Hello all
I have left teaching completely and gave my 8 years in teaching students with honesty and gave a little bit of what I was aware of. What is Evergreening of the Patent?
A common term that is often used in the news related to IPR regime.
Suppose a company develops a medicine and gets a 20-year patent.
As the patent is about to expire, the company makes a small change to the medicine—such as changing its form or formulation—and applies for a new patent.
This attempt to extend patent protection through minor modifications is called “evergreening of patents.”
Novartis Example:
Novartis had a cancer drug called Glivec (imatinib).
It sought a patent for a modified crystalline form of the drug.
But under Section 3(d) of India’s Patent Act, simply creating a new form of an existing substance is not enough. It must show enhanced therapeutic efficacy.
In 2013, the Supreme Court rejected Novartis’ patent claim
The easiest way to remember:
Factor → Basic → Market
First ask:
Factors ko kitna mila?
↓
Production activity par tax/subsidy adjust karo
↓
Product par tax/subsidy adjust karo
↓
Market Price
And remember — these are not three different GDPs.
It is the same economic activity valued at different stages.
Imagine you manufacture a shirt.
Now let's see what happens to its value at different stages.
1. Factor Cost — Factors ko kitna mila?
Suppose the production of the shirt generates:
Wages = ₹600
Interest = ₹100
Profit = ₹200
Total = ₹900
This ₹900 is the income going to the factors of production.
So:
Factor Cost = ₹900
Think: “Production se factors ko kitna mila?”

2. Basic Price — Producer ko production ke liye kya milta hai?
Now suppose the government charges a production tax of ₹50.
For example, a factory may have to pay a tax/fee linked to its operation or production activity, such as a pollution/environment-related production levy.
Suppose the government also gives a production subsidy of ₹10 to encourage cleaner production.
Therefore:
₹900 + ₹50 − ₹10 = ₹940
So:
Basic Price = ₹940
In simple terms:
Factor Cost + Production Taxes − Production Subsidies = Basic Price
The important point is:
Production tax/subsidy is related to the act of producing or operating, not to the individual shirt being sold.

3. Market Price — Customer finally kitna pay karega?
Now the shirt reaches the market.
Suppose the government imposes a product tax of ₹80, such as GST on the sale of the shirt.
At the same time, suppose the government provides a product subsidy of ₹20 that reduces the effective price paid by the buyer.
Therefore:
₹940 + ₹80 − ₹20 = ₹1,000
So:
Market Price = ₹1,000
In simple terms:
Basic Price + Product Taxes − Product Subsidies = Market Price
A very common student confusion is:
“Sir, GDP toh GDP hai… phir Factor Cost, Basic Price aur Market Price alag-alag kya hain?”
The easiest way is to understand it as a chain, rather than memorising three definitions.
