| 5 | Warning against the Fitnah of Spouses and Offspring
Allah states that some wives and children are enemies to their husbands and fathers, in that they might be busied with them rather than with performing the good deeds. Allah said in another Ayah,
يأَيُّهَا الَّذِينَ ءَامَنُواْ لاَ تُلْهِكُمْ أَمْوَلُكُمْ وَلاَ أَوْلَـدُكُمْ عَن ذِكْرِ اللَّهِ وَمَن يَفْعَلْ ذَلِكَ فَأُوْلَـئِكَ هُمُ الْخَـسِرُونَ
(O you who believe! Let not your properties or you children divert you from the remembrance of Allah. And whosoever does that then they are the losers.) (63:9) Allah the Exalted said here,
فَاحْذَرُوهُمْ
(therefore, beware of them!) for your religion, according to Ibn Zayd. Mujahid explained the Ayah ,
إِنَّ مِنْ أَزْوَجِكُمْ وَأَوْلـدِكُمْ عَدُوّاً لَّكُمْ
(Verily, among your wives and your children there are enemies for you;) by saying, "They might direct the man to sever his relation or disobey his Lord. The man, who loves his wives and children, might obey them in this case."
Ibn Abi Hatim recorded that Ibn Abbas said to a man who asked him about this Ayah,
يأَيُّهَا الَّذِينَ ءَامَنُواْ إِنَّ مِنْ أَزْوَجِكُمْ وَأَوْلـدِكُمْ عَدُوّاً لَّكُمْ فَاحْذَرُوهُمْ
(O you who believe! Verily, among your wives and your children there are enemies for you; therefore beware of them!) "There were men who embraced Islam in Makkah and wanted to migrate to Allah's Messenger. However, their wives and children refused to allow them. Later when they joined Allah's Messenger ﷺ, they found that those who were with him (the Companions) have gained knowledge in the religion, so they were about to punish their wives and children. Allah the Exalted sent down this Ayah,
وَإِن تَعْفُواْ وَتَصْفَحُواْ وَتَغْفِرُواْ فَإِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ
(But if you pardon (them) and overlook, and forgive, then verily, Allah is Oft-Forgiving, Most Merciful.)" At-Tirmidhi collected this Hadith and said that it is Hasan Sahih.
Allah's statement,
إِنَّمَآ أَمْوَلُكُمْ وَأَوْلَـدُكُمْ فِتْنَةٌ وَاللَّهُ عِنْدَهُ أَجْرٌ عَظِيمٌ
(Your wealth and your children are only a Fintah, whereas Allah! With Him is a great reward.) Allah said that the wealth and children are a test and trial from Allah the Exalted for His creatures, so that He knows those who obey Him and those who disobey Him.
Allah's statement,
وَاللَّهُ عِنْدَهُ
(whereas Allah! With Him) meaning, on the Day of Resurrection,
أَجْرٌ عَظِيمٌ
(is a great reward.) As Allah said;
زُيِّنَ لِلنَّاسِ حُبُّ الشَّهَوَتِ مِنَ النِّسَآءِ وَالْبَنِينَ وَالْقَنَـطِيرِ الْمُقَنطَرَةِ مِنَ الذَّهَبِ وَالْفِضَّةِ وَالْخَيْلِ الْمُسَوَّمَةِ وَالأَنْعَـمِ وَالْحَرْثِ ذَلِكَ مَتَـعُ الْحَيَوةِ الدُّنْيَا وَاللَّهُ عِندَهُ حُسْنُ الْمَأَبِ
(Beautified for men is the love of things they covet; women children, Qanatir Al-Muqantarah of gold and silver, branded beautiful horses, cattle and well-tilled land. This is the pleasure of the present world's life; but Allah has the excellent return with him.) (3:14), and the Ayah after it. Imam Ahmad recorded that Buraydah said, "The Messenger of Allah ﷺ was giving a speech and Al-Hasan and Husayn came in wearing red shirts, walking and tripping. The Messenger descended from the Minbar, held them and placed them in front of them and said,
«صَدَقَ اللهُ وَرَسُولُهُ إِنَّمَا أَمْوَالُكُمْ وَأَوْلَادُكُمْ فِتْنَةٌ، نَظَرْتُ إِلَى هَذَيْنِ الصَّبِيَّيْنِ يَمْشِيَانِ وَيَعْثُرَانِ، فَلَمْ أَصْبِرْ حَتْى قَطَعْتُ حَدِيثِي وَرَفَعْتُهُمَا»
(Allah and His Messenger said the truth,Verily, your wealth and your children are a Fitnah.' I saw these two boys walking and tripping and could not be patient until I stopped my speech and picked them up.)" This was recorded by the Sunan compilers, and At-Tirmidhi said, "Hasan Gharib."

| 11 | Wudu' instead of Ghusl in the state of Janabah: Is it allowed?
The eighth question of Fatwa no. 8823
Q: Is it permissible for a person who has sexual intercourse with his wife during the night and gets up late, to perform Wudu' (ablution) and perform Salah (prayer) instead of taking a Ghusl (ritual bath)? In fact, this may well take place because he wants to be on time or wait till the cold hours pass. Or, is it absolutely prohibited to offer Salah while in a state of Janabah (major ritual impurity related to sexual discharge)?
A: Such a person has to take a Ghusl in order to be purified from the state of Janabah and, consequently, to perform Salah. In such a case, performing Wudu' is not sufficient. Moreover, Tayammum (dry ablution) is not sufficient for him as long as there is the ability to use water even if he has to buy it. For such a person, the time he gets up is the prescribed time of Salah. In this regard, the Prophet (peace be upon him) said: He who falls asleep and fails to perform a Salah (prayer) or (Part No. 6; Page No. 157)
forgets to perform a Salah (during its prescribed time), its expiation is only that he should observe it when he remembers it. (Recorded by both Al-Bukhari and Muslim.)

