What's up with Ola, Uber, and Rapido? The Delhi Government has made the decision to ban the bike taxi services offered by Ola, Uber, and Rapido on the grounds that they were unauthorized under the Motor Vehicles Act of 1988. The question is, why did the government forbid these services? According to the Delhi Transport Department, commercial bike taxi services like Ola, Uber, and Rapido use private bikes, and transporting people on private bikes for employment or profit is, therefore, illegal under the Motor Vehicles Act of 1988. Due to a lack of rules and regulations, the transport department does not currently grant business permits to two-wheelers. These private taxis do not have the yellow plates with PSV insignia that are required by the Act for taxis. Authorities have also issued diktats due to worries over drivers' improper identification and the safety of passengers, particularly women The department stated that because digital platforms are acting as aggregators by aiding taxi service operations through the use of an app, they are in violation of Section 93 of the Act and subject to fines of up to Rs. 1 lakh. But what does section 93 of the Motor Vehicles Act of 1988 state? "93. Agent or canvasser to obtain a license. (1) No person shall engage himself- as an agent or a canvasser, in the sale of tickets for travel by public service vehicles or in otherwise soliciting custom for such vehicles, or as an agent in the business of collecting, forwarding or distributing goods carried by goods carriages, unless he has obtained a license from such authority and subject to such conditions as may be prescribed by the State Government." Recently the Supreme Court refused to grant relief to bike taxi aggregator Rapido against the Maharashtra government's refusal to grant a license to it. It had noted that amendments made to the Motor Vehicles Act in 2019 made it clear that aggregators cannot operate without a valid license. On Monday, Transport Minister Kailash Gahlot said a draft aggregator policy for two-, three- and four-wheelers will be rolled out soon. As per the public notice issued by the Delhi Government if Ola, Uber, and Rapido bike drivers continue driving then the bike riders of such companies will be liable to If caught a fine of Rs 5,000 will be charged. If the offense is committed again, then a fine of Rs 10,000 will be charged as well as imprisonment. If the offense is repeated, the driving license of the driver can also get suspended for a minimum period of three months.
