ʿAbd Al-ʿAzīz bin Yaḥya Al-Kinānī (240 AH) – Raḥimahu Allāh - was asked about these Āyāt (the three about not ruling by the law of Allāh), so he said: «إِنَّهَا تَقَعُ عَلَى جَمِيعِ مَا أَنْزَلَ اللَّهُ لَا عَلَى بَعْضِهِ، فَكُلُّ مَنْ لَمْ يَحْكُمْ بِجَمِيعِ مَا أَنْزَلَ اللَّهُ فَهُوَ كَافِرٌ ظَالِمٌ فَاسِقٌ، *فَأَمَّا مَنْ حَكَمَ بِمَا أَنْزَلَ اللَّهُ مِنَ التَّوْحِيدِ وَتَرْكِ الشِّرْكِ، ثُمَّ لَمْ يَحْكُمْ بِجَمِيعِ مَا أَنْزَلَ اللَّهُ مِنَ الشَّرَائِعِ، لَمْ يَسْتَوْجِبْ حُكْمَ هَذِهِ الْآيَاتِ».* وَقَالَ الْعُلَمَاءُ: «هَذَا إِذَا رَدَّ نَصَّ حُكْمِ اللَّهِ عِيَانًا عَمْدًا، فَأَمَّا مَنْ خَفِيَ عَلَيْهِ أَوْ أَخْطَأَ فِي تَأْوِيلٍ فَلَا». “This is about everything that Allāh has sent down, not some of it, so everyone that does not rule by everything that Allāh has sent down is a Kāfr, a Ẓālim (transgressor) and a Fāsiq (deviant). *As for the one who rules by what Allāh sent down with regards to Tawḥīd and abandoning Shirk, then does not rule by everything [else] that Allāh sent down from legislation, then the ruling of these Āyāt do not apply to him.”* The scholars said: “This is if he rejects the explicit ruling of Allāh knowingly and deliberately, as for the one to whom it was hidden or who erred in an interpretation, then no.” [1] _____ [1] “Tafsīr Al-Baghawī ” (Vol. 3, P. 61) .
