LODGING A COMPLAINT
Zero FIR will allow complaints to be filed at any police station regardless of the crime's location, streamlining the initiation of legal action.
INVESTIGATION
Police have 90 days to probe the case (which may be extended for the reasons to be recorded in writing, to 120 days.) The progress report of the case will be informed to the victim within 90 days from the date of registration of FIR.
GOING DIGITAL
Complainants can now file police complaints through a designated portal or police website.
Notably, the submitted e-FIRs are forwarded to the investigation officer for initial verification.
JUSTICE
INCLUSIVE AND PROGRESSIVE MEASURES:
The new laws expand definitions to include transgender individuals, promote gender inclusivity, and introduce streamlined court procedures for efficient legal proceedings.
JUDGEMENT TIMELINES
Strict timelines for delivering trial judgments within 30 days from the date of completion of arguments, which may be extended to a period of 45 days.
WITNESS PROTECTION
Every State Government shall prepare and notify a Witness Protection Scheme for the State with a view to ensure protection of the witness.
VIDEO STATEMENT
The new laws make it mandatory to record the statement of rape victim through audio-video mode.
DETENTION
Police can now detain any person who is resisting, refusing, ignoring or disregarding any form of direction for 24 hours.
NEW DEFINITIONS
Definition updates include emerging crimes such as false promise of marriage and gang rape of minors, alongside a comprehensive definition of terrorism.
CRIME SCENE RECORDING
Compulsory provisions have been introduced for video recording of evidence, search and seizure with aims to reduce the scope of framing someone.
CRIMES AGAINST WOMEN AND CHILDREN
Buying or selling a child for purposes of prostitution, etc, is punishable by severe penalties. Rape of a woman under twelve years of age can result in a death sentence or life imprisonment.
FORENSIC INTERVENTION
For serious offences, forensic experts are to visit the crime scene to collect the evidence.
MODERN TIMES
Courts are also being modernised and through ICJS, Forensic Science University, Police Stations, Home Department, Public Prosecutor Office, and Jails are on the verge of going online under a single software.
