The Karnataka High Court has held that an alleged promise to marry made after having sexual intercourse does not attract Section 69 of the Bharatiya Nyaya Sanhita (BNS), 2023. A single-judge bench made the observation while granting regular bail to the accused, noting that for an offence under Section 69 to stand, the false promise must operate as the direct inducement to obtain consent before the sexual act occurs. According to the prosecution, the complainant and the petitioner were in a relationship, and physical intimacy took place before any proposal of marriage was raised. The petitioner allegedly assured marriage subsequently but later reneged on the commitment. The High Court clarified that when physical relations precede any commitment, the essential ingredient of deceitful inducement under Section 69 BNS is prima facie absent. Differentiating between a pre-meditated false promise used as bait and a subsequent breach of an assurance, the court granted bail subject to standard conditions.
