Net10 Wireless markets certain plans as "unlimited data" services, these plans, in fact, offer limited high-speed data, after which the data speed is throttled to a level that severely impairs basic internet functionalities including, but not limited to, checking bank accounts or even verifying the connection speed in which we have recorded evidence. This practice is not only misleading but potentially violates consumer protection laws that are designed to ensure fairness and transparency in marketing and selling practices. We believe that these actions may constitute a breach of the following: 1. [Federal or State Consumer Protection Laws]: These laws are intended to protect consumers against unfair, deceptive, or misleading advertising and business practices. For example, the Federal Trade Commission (FTC) Act prohibits unfair or deceptive advertising in any medium. 2. Contractual Obligations: If the terms of service are not being adequately fulfilled as promised under the contractual agreement between Net10 Wireless and its customers, this may amount to a breach of contract. While I prefer to resolve this matter amicably and outside of court, I are prepared to take further legal action if necessary to ensure compliance with the law and fair treatment for all Net10 Wireless customers. This letter serves as a formal request for Net10 Wireless to: Cease all deceptive marketing practices related to the advertising of "unlimited data" where such claims are not fully transparent about speed throttling after certain data usage. Make immediate adjustments to the data service provided to affected individuals to align with advertised promises, or alternatively, adjust marketing materials to accurately reflect the nature of the service provided. Please consider this communication as our earnest attempt at an administrative remedy. I hope that Net10 Wireless will take immediate action to address these concerns. Failure to respond within [30 days] will leave me no choice but to consider pursuing litigation to seek a resolution.
