫނުތަކަށް ރާއްޖެ ތަބާވާކަށް ނުޖެހެއެވެ. އެމެރިކާގެ 'ޑީ.އެމް.ސީ.އޭ' ފަދަ ބޭރުގެ އޮނިގަނޑުތަކަށް ހަވާލާދީ ދައްކާ ވާހަކަތަކަކީ، ރާއްޖޭގެ އެތެރޭގައި ކަމެއް ހަލާލު ނުވަތަ ހަރާމް (ޤާނޫނީ ނުވަތަ ޣައިރު ޤާނޫނީ) ކަމެއްގެ ގޮތުގައި އޭގެ ޒާތުގައި ނިންމޭނެ ކަންކަމެއް ނޫނެވެ. އެންމެ ފަހުގެ ސުވާލަކީ މިއެވެ: ބާޒާރުގައި އޮތް އެއްކުންފުންޏެއްގެ ބާރުވެރިކަމަށް (monopoly) ގޮންޖެހުމެއް ކުރިމަތިވާތީ، އާ އީޖާދީ މަސައްކަތްތައް ފުނޑާލަންވީ ހެއްޔެވެ؟ ނުވަތަ، ރާއްޖޭގެ ޤާނޫނުތަކުގެ އިމުގެ ތެރެއިން ޚިދުމަތް ދެވޭނަމަ، މައުލޫމާތާއި މުނިފޫހިފިލުވުމުގެ ޚިދުމަތް ހޯދާނެ ގޮތެއް އިޚްތިޔާރު ކުރުމުގެ މިނިވަންކަން ދިވެހި ރައްޔިތުންނަށް އޮންނަންޖެހޭނެ ހެއްޔެވެ؟ މި ސުވާލުގެ ޖަވާބުން ނިމެނީ ހަމައެކަނި ހިލޭޓީވީގެ މުސްތަޤުބަލެއް ނޫނެވެ، ރާއްޖޭގެ މީޑިއާގެ މިނިވަންކަމާއި، ވިޔަފާރީގެ ވާދަވެރިކަމާއި، ޓެކްނޮލޮޖީގެ ކުރިމަގުވެސް ކަނޑައެޅިގެން މިދަނީ މިހާރު މި ފެން މަންޒަރު ތަކުގެ މައްޗަށެވެ.

Investigation: Is Competition in Maldivian Television Being Silenced? The battle over HilayTV is no longer just about a website. It is about a bigger question: Who controls television in the Maldives, and who gets to decide what the public can watch? HilayTV maintains that it is not a broadcaster, not a rebroadcaster, and not a cable television operator. The platform describes itself as a content aggregation service that does not host or retransmit television channels. Yet despite this position, HilayTV has become the target of legal action and website blocking attempts. The irony is difficult to ignore. The Maldives already has a dominant cable television operator with a massive presence in the market. Questions have long been raised about market concentration and whether new technologies are given a fair opportunity to compete. Even the regulatory history tells a story. The Rebroadcasting Regulation published in the Maldives Government Gazette provides the legal framework governing rebroadcasting services: https://gazette.gov.mv/gazette/6891 The latest amendments explicitly permit households and individuals to watch channels for personal use without obtaining a rebroadcasting licence. If citizens can legally access channels for personal use, then what exactly is HilayTV being accused of? HilayTV insists it does not host streams. It does not retransmit foreign channels. It does not operate a cable network. We only work with licensed Broadcasters in the Maldives and actually seriously challenge Medianet by creating totally new channels every year since the beginning of our operations. So is HilayTV being judged based on what it actually does or simply because it threatens an established business model? The questions become even more significant when one examines the ownership structures and political influence surrounding the television industry. Everyone knows what our parliament members are doing in the Maldives parliament. It is a matter of public record that influential political figures have business interests in the broadcasting and rebroadcasting sector. This naturally raises concerns about conflicts of interest and whether regulation is always applied equally to newcomers and incumbents. The Maldives is a sovereign nation with its own laws. It is not bound by foreign legislation simply because powerful companies invoke it. Claims based on foreign frameworks such as the DMCA do not automatically determine what is legal or illegal inside the Maldives. The ultimate question is simple: Should innovation be crushed because it challenges an existing monopoly? Or should Maldivians be free to choose how they access information and entertainment, provided the service operates within the laws of the Maldives? The answer to that question will determine not only the future of HilayTV, but the future of media freedom, competition and technological innovation in the Maldives itself.
