If you don’t know your rights… you don’t have them. Not because they don’t exist. But because they’re never brought forward. Rights are not self-executing. They don’t operate on their own. They must be known… and they must be asserted. Otherwise, something else steps in. Administration. Process replaces principle. Procedure replaces protection. And before long, what should have been a boundary… becomes something you’re expected to comply with. This is why the Bill of Rights matters. By 1791, the people had already experienced power—both under a king and under their own new government. They weren’t guessing. They knew exactly what needed to be restrained. Not because they don’t believe in it… but because somewhere in the back of their mind they’re wondering: “What happens if I actually step forward with this?” That hesitation is more common than people admit. And it doesn’t come from nowhere. But here’s what often hasn’t been brought fully into view: The right of private association is not something new. It’s not something fringe. It’s not something that exists in a gray area. It is woven into the very fabric of this country. From the principles expressed in the Declaration of Independence… to the structure of early union under the Articles of Confederation… to the foundational protections carried forward into the United States Constitution and the Bill of Rights… the ability of people to associate, assemble, and operate in the private has always been part of the design. Last night’s class was a little bit nutso… and also amazing. Zoom decided at the last minute that it wanted a password along with the link, which meant we had some unexpected pauses while we got everyone into the room. Huge thank you to Nancy, who was watching the Telegram chat and helping people get connected while we worked through it. That made a big difference. Despite the chaos, the class itself was really good. We had a great conversation exploring “The Act That Gave Intention a Voice” and why wills developed in the first place — not just as end-of-life documents, but as the way a person’s intention can continue guiding things when they are no longer there to explain it. I’ve just sent an email out to everyone who signed up for the class with the replay links. This coming Monday night we step into Week 3 of our series: The Acts that Secure Title. So far we’ve explored something most people never hear explained clearly… How title and use became separated, and how that separation eventually gave rise to trusts. But once that separation existed, a new question naturally followed. What happens when the person who holds intention is not present to speak? Maybe they are traveling. Maybe they are sick. Maybe they simply aren't there when a decision needs to be made. And sometimes… someone dies. This is where wills enter the story. Most people only hear the phrase Last Will and Testament and assume a will is something written at the end of life. But historically a will is something much broader. A will is simply the expression of intention — written in such a way that it can continue speaking even when the person who formed that intention is not present. When intention is clear, responsibility can continue peacefully. When intention is unclear… confusion usually follows. On Monday night we’ll explore: • Where wills actually came from • Why equity recognized expressed intention • How written intention stabilizes responsibility • And why learning to express your will clearly is one of the most practical things a person can do.
