Landmark judgement:Supreme Court recently while hearing a PIL by journalist Sukanya Shantha held caste based division of labour in prisons is "unconstitutional".Provisons in prison manuals of UP, WB, Odisha, Maharashtra , TN etc were highlighted. Eg. Rajasthan Prison Rules, 1951 allocated latrine duties to the 'Mehtar' caste-a SC, while Brahmins assigned kitchens. Manuals reinforce colonial stereotypes of caste. Eg. Criminal Tribes Act, 1871 had some tribes as 'criminal tribes' meaning they were 'born criminals'. It's violation of Article 14 as Supreme Court said, "caste as criteria for classification can be employed only when it seeks to benefit victims of caste discrimination. Segregating prisoners on the basis of caste reinforce caste differences or animosity that ought to be prevented in the first place.Differentiating inmates based on 'habit', 'custom', 'superior mode of living', 'natural tendency to escape' offends principle of substantive equality. Violation of Article 15,17 and 21 also. When Prison manuals restrict reformation of prisoners from marginalised groups added to deprived from sense of dignity, they violate Article 21. Usage gs1 caste status in notion, changing forms of caste or not, discrimation of marginalised, social justice, gs2 prison reforms, judicial activism, PIL, gs4 dignified life, good governance, institutional biasness. #casteism #prison_reforms Kindly speak for us to others.
