Open any 3D marketplace — Cults, MyMiniFactory, Etsy, Patreon. You’ll see countless miniatures, busts and sculptures that are instantly recognizable: white hair + two swords + scar across the eye… night-elf armor with moon symbols… baseball bat + patched backpack…
But the title says: “White Wolf” “Moon Priestess” “Post-apocalyptic single dad”
No “Geralt”. No “Tyrande”. No “Joel”.
Why?
1️⃣ It’s not creativity. It’s legal camouflage. Character names, looks, symbols and settings are protected IP. Blizzard, Naughty Dog, CD Projekt RED own them. Using the real name in a commercial listing = direct infringement. A vague title (“elf girl in purple”) creates a buffer. Harder to prove intent. DMCA bots often miss pure visuals without text triggers.
2️⃣ “Fan-art” is not a magic shield. Commercial use ≠ fair use. Selling a physical copy of someone else’s character is not parody, critique or transformative work. It’s straight-up replication. Official licenses exist (WizKids, Good Smile etc.). Random Patreon creators don’t have them. Zero.
3️⃣ Why does this still work? Because hunting is more expensive than the prey. Companies can DMCA or sue almost any of these models. But tracking thousands of tiny creators worldwide costs more than the money they could recover. So they hit the big fish and leave the small ones swimming. This creates the illusion that “everyone does it, so it’s fine”.
4️⃣ What’s actually happening The creator takes years of someone else’s design, recognition and emotional connection… and monetizes it without investing in original lore, marketing or development. Ready-made fame > building your own character from scratch. That’s not entrepreneurship. That’s arbitraging someone else’s cultural value.
When the same person starts talking about “rights”, “piracy” or “creative freedom”… remember the context. They’re defending the profit they made from an asset that isn’t theirs.
Bottom line: “Elf Queen” is just a quiet way to sell what doesn’t belong to you.
Non-commercial, transformative, honest fan-art is powerful. A production line of copies under the label “inspired by” is just a grey market of other people’s ideas.
