An inflationary application of such paragraphs ultimately weakens democracy itself, as it privatises and criminalises discourse – and places power in the hands of ideological activists. The case also shows that Germany has reached a dangerous point: prosecutors are examining statements by top politicians about everyday realities, while real issues – whether crime, integration problems, or political corruption – are hardly pursued with similar consistency. Therefore, anyone who still believes that the judiciary is neutral fails to recognise the ideological enforcement of the institutions. The real danger to democracy does not come from people like Merz, but from those who want to prevent open debate by posing as the moral guardians of the republic. A sentence like "there is this problem in the cityscape" should not be a reason for legal investigations in a mature community.
