Now, obviously when one is dealing in a TRO situation, I memorialized it in shorthand, but you are telling me that that very clear point, you are saying that you felt that you could disregard it because it wasn't in the written order?"
Boasberg admits his "verbal" order and minute order--he rushed it in order to turn the ACLU lawsuit into a class action suit covering all illegals under the president's proclamation--are inconsistent.
SO NRO--which court order did the president "defy?"

I just purchased the transcript of the March 17 hearing before Jeb Boasberg. Even though I covered it live, reading the transcript is more infuriating.
Boasberg continually challenged the DOJ's argument that his written order---posted at 7:26pm--controls over this "verbal" order at about 6:45pm that night.
And in doing so, Boasberg demonstrates why a verbal order is not generally accepted. ("I think I meant...")

Boasberg suggested during Monday's hearing that NO deportation flights should have taken off because he had scheduled a hearing for 5pm and the DOJ should have known he would try to order the return of planes already in the air π
He again confirms the inconsistencies between his 2 "orders" The written one was "pithier?" Is that a judicial term lol

I knew I had the Ray Epps sentencing transcript--just found it.
In Jan 2024, Judge Boasberg again referred to Jan 6 as an "insurrection" by Trump supporters--and implied the president was responsible.
He gave Epps a slap on the wrist by lamenting his alleged victim status:

I have obtained the transcript of the hearing yesterday before Judge Beryl Howell related to Perkins Coie lawsuit against the president for his executive order punishing the firm in a variety of ways. (Will post snippets later this evening.)
As I noted yesterday--while Howell did not include the security clearances as part of the temporary restraining order, she very likely will in the future.
Perkins Coie lawyer:
"The reason is that we picked the sections [1, 2 and 5] where the harm was most immediate and the infirmity most clear and the remedy most clear. The other provisions in our...if you set a preliminary injunction hearing, we believe we will be able to demonstrate that they are constitutionally invalid as well."

NEW: In a court filing yesterday, EPA explained just some of the fraud and conflicts of interest associated with the $20 billion climate slush fund.
Judge Chutkan in a hearing yesterday afternoon repeatedly demanded proof of fraud or criminal conduct needed to justify EPA Adm. Lee Zeldin's cancelling of the contracts receiving the funds.
(1) Jahi Wise, the former director of the Greenhouse Gas Reduction Fund (the Biden policy that created the bounty), personally oversaw a $5 billion grant to his previous employer, the Coalition for Green Capital, without recusing himself.
(2) A $2 billion grant to Power Forward Communities, a new nonprofit formed in 2023 with ties to Stacey Abrams.
(3) A group called "Young, Gifted, and Green" was awarded $20 million while its CEO served on the White House Environmental Justice Advisory Council.
This is the TIP of the icerberg.

This TRO only applies to 3 sections of the exec order for now, including limits on access to government buildings and government contracts.
But Perkins Coie is asking Howell to declare the ENTIRE executive order, which includes revocation of security clearance, unconstitutional. This TRO is a first step.
And given Howell's outlandish comments today, no one should doubt that is precisely what she plans to do.
As we've learned---TROs are usually not appealable. and SCOTUS is loathe to intercede. DOJ likely will wait until Howell issues a preliminary injunction before it appeals to DC circuit.
