*Supreme Court Postpones Decision for Disqualification of 12 Bulawayo MPs* The Supreme Court has postponed the matter for the Citizens Coalition for Change (CCC) 12 Bulawayo MPs who are facing possible disqualification from the upcoming elections. This comes after the High Court ruled that they submitted their nomination papers after the 4pm deadline. *By Tongai Mwenje* The High Court's ruling goes against the confirmation made by the Zimbabwe Electoral Commission (ZEC), which stated that the 12 aspiring MPs submitted their papers before the 4pm deadline. During today's hearing, the CCC legal team, comprised of Professor Welshman Ncube, Advocate Thabani Mpofu, and Jeremiah Bhamu, presented factual submissions to the three-member Supreme Court judges team. The team argued that their clients had indeed submitted their nomination papers on time and that the High Court's ruling was erroneous. After hearing the arguments put forth by both appellants and the respondents, the Supreme Court judges decided to postpone the matter to tomorrow at 12pm for judgment. This delay has left many in suspense, as the fate of the 12 Bulawayo MPs now hangs in the balance. The CCC, the biggest opposition party in the country which is seeking change in Zimbabwe, has been fighting tooth and nail to ensure that their candidates are allowed to participate in the upcoming elections. The disqualification of these 12 MPs would be a significant blow to their campaign and could potentially plunge the country into an unprecedented electoral and national crisis. “The High Court ignored the evidence of @ZECzim to the effect that the document relied upon by the applicants did not reflect the time of submission but the time data was captured into the system. ZEC accepted that the appellants submitted well before 4pm.” “Under the Judicial Laws Amendment Act, only the Electoral Court has jurisdiction to entertain challenges to the nomination of candidates. The High Court erred by hearing a case that falls under the exclusive jurisdiction of a specialised court,” argued the CCC legal team. On the other hand, the ZEC through an affidavit has maintained that their records show the nomination papers were submitted before the deadline. They clarify that the ZEC nomination court form, which is circulating on social media platforms, displays the time at which the data clerk successfully captured the information, not the time the court papers were submitted. As the nation eagerly awaits the Supreme Court's judgment, the outcome of this case could have far-reaching implications for both the CCC and the upcoming elections. The decision will not only determine the fate of the 12 Bulawayo MPs but also set a precedent for future disputes regarding nomination deadlines and the integrity of the electoral process. For now, all eyes are on the Supreme Court as Zimbabweans anxiously anticipate the final verdict. The postponement has only heightened the tension surrounding this case.