| 13 | The Disbelieving father May not be a Guardian of his daughter in marriage
Question:
A young Muslim man wants to marry a Muslim girl, but her father, who is a habitual drinker, and an apostate always refuses. Is it permissible for this to contract the marriage of his daughter?
Answer:
If she is a Muslim, then there is no objection to the young Muslim man marrying her. But her father may not be her guardian if he is a disbeliever; instead, her brother may give her in marriage, if she has a good brother, or her paternal uncle, or her paternal cousin, or her brother's son -if she has paternal Muslim relatives- then the nearest of them may give her in marriage. And if there is no one beside the disbelieving father, the Judge may give her in marriage.

While explaining the hadeeth of Fatimah bint Qaes (may Allah be pleased with her); in which she approached the Prophet صلى الله عليه و سلم and informed him that individuals have approached her for marriage, upon hearing the names of these individuals the Prophetصلى الله عليه و سلم replied:
As for Abu Jahil, he does not remove the stick from his shoulder (he beats women), and as for Mu’awiyah, he is poor. Instead, marry Usamah. (Saheeh Muslim)
Sheikh ‘Uthaymeen commented (in summary):
If it were said: How can the Prophet صلى الله عليه و سلم say: “As for Mu’awiyah, he is poor”, while he (the Prophet) doesn’t know? It’s possible he (Mu’awiyah) will become wealthy (in the future). And actually, this did take place. Mu’awiyah became a ruler; in fact he became one of the wealthiest rulers.
Thus, we say: From this hadeeth a vital benefit can be derived, which is: That which should be considered is what is apparent, not what will possibly occur in the future. Pay close attention to this principle. An individual is not commissioned to (consider) matters of the unseen, but rather, he is responsible for that which is in front of him.
Consequently, we know the answer for a commonly mentioned question (issue). This occurs when a man who is not practicing seeks to marry a practicing female. The female would like to marry him and thus she says: It’s possible that Allah will guide this man by way of me. This action (him changing) may or may not occur in the future. She does not know, but that which is presently apparent is that this individual is not practicing. If the female was to say: It is possible that Allah will guide him by way of me, we will respond: It is (also) possible that Allah will lead you astray by way of him! Both of these outcomes are possible, and you (the female) being led astray by way of the man is more likely, due to the fact that the authority and influence of the man over the woman is much greater than her authority and influence over him. Likewise, how many men put pressure on their wives to perform something that the husband wants, and due to his pressure, the female falls into something she herself dislikes. This is something which is known and proven.
The most important benefit in this issue is that a person is responsible for that which is apparent, not that which will may or may not occur in the future.

Remaining with a husband who does not pray is not allowed as he is a disbeliever (kaafir).

💠 Question:
If a women is married and her husband does not pray, is it permissible for her to leave him?
Answer:
If a woman is married and her husband never prays, not in the congregational prayer or by himself, then her marriage to him is void and she is not his wife. She is not permissible to him in marital relations, because she has become as a strange woman to him. It is obligatory in this situation for her to go to her family and exert her utmost efforts in separating from this man who has disbelieved after his Islam. (Refuge from this is with Allah). Upon this I say, it is not permissible for any woman whose husband does not pray, to stay with him for the blink of an eye, even if she has children from him. The children in this situation will remain in her custody of a Muslim. If Allah guides her husband, and she returns to him if she is still within her waiting period. If her waiting period finishes before he returns to the prayer then her affairs are in her own hands. Most of the scholars are of the opinion that the wife of an apostate is not to return to him if he returns to Islam after her waiting period has finished except by concluding a new marriage contract.

💠 Question:
My husband neglects his religion; he does not fast in Ramadaan and he does not pray, and moreover, he stops me from doing any good deed. He has also started to be so suspicious of me, that he has left his work to stay home so he can watch over me. What should I do?
Answer:
It is not permissible to stay with a husband who is like this, because by neglecting the salaah (prayer) he is a kaafir, and it is not permissible for a Muslim woman to marry a kaafir or stay with him.
Allah says (interpretation of the meaning):
“… if you ascertain that they [women] are true believers, send them not back to the disbelievers, they are not lawful (wives) for the disbelievers nor are the disbelievers lawful (husbands) for them…” [al-Mumtahinah 60:10]
The marriage between you and him is null and void, and there can be no nikaah (marriage) between you unless Allah guides him and he repents to Allah and comes back to Islam. In that case the marriage will remain valid. The husband’s conduct is not correct, and it seems to me that he is suffering from some kind of (mental) illness, namely paranoia and waswaas (insinuating whispers of the Shaytaan) from which some people suffer with regard to their worship and their dealings with others. Nothing will get rid of this sickness but remembering Allah (dhikr), seeking refuge in Him and putting one’s trust in Him to get rid of it. What matters is that for your part, you have to leave him and not stay with him, because he is a kaafir and you are a believer. With regard to your husband, we advise him to come back to his religion and to seek refuge with Allah from the accursed Shaytaan, and to try to recite some beneficial du’aa’s with which to rid his heart of this waswaas. We ask Allah to help him. And Allah knows best.
