Electoral Bonds Scheme

The SC has declared the Electoral Bonds Scheme unconstitutional.

No Immunity For MPs/MLAs Taking Bribe For Vote/Speech In Legislature

The SC held that legislators are not immune to criminal prosecution for bribery charges related to their speech and votes made in Parliament and Legislative Assemblies. SC overruled its own 1998 judgement in P V Narasimha Rao v State (CBI/Spe), where it held that legislators were immune from prosecution for taking such bribes.

SC upholds Section 6A of Citizenship Act as valid law

✅Section 6A  of the Citizenship Act 1955✅ 1. Immigrants who entered Assam before January 1, 1966, are deemed to be Indian citizens. 2. Immigrants who entered Assam between January 1, 1966, and March 25, 1971, are entitled to seek Indian citizenship provided they fulfil the eligibility criteria. 3. Immigrants who entered Assam on or after March 25, 1971, are declared to be illegal immigrants and are liable to be detected, detained and deported.

Minority status of Aligarh Muslim University (AMU)

✅SC overruled Azeez Basha v Union of India (1967) which held that Aligarh Muslim University (AMU) did not have minority status under Article 30, as it was established through Union legislation.  ✅SC for the first time in 75 years laid down parameters to determine a minority institution held that an institution. SC  can be considered a minority institution if it is “established” by members of a minority community, with the “administration” of the institution being a consequence of its establishment. ✅A regular bench will use these parameters to study the minority status of AMU.
