As you go through this topic: Forest Conservation Act (Amendment) 2023: you must have a background understanding of Forest Conservation Act 1980 and related laws in India. 1. Forest. Related matters come under the concurrent list in India and thus both central and state government can make laws on it. 2. Certain forests are “notified as forests” and any diversion of notified forest lands for infrastructure, industrial purposes etc requires prior approval from government and compensatory afforestation to compensate for loss of forest area due to to developmental activities. 3. 1996 (Godavarman )judgement of Supreme Court said even if the central government does not notify a forest like area “as a notified forest”, for the purpose of forest conservation act, the state government is free to classify a land as forest land on the basis of its own criteria. These points are also relevant for prelims examination as environmental legislations are a high yielding topic for prelims.
