🌟 Procedure in case of Re-arrest in case of failure Grounds of Arrest ISSUE: Whether the police can freely re-arrest a person after the earlier arrest has been declared illegal solely for failure to furnish the grounds of arrest in writing, as mandated by Article 22(1) of the Constitution. ⚖ Re-arrest Permissible with conditions 𝟭. 𝗙𝘂𝗿𝗻𝗶𝘀𝗵𝗶𝗻𝗴 𝗼𝗳 𝗚𝗿𝗼𝘂𝗻𝗱𝘀 𝗼𝗳 𝗔𝗿𝗿𝗲𝘀𝘁 The grounds of arrest must first be furnished in writing to the accused. 𝟮. 𝗔𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻 𝗳𝗼𝗿 𝗥𝗲-𝗮𝗿𝗿𝗲𝘀𝘁 Only thereafter may the police file an application before the concerned Judicial Magistrate seeking permission to re-arrest the accused. The application must: Be endorsed by the immediate superior of the officer who made the first (illegal) arrest; Contain an explanation for the earlier non-supply of the grounds of arrest. 𝟯. 𝗠𝗮𝗴𝗶𝘀𝘁𝗿𝗮𝘁𝗲'𝘀 𝗖𝗼𝗻𝘀𝗶𝗱𝗲𝗿𝗮𝘁𝗶𝗼𝗻 The Magistrate must decide the application expeditiously. Re-arrest may be permitted only if the Magistrate is satisfied that: (a) There were bona fide reasons for not furnishing the grounds at the first instance; and (b) The accused needs to be re-arrested. 𝟰. 𝗖𝗵𝗮𝗻𝗴𝗲 𝗼𝗳 𝗜𝗻𝘃𝗲𝘀𝘁𝗶𝗴𝗮𝘁𝗶𝗻𝗴 𝗢𝗳𝗳𝗶𝗰𝗲𝗿 The investigation must be transferred to another officer. 𝟱.
