The Ruling on a Relative Signing Surgical Consent in Place of the Husband 📩Question📩 🔹A Man asked:🔹 "A woman was taken into surgery, and the hospital requested that her husband sign the consent form for the operation. The husband was not present, so one of the relatives signed on his behalf. Then the woman died. What is the ruling regarding the person who signed in place of the husband?" 📨Answered by:📨 🎙Ash-Shaykh Abee Billal Al-Hadramee ((حفظه الله)) If it was possible to contact her husband, then that relative had no right to act in such a situation. Rather, he should have sought the husband's permission, for the husband has more right in this matter than her father, her mother, or her brothers. His right over her is greater than the right of the father and the mother. Therefore, he should not have acted in this mistaken manner. For example, it may be that the husband did not agree with the operation that was proposed. He might have believed that there was another possible treatment by which she could be treated, even if her recovery would be delayed. In such a case, your action was a mistake. However, if the illness could not tolerate any delay, and it was absolutely necessary for her to undergo the operation, and they could not locate her husband they did not know where he was, he had no phone, nor any other means of contacting him and they genuinely tried to reach him but were unable to do so, and if delaying the operation might have caused the woman to die, then the relative intended to do good by signing, hoping that Allaah would cure her and grant her recovery through that operation. In that case, it is hoped that there is no sin upon him. The medical staff would not proceed with the operation except after obtaining the signature of one of the relatives. Nevertheless, he should seek the husband's pardon, and, Allaah willing, he is excused because his action fell under the category of doing good (iḥsān). For had the woman been left without the operation, she might have died. She underwent the operation, and Allah decreed what He willed. As for when it is possible to reach the husband, and the operation is not one of those absolutely necessary procedures meaning that delaying it would not harm the woman then do not act in this manner, and do not be hasty.
