🔆 What Does Thailand’s New Amnesty Act Cover? 📍 Why in News? 🟢 Thailand’s Peaceful Society Promotion Act, an amnesty initiative passed by lawmakers in July, came into effect on August 24. 🟢 The government of Prime Minister Anutin Charnvirakul has presented it as a step towards political reconciliation. 🟢 The move comes amid Thailand’s long-running political divisions linked to former Prime Minister Thaksin Shinawatra, royalist groups and pro-democracy movements. 📍 What Does the Act Provide? 🟢 The Act covers political cases recorded between 2005 and 2025. 🟢 It lists more than 40 categories of offences eligible for amnesty consideration. 🟢 These include charges such as sedition, rebellion, cybercrimes and violations of emergency laws. 🟢 A “Peaceful Society Promotion Committee”, led by the Prime Minister or Deputy Prime Minister, will determine eligibility. 🟢 The committee can order the release of prisoners, closure of investigations and prosecutions, dismissal of pending cases and clearing of criminal records. 📍 Who Could Benefit? 🟢 Thai Lawyers for Human Rights says that more than 5,000 people have faced prosecution over political conflicts since the 2006 coup. 🟢 The beneficiaries could include members of pro-Shinawatra groups, pro-democracy activists, anti-monarchy groups and royalists involved in the 2006 “yellow shirt” protests. 🟢 The Act could therefore clear the criminal records of thousands of people linked to Thailand’s prolonged political conflict. 📍 Major Exclusions 🟢 Article 112 of Thailand’s Criminal Code, the lèse-majesté provision dealing with offences against the monarchy, remains excluded. 🟢 As a result, many pro-democracy activists charged under Article 112 may not benefit from the amnesty. 🟢 A proposal to extend amnesty to Section 112 convicts who were under 18 at the time of the offence was rejected. 📍 Why is Article 112 Controversial? 🟢 Critics argue that Article 112 has been used as a tool to suppress political dissent. 🟢 Human rights groups have also raised concerns about minors facing such charges. 🟢 Critics say excluding Article 112 makes reconciliation selective and conditional, rather than comprehensive. 📍 Other Concerns 🟢 Critics have questioned the inclusion of certain election-fraud-related offences within the scope of the amnesty. 🟢 They argue that such provisions could benefit individuals accused of electoral collusion, extending the Act beyond its stated objective of addressing political expression and conflict. 📍 Political Significance 🟢 Thailand’s political landscape has been marked by coups, mass protests, judicial interventions and intense conflict between competing political factions. 🟢 The sweeping amnesty could help the government build support across multiple political camps. 🟢 However, its effectiveness will depend on whether reconciliation is perceived as inclusive, impartial and consistent with justice and accountability. 📍 Key Takeaway 🟢 Thailand’s new Amnesty Act seeks to close two decades of political conflict through legal forgiveness and reconciliation. 🟢 Yet, the exclusion of lèse-majesté cases highlights the central dilemma: Can political reconciliation succeed when some of the most controversial forms of dissent remain outside its scope? 🔹 UPSC Mains Question: “Amnesty laws can promote political reconciliation, but selective exclusions may undermine justice, accountability and lasting peace.” Discuss in the context of Thailand’s new Amnesty Act. #InternationalRelations
