What did the architects of post-war Europe realize? To begin with, let's go back to the thirties. In the interwar period, Europe was hit by a crisis of liberalism and parliamentary democracy. Look at the map. Most countries in Europe had authoritarian regimes, and Eastern Europe had no democratic regimes at all, except Czechoslovakia. And this is a map BEFORE Hitler's conquests. And in this atmosphere, in 1937, Karl Löwenstein (on the photo), a liberal lawyer of Jewish origin, who fled from Germany to the USA, proposed the idea of "militant democracy". The meaning of the idea is very simple - democracy should have fists and not be afraid of such measures as banning fascist parties or disenfranchising enemies of democracy. All other parties should, when threatened from the right, unite in broad anti-fascist coalitions. In short, democracy should not be afraid to step on the throat of its own song - if anti-fascism demands it. After World War II, Löwenstein worked for the American occupation administration - working on the new legislation of the future Federal Republic of Germany and supervising the academic process in the field of jurisprudence. Incidentally, it was Löwenstein who filed a criminal complaint against Carl Schmitt - and it was Carl Schmitt who first identified Löwenstein's future problematics in his "The Crisis of Parliamentary Democracy". Löwenstein's ideas had a direct influence on the Basic Law of West Germany - that is why the far right party "Imperial Socialists" was the first to be banned in the FRG, and the German secret service is called the "Office for the Protection of the Constitution". The FRG became a "militant democracy." Similar principles, although in a softened form, were established in other countries of Western Europe - for example, in Italy, in France and in Austria. And in 1947, based on the requirements of the Marshall Plan, the original anti-fascist restrictions were extended to Communists. In the Federal Republic of Germany they were simply banned, and in other countries they put an invisible barrier in their way - not a single Communist entered Western governments during the Cold War. Another tool of "militant democracy" is the Constitutional Court. The aforementioned Carl Schmitt believed that the main guarantor of democracy should be a president standing above the parties. The Austrian liberal lawmaer Hans Kelsen, for whom the Constitutional Court was such an instrument, argued with him. Kelsen, of course, won this absentee dispute. Before World War II, there was no such institution anywhere - except America and Australia. But after the war, the CC became an indispensable attribute of liberal democracy. Constitutional Courts must be filled with supporters of a liberal interpretation of the law, who in turn must stand for democracy and keep the legislature in check. The Constitutional Court in France has even been called "a cannon aimed at Parliament." The majority may be wrong - but the Constitutional Court is never wrong. Another tactic, labeled by Löwenstein, is broad cross-party coalitions directed against "fascists." This method was first tried in the mid-1930s by the Popular Front in Spain and France. This tactic still works today: in France, when the nationalists go into the second round, they are opposed every time by everyone from Trotskyites to conservatives. And in Germany, the Christian Democrats recently announced that they will enter a coalition with any party - a coalition against the nationalist AfD. So, it turns out that the system that has developed in post-war Europe is not just a democracy, but a special "democracy with fists", which considers it its duty, firstly, to determine who is an enemy of democracy, and, secondly, to come down on these people with all its might.
